FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Contracts Division.
2. Description of the Action Being Approved
Award of a cost-plus-fixed-fee contract on a sole source basis to Northrop Grumman, 468 Viking Drive, Virginia Beach, VA 23452 for the procurement of hardware development and production for Ship Self Defense System (SSDS) Mk2 Command and Control Hardware and engineering support services.
3. Description of Supplies/Services
Northrop Grumman shall develop and deliver hardware as specified by the Government's Preliminary Technical Data Package (TDP), consisting of mechanical, electrical and assembly drawings. The scope includes: hardware development, hardware production (which may include GFE), assembly, configuration, alignment, integration, testing and shipping for the SSDS Mk2 system hardware, typically ordered by the cabinet.
The Government's minimum needs have been verified by the certifying technical and requirements personnel.
The estimated dollar value of this contract is $11,005,741. SCN and OPN funding will be utilized for this requirement. The below table provides a breakdown of the funding:

4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c) (1), only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
Northrop Grumman is currently providing engineering services as part of the design, prototyping and environmental qualification testing of various equipment. Combat Direction Systems Activity (CDSA) Dam Neck has invested approximately $3.7M in this tasking, for which Northrop Grumman has produced First Article units without TDP's. The knowledge and expertise possessed by Northrop Grumman makes it possible for them to produce the necessary equipment before the completed TDP's are available. Until such time that TDP's are available, Northrop Grumman is the only company capable of meeting the current requirements.
If a sole source contract to Northrop is not awarded, it would be necessary to delay production until the TDP's are complete and a competed IDIQ contract is in place.
In order to meet this timeframe, it is necessary to award a sole source contract to Northrop Grumman, which does not require completed TDP's.
Northrop Grumman is currently assisting in finalizing designs and redline drawings in the TDP's, which are approximately 75% complete. It is estimated that the drawings will be completed in six (6) months.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
In accordance with FAR 5.201, the proposed action was synopsized in both the Federal Business Opportunities (FBO) and the Navy Electronic Commerce Online (NECO) as a sole source procurement.

The synopsis posted on December 6, 2012. No other parties expressed an interest.
7. Determination of Fair and Reasonable Costs
The contracting officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
The Government intends to competitively solicit an Indefinite Delivery, Indefinite Quantity (IDIQ) production contract once the TDP's have been completed; however delays in development funding have resulted in the SSDS Mk2 TDP's still being incomplete at this time.
