FOR OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Division

2. Description of the Action Being Approved

Award of a firm fixed priced contract on a sole source basis for critical equipment 6 manufactured by X-COM Systems LLC.

3. Description of Supplies/Services

X-COM Systems LLC will be providing the following components:

The power supplies are repair parts needed to replace components damaged during a power surge.

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

X-COM Systems LLC is the original equipment manufacturer and has proprietary rights for switches and devices currently installed in multiple sites. X-COM Systems LLC holds a patent for the technology used in their switching systems and no other switch manufacturers can supply both Naval Tactical Data System (NTDS) and ORTS Data Bus interface switching products that will function in existing X-COM switch chassis, nor can they perform engineering services or repairs on these items. In addition, utilizing another vendor's products would require changing to a new design, which would result in a substantial duplication of costs estimated at approximately $1,850,000.00. The estimated cost breakdowns follow: Non-Recurring Engineering at $120,000.00; Switching Equipment for 256 Discrete Ports at $1,600,000.00; Cables and consumables at $60,000.00; and Labor (Installation and User Training) at $70,000.00. These are costs to the Government that would not be recaptured through competition

6. Description of Efforts Made to Solicit Offers from as Many Of ferors as Practicable

Market research conducted included the following: Contacting knowledgeable individuals in government and industry regarding market capabilities to meet requirements; Reviewing the results of recent market research undertaken to meet similar or identical requirements;

and Reviewing catalogs and other generally available product literature published by manufacturers, distributors, and dealers or available on-line.

As a result of the above market research and the review of the manufacturer's compatibility and system specifications, it was revealed that these products would be the only solution compatible with the X-COM physical layer switch chassis

The Sources Sought was posted and the requirement will be synopsized on the Federal Business Opportunities (FEDBIZOPPS) website. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than X-COM Systems LLC to provide the required equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Dahlgren Contract Division has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Division will assess whether competition for future requirements is feasible.
