JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Division.
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a brand name basis for critical equipment for the Vertical Launching System (VLS) which is a primary system within the Aegis Combat System (ACS), manufactured by Leica Geosystems.
3. Description of Supplies/Services

The Government's minimum needs have been verified by the certifying technical and requirements personnel.
The estimated value of the proposed contract action is $388,791.00. Fiscal Year 2013 (FY13) Ship Building and Conversion, Navy, funding will be utilized for this procurement.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) – Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority

Leica AT960LR with computer and SA-Pro are a critical pieces of equipment needed in order to properly perform this task.
The VLS program (IWS 3L) requires validation of material components of the VLS Assembly (eight cell interim structure assembly), sub-assemblies (top deck structure, uptake upper, uptake intermediate, base structure assembly) and support equipment (VLS Tilt fixtures, spanning tools) produced by the vendor. These components will be validated at the vendor site and at Government owned facilities.
The selected coordinate measuring machine (CMM) requires the following:
Must be able to operate in a standard and inverted mode (tripod and hung) and have 6 degrees of freedom.
| Must be able to measure distances (external dimensions of assemblies) of 112 in. width and 117 in. length with accuracy in flatness, perpendicularity and parallelism of at maximum 0.010 inches of error. |
| Must be able to measure depths of interior surfaces (canister) of 252 in. depth with accuracy in flatness, perpendicularity and parallelism of at maximum 0.010 inches of error. |

September 2015 delivery of the first vendor produced item.
The Government must validate the products from the vendors against as-built drawings before acceptance. The requirements stated are derived from the requirement to measure external and internal dimensions and tolerances from the original engineering drawings.
The alternative to this purchase is to produce specialize gages to perform these measurements. It is estimated that there will be a total of 22 required gages that have not been commissioned. The effort to engineer, fabricate and maintain these gages is estimated at $500,000 and would require at least 1 year to produce. These single attribute gages cannot be repurposed.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Extensive market research was conducted in an attempt to find other sources for Laser Measuring System that would meet the current design requirements. An exhaustive review of manufacturer websites, catalog resources and demonstrations indicated that there are no comparable solutions to the technical specifications that will meet the Government’s minimum requirements.
Current market research has confirmed that Leica Geosystems is the sole manufacturer of items which are compatible and acceptable for the VLS assembly validations. Hexagon Metrology, Inc. is the only authorized distributor in NSWCDD’s regional area for Leica Geosystems products.
The proposed contract was synopsized on the Federal Business Opportunities (FEDBIZOPPS) website on 23 June 2009 and only Themis Computers and authorized resellers expressed an interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Hexagon Metrology, Inc. to provide the required products.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract Division has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Division will assess whether competition for future requirements is feasible.
