JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Division.
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a sole source basis for critical highly specialized material to support the Fleets’
Carry-on Equipment (COE) suite by NSWCDD, Combat Direction
Systems Activity, Dam Neck, Special Technology Branch, manufactured by Engineering Design Team, Inc. (EDT).
3. Description of Supplies/Services
EDT will be providing a quantity of twenty-six (26) Peripheral
Component Interconnect Express LX 3P field-programmable gate array (FPGA) card sets, part number 019-14395. This procurement of current field equipment is needed to satisfy fleet specific mission requests related to National Security and is a direct match for the current COE suite, providing the required range and sensitivity while maintaining the interoperability, functionality and compatibility with current system configurations designed to interface with a tactical network.
Several COE shipboard design restrictions such as weight, depth, power, reliability, integration testing, military standard testing, and information assurance (IA) compliance makes the EDT units the only equipment that satisfies all of the government’s specifications. The government has already made significant investments in these units with regards to the integration into shipboard installation Temporary Alteration (TEMPALT) design, government engineered software, and configuration management.
The introduction of any other hardware is not considered to be in the best interest of the Government with regards to configuration, performance, supportability, and cost.
The Government's minimum needs have been verified by the certifying technical and requirements personnel.
The estimated cost of the proposed contract action is
$321,710.00, Fiscal Year 2016 Other Procurement, Navy will be utilized for this procurement.
4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c)(1) – Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
The EDT chassis and FPGA are an integral part of an established
COE Shipboard Systems infrastructure. These systems are currently fielded on deployed fleet assets and a substantial development cost has already been made by the government. The government’s initial investment includes shipboard design, TEMPALT development, hardware configuration, shipboard mounting design, government-developed software, IA accreditation, operator and maintainer training, and associated operations, maintenance and training documentation and testing; all utilizing the specific hardware for this unit. The introduction of any other manufacturer’s digitizer will not allow the operators or the fleet to utilize the key applications developed for this hardware.
In addition, the use of another vendor’s product, assuming a qualified vendor or product can be found, would require unbudgeted and unanticipated system integration, operability, functionality, software redesign, form fit re-design, accreditation and testing. Another manufacture’s product would result in new electromagnetic interference testing, IA accreditation, specialized government software development, shipboard integration or TEMPALT design, training of operators, and a new logistic tail. With regard to configuration, performance, functionality, schedule, and cost, it is not considered to be in the best interest of the Government to use another manufacture’s variant of this hardware. Estimated additional costs to the government would be approximately
$2,000,000.00, and extend deployment of this capability to the fleet by a minimum of eight months, which would not be recouped through open competition.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
A patent, copy right or proprietary data limits competition.
Market research included contacting EDT, the Original Equipment
Manufacturer and it was found that there are no authorized resellers for the requested components. The requirement is to leverage the hardware, software, and TEMPALT design to which the government is already committed. There are no resellers available for these proprietary mission essential components related to National Security.
A Sources Sought notice for the acquisition was posted on the
Federal Business Opportunities (FEDBIZOPS) website on 24 June
2016 requesting capability statements from interested vendors to confirm that the OEM was the sole source provider for the requested equipment. No responses were received during this timeframe.
The proposed acquisition was then synopsized on the FEDBIZOPPS website on 8 July 2016 and two submissions were received, one from the OEM EDT and one from a vendor, Leslie McDermott, Inc..
Per the OEM, they have no authorized distributors and all sales should be direct from them. The submission from Leslie
McDermott, Inc. is found to be not acceptable as verified by the
OEM. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than EDT to provide the required equipment.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the Justification and Approval will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract
Division has no plans at this time to compete future contracts for the type of equipment covered by this document specifically due to the components being in a National Security System. If another potential source emerges, Dahlgren Contract Division will assess whether competition for future requirements is feasible.
