JUSTIFICATION

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department.

2. Description of the Action Being Approved

Award of a Firm-Fixed priced contract on a sole source basis for modifications to existing Advanced Boresight Equipment (ABE)

Interface Control Documents (ICDs·) , Software End Product Information, in support of the Battle Management Systems (BMS) Program, to AAI Corporation, a/d/b as Textron Systems.

3. Description of Supplies/Services

The proposed award will procure modifications of existing (ABE), Interface Control Documents (ICDs), Software End-Product Information, supporting data and training for the changes made to the ABE.

The Government's required delivery date for all the work to be complete is July 01, 2016. It is estimated to take a total of six (6) months.

The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The total estimated value of this acquisition is $243,100 . 00.

4. Statutory Authority Permitting Other Than Full and Open Competition

This justification is based upon the authority of 10 U.S.C.

2304(c) (1), as implemented by FAR 6.302-l(a) (2) (iii) (A), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5 . Rationale Justifying Use of Cited Statutory Authority

Full and Open competition is not feasible since Textron systems is the original equipment manufacturer (OEM) of the ABE equipment. As a result of market research and the review of the manufacturer's compatibility and system specifications, it was revealed that all current personality modules and software are proprietary to them.

NSWCDD has been directed by the Air Force, which sponsors this project that no other boresighting equipment is to be used on their aircraft platform weapon systems. Currently the Air Force utilizes this ABE to align several different t m systems including which the system's provisioning and logistical planning is already under the purview of the Air Force. There are no other approved systems for use by the Air Force.

The estimated total cost for the development of a new boresighting system were based on costs derived from labor categories, labor mix, and quantities of those categories towards development of a new system. It's estimated Three (3) mechanical engineers, One (l) electric engineer, and two (2) software engineers would be required using the average engineering loaded labor rate of $140/per hour, derived from BMS's recent existing contract awards. The material costs were based on the current price of the ABE and costs of the existing system. The labor hours were derived from communications with the Pro on previous efforts towards and with the current s so ware towards this current effort. The software lead also concurred with the labor mix for this estimate. The total labor estimate came to $1,680,000 and materials were $350,000. This brought the total to $2,030,000.00. Development of an entire new system is 10 times that to modify the current one. Based on this estimate, the use of any other source would result in substantial duplication of

cost to the Government that is not expected to be recovered through competition. It is in the best interest of the

·Government to continue this association with Textron.

6. Description of Efforts Made to Solicit Offers from as Many Offerers as Practicable

In accordance with FAR 5.201, the proposed action was synopsized on the Federal Business Opportunities (FBO) website on May 20, 2015. In addition, the synopsis invited all responsible sources to submit a capability statement;, proposal or quotation for the agency to evaluate in compliance with PGI 206.302-1. No additional market research was conducted because it was not practicable, for the reasons discussed in paragraph 5 above, for any company other than AAI a/d/b as Textron Systems to provide the required equipment modifications and personality updates.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated· cost to t?-e . Goye,:i;:'nment ,f<;n; ~h~ equipment covered by the1 J&A will be found fair and reasonable through price analysis.

8. Actions 'to· Remove Barriers to Competition

Due to the Proprietary nature of this procurement and for the reasons set forth in paragraph 5, there is no plan to compete this requirement in the future . If another source is identified, competition would be utilized if in the best interest of the government.
