IN REPLY REFER TO

DL 13354

N00178-15-C-4311 29 June 2015

FOR OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division, Contracts Division.

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical components

, manufactured by Rugged Systems Incorporated, doing business as Core Systems.

3. Description of Supplies/Services

Core Systems will be providing a quantity of one-hundred and sixteen (116) Custom AR3 Sealed Fanless Chassis, Part Number - 11064-AR3.NT2 and quantity twenty six (26)Part Number- 11064- AR3-NT2 as follow:

Part Nwnber Qty. Unit Price Ext. Price

11064-AR3-NT2 116 $14,925.00 $1,731,300.00

Total $2,187,824.90

The required delivery date is sixty (60) days after award of the order. The optional units are requested to be available through the end of Fiscal Year (FY) 2016.

. These units have the advantage of a smaller mechanical footprint and reduced weight, qualities advantageous in aircraft systems.

These AR3 Chassis have newer technologies yet they provide the same functionality, electrical interface, and fire control compatibility

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated value of this acquisition is $2,187,300.00.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies ?r services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

, d g e

This procurement is essential for continued support in that it provides inexpensive, commercial off-the-shelf (COTS) digital and analog Input/Output (I/O) modules compliant with the AR3D MIL-SPEC CHASSIS, which has been identified as the computing hardware for the next iteration

The requirements for reduced weight and footprint are levied by the program's sponsor, and to date this AR3 computer chassis is the only compatible chassis found to meet the sponsor's requirements while operating in the harsh military flight environment. The BMS GCC configuration is set for validation trials onboard a test aircraft during early Fall 2015. No other computer chassis has been found that would meet the mechanical footprint, weight, or BMS aircraft system interface requirements. Due to the proprietary nature of the components, no other source or resellers are available. The Government has spent four (4) man years on design, development, integration, and proof testing/validation efforts estimated at more than $1.2M, which is unlikely to be recovered using competitive procurement to purchase a different brand name or model computer chassis.

6. Description of Efforts Made to Solicit Offers from as Many Of ferors as Practicable

Previous market research was conducted during requirements analysis. This particular computer chassis was the only one found that met all Government requirements on the previous program of Dragon Spear. Current market research has confirmed that Core Systems is still the sole manufacturer of this proprietary AR3 computer chassis; there are no authorized resellers.

The Sources Sought was posted on 8 July 2015 and the proposed contract was posted on the Federal Business Opportunities website (FedBizOpps) . No further market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than authorized resellers to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract Division has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges or a complete redesign occurs, Dahlgren Contract Division will assess whether competition for future requirements is feasible.
