REPLY REFER TO:
J&A No.: J&A6.302-1-18-AR01 03 Aug 18
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Identification of Agency and Contracting Activity.
Naval Research Laboratory, 4555 Overlook Avenue, SW, Washington, DC 20375-5000.
2. Nature/Description of Action.
The contract action being approved is an award for a cost-plus-fixed-fee (CPFF) bridge contract, on a sole source basis, in order to provide IT services for the purposes of science and operations support for several NASA missions. The proposed source is Information Delivery Systems Inc.
(IDS) (incumbent for contract: N00173-17-C-6007). IDS is located at 7305 Quetzal Dr, Bowie, MD 20720-4349.
3. Description of Supplies/Services.
The contractor provides IT support to the Space Science Division. The costs outlined in the table below reflect the labor costs for 4.75 FTEs over 6 months (POP for the bridge contract).
Estimated Dollar Value
FY18 Total
RDT&E $469K $469K
4. Identification of Statutory Authority.
The statutory authority permitting other than full and open competition is Title 10 U.S.C.
2304(c) (1), Only one responsible source, as implemented by the Federal Acquisition Regulation (FAR) 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. As further implemented by FAR 6.302-1(a)(2)(iii) where services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s
J&A No: J&A6.302-1-18-AR01 requirements.
5. Demonstration of Contractor’s Unique Qualification.
The NRL Space Science Division (SSD) has IT requirements directly related to contracts for providing science and operations support for several NASA missions.
Specifically, the Wide-Field Imager for Solar Probe (WISPR) is an NRL SSD instrument for the NASA Parker Solar Probe (PSP) mission that is currently schedule to launch on August 11, 2018.
NRL SSD has several requirements from the NASA sponsor which must be met by launch + 30 days currently September 11, 2018. These requirements include hosting a web site that describes the NRL SSD instrument, WISPR, and will serve out the WISPR data to the scientific community.
NRL SSD has been working on this function and is ready to transition it operationally.
Additionally, the SSD has NASA contracts to provide operations and science support for the EUV Imaging Spectrograph (EIS) instrument on the Hinode mission, and the Sun Earth Connection Coronal and Heliospheric Investigation (SECCHI) instrument suite on the Solar TErrestrial RElations Observatory (STEREO) mission. These obligations require timely network access for submitting observing plans as well as support for large disk arrays for storing and distributing data.
In summary, while it may be the case that others can provide the required tasks listed above, there is no one else uniquely qualified to perform these aforementioned tasks without an unacceptable delay to the work that needs to be completed within the specified timeframe.
6. Description of Efforts to Ensure Other Potentials Sources Were Sought.
A presolicitation notice was published to Federal Business Opportunities (FBO) website, at fbo.gov, on July 27, 2018 with a response date of 8/11/2018.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.404-1(b)(2)(v), the Government will use the Independent Government Cost Estimate (IGCE) in combination with FAR 15.404-1(b)(2)(ii) Comparison of proposed prices to historical prices paid, in order to determine whether the proposed cost/price is fair and reasonable. In accordance with FAR 15.403-4 certified cost or pricing data will be required. I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
8. Description of Market Research.
Market research was not conducted for the proposed 6-month bridge contract since pursuing other potential sources will result in unacceptable delays and disruption in critical science and operations support for NRL and NASA missions. As described previously, if this extension is delayed, it will cause work stoppage in critical NASA contracts and projects. Market research and other acquisition approaches were initially performed when contract N00173-17-C-6007 was initially awarded. This effort/J&A is a bridge until the recompetition can take place. These duties will be performed for the recompete effort that is currently on-going.
9. Any Other Supporting Facts.
None.
10. Listing of Interested Sources.
No other source expressed interest in providing the additional work required by this extension.
11. Actions Taken to Remove Barriers to Competition.
This bridge contract is a one-time requirement. This 6-month bridge contract allows for the time necessary to recompete the full five-year (60-month) requirement for the necessary research and development work. This bridge action is being used as a temporary means of preventing a gap in critical services to NRL while simultaneously allowing the time needed in order for full and open competition to occur.
12. Statement of Delivery Requirements.
The Wide-Field Imager for Solar Probe (WISPR) is an NRL SSD instrument for the NASA Parker Solar Probe (PSP) mission that is currently schedule to launch on August 11, 2018.
13. Reference to the Approved Acquisition Plan (AP) or Equivalent Documentation.
MOPAS # MPS-18-011 was approved by the Chief of Contracting Office.
14. Explanation of all actions attempted to make the immediate acquisition competitive and the cost /benefit analysis reflecting costs associated with obtaining competition and anticipated benefits.
This acquisition is for a bridge action for continued highly specialized services from the incumbent. Award to any other source would result in unacceptable delays in fulfilling the agency’s requirements. Government has begun the acquisition process of developing an acquisition strategy for the full and open competition of the required IT research and development effort. The bridge contract will commence upon award through 6 months and provide the continuation of services until a new acquisition strategy is executed.
