About this file

This document is a Sole Source/Brand Name Justification memorandum for a Navy procurement under the Simplified Acquisition Threshold (SAT). The procurement involves three specific hardware components from Concurrent Technologies Inc. for submarine monitoring systems: a 2.5" SATA Drive mounting kit, an RTM for use with PPB76 SBC, and a 6U CPCI SBC with a 6-core Intel XEON processor. The total quantity for each item is 24 units, to be installed in Monitoring Signal Data Converters for Total Ship Monitoring System (TSMS) on Los Angeles, Seawolf, Ohio, and Virginia Class submarines. The justification highlights that Concurrent Technologies is the sole source due to proprietary telemetry protocol units and exclusive knowledge of specific hardware configurations, with substitutions not approved to ensure critical data collection during acoustic trials.

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 4 Template Effective July 2024

USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN

SIMPLIFIED ACQUISITION THRESHOLD MEMO

FROM:

CODE: 765

TO: Code 02 SUBJECT: Sole Source Justification for Use of Other than Full & Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

3. Other Reasons:

B. SOLE SOURCE (select all that apply)

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

The requested equipment from sole source vendor Concurrent Technology is a critical pathway component associated with onboard data collection and analysis for Total Ship Monitoring System (TSMS) onboard LOS ANGELES, SEAWOLF, OHIO, and VIRGINA Class submarines equipped with Acoustic Rapid Commercial Off the Shelf Insertion (ARCI). This is to be installed in Monitoring Signal Data Converter (P/N CV-3399A/BYQ) for processing Noise and Vibration Monitoring data as part of Monitoring Subsystem on SSBN. The hardware configuration is specified by Monitoring Subsystem Temporary Engineering Change TEC-U090. These are Proprietary Telemetry Protocol units and substitutions are not approved, especially the Intel CPU components.

Failure to procure the requested equipment will prevent real-time data collection during acoustic trials, which will result in a loss of data due to limited ship availability.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

Concurrent Technologies is the only OEM and distributor as they hold proprietary knowledge of the configurations.

C. LIMITED SOURCE (FAR 8.405-6):

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).
