This is a combined synopsis/solicitation for commercial items prepared in accordance with Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The Naval Surface Warfare Center Carderock Division (NSWCCD) intends to solicit only one source under the authority of FAR Part 13.106-1(b) the Contracting Officer has determined that circumstances of the contract action deem only one source reasonably available. The Government intends to solicit with Magnolia Plumbing for continued wastewater delivery services

The NAICS code is 562119 and the Small Business Standard is $47 Million

The provisions and clauses included and/or incorporated in this solicitation document are those in effect through the Federal Acquisition Circular. This RFQ incorporates all provisions and clauses in effect through Federal Acquisition Circular FAC 2024-07 and the Defense Federal Acquisition Regulation Supplement (DFARS) DPN 20241010. CLAUSES AND PROVISIONS.

Interested parties may identify their interest to this requirement by submitting a capabilities statement no later than the response due date. This notice is NOT a request for competitive quotes. However, all capabilities statements received by the above deadline will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. All responses shall include price(s), FOB point, a point of contact, name and phone number, GSA contract number (if applicable), business size, and payment terms. Each response must clearly indicate the capability of the quoter to meet all specifications and requirements.

PERFORMANCE WORK STATEMENT

Performance Work Statement Wastewater/Sewage Hauling and Delivery Services

1.0 DESCRIPTION OF SERVICES/INTRODUCTION

As a follow-on to Contract N0016722P0223, wastewater hauling service is required to allow NSWCCD Code 633 to continue testing of a simulated shipboard sewage handling system in the NSWCCD wastewater laboratory using real-world sewage. Testing the system using real-world sewage enables the laboratory evaluation to be more representative of shipboard conditions. A wastewater hauler shall collect, haul, and deliver loads of sewage from a wastewater treatment plant to the NSWCCD wastewater laboratory in support of the sewage handling system evaluation.

2.0 BACKGROUND

Under Contract N0016722P0223, loads of sewage were delivered to the NSWCCD wastewater laboratory, which allowed Code 633 to test the simulated shipboard sewage handling system through FY23 and FY24. A new contract for additional loads of sewage is necessary to allow Code 633 to continue testing the sewage handling system through FY25, as tasked by the sponsor NAVSEA 05P5/F.

3.0 OBJECTIVES

NSWCCD C/633 requires wastewater collection from either the Little Patuxent Water Reclamation Plant located at 8900 Greenwood Place, Savage, MD or the Noman M. Cole Jr. Pollution Control Plant located at 9399 Richmond Highway, Lorton, VA. NSWCCD C/633 requires delivery of the collected wastewater to NSWCCD’s wastewater laboratory located at 9500 MacArthur Blvd., West Bethesda, MD 20817-5700 (Building 60, Room 175).

3.1 The contractor shall provide services at NSWCCD’s request throughout the period of performance, including during inclement weather. NSWCCD will notify the contractor at least 24 hours in advance when wastewater is required to be delivered. Deliveries shall be conducted Monday - Friday, during working hours, 0600-1500, excluding U.S. Federal holidays. Inspection and acceptance of the deliverables and services to be provided in accordance with this Performance Work Statement will be made by representatives of the Government at the destination.

3.2 The contractor shall provide the personnel, services, transportation, and materials necessary for collection and delivery of the following wastewater loads:

The maximum number of loads is 1 per day with a volume of ~2,500 gallons per load.

A ~2,500 gallon load must be delivered in a single delivery by a single truck.

Prior to offloading sewage to the NSWCCD wastewater laboratory tank, the contractor must verify of the alignment of their equipment and transfer valves, communicate with the government point of contact (POC), and wait for the government POC direction to commence sewage transfer.

3.3 The contractor shall be responsible for cleaning up any spillage. The contractor must provide a spill containment or contingency plan in the event that wastewater is accidentally spilled at the collection or delivery location. The contractor is required to be prepared with proper equipment to contain any such spillage (e.g., buckets, oil absorbent material/cloths, etc.).

3.4 Prior to collection of each wastewater load for NSWCCD, the contractor shall thoroughly flush/clean the inside of their tank, ensuring no grease or chemical residue remains in the tank, using hot water if necessary, to prevent contamination of the wastewater load. Rock, stones and gravel delivered in the wastewater shall be considered evidence that the wastewater collection point was from the source tank bottom, or the truck’s tank was not thoroughly flushed prior to collection, and will be cause for rejection of the delivery. Evidence of wastewater contamination from grease or chemical residue in the hauler’s truck will also be cause for rejection of delivery.

3.5 OPTION - There is an option to include 18 additional ~2,500 gallon loads which shall meet all the same requirements as identified above.

4.0 SPECIAL QUALIFICATIONS

The contractor must be certified, licensed, registered, bonded, and insured to collect and transport wastewater in Howard County, Maryland and Fairfax County, Virginia.

The contractor must have the following:

A truck capable of delivering 2,500 gallons of sewage to NSWCCD in a single load;

Equipment capable of pumping sewage from the hauling truck into the NSWCCD tank to a height of 15 feet for deliveries;

Approximately 200 feet of three-inch septic hose (such as Kana-flex or equivalent) with a three-inch male camlock connector for discharge. The hoses must be secured to the fitting using hose clamps that are rated for the maximum pressure (plus 25%) generated by the pump or clogged hose to prevent the hoses from detaching from the hose barb-camlock fitting.

Ability to thoroughly flush out their truck tank prior to wastewater collection, using hot water as necessary, to remove grease, chemical residues, and/or rocks from the tank to prevent contamination of the wastewater loads.

5.0 PERFORMANCE AND DELIVERY

5.1 Period of Performance

It is anticipated that the Base Award period of performance will be as follows:

Effective from date of award to 30 September 2025.

It is anticipated that the Option Award period of performance will be as follows:

Effective from date of award to 30 September 30 2025.

5.2 Place of Performance

All wastewater/sewage will be hauled from the Little Patuxent Water Reclamation Plant in Savage, MD or from the Noman M. Cole, Jr., Pollution Control Plant in Lorton, VA to the wastewater laboratory located at Naval Surface Warfare Center, Carderock Division, 9500 MacArthur Blvd, West Bethesda, MD, 20817-5700 (Building 60, Room 175).

5.3 Delivery Instructions from Collection Point

The contractor shall collect sewage from the Little Patuxent Water Reclamation Plant (Howard County, MD) in Savage, MD or from the Noman M. Cole, Jr., Pollution Control Plant (Fairfax County) in Lorton, VA, from the primary sludge thickener influent stream; then proceed to immediately deliver each load to NSWCCD, Bethesda, MD (Building 60, Room 175).

Prior to collection of each wastewater load for NSWCCD, the contractor shall thoroughly flush/clean the inside of their tank, ensuring no grease or chemical residue remains in the tank, using hot water if necessary, to prevent contamination of the wastewater load.

The contractor shall contact NSWCCD if they are unable to collect a sufficient volume of wastewater in a 2-hour period.

The contractor is required to coordinate each sewage collection period with the point of contact listed in the table below (to be provided at time of award).

The contractor must request the Noman M. Cole representative to turn off the polymer to the sewage and wait for about 20 minutes prior to collecting the sewage. Note that this does not apply to the Little Patuxent Water Reclamation Plant as this facility does not use polymer.

5.4 Delivery Instructions at Delivery Point

5.5 Delivery Inspection and Acceptance

Inspection and acceptance of the deliverables and services to be provided in accordance with this Statement of Work will be made by representatives of the Government at the destination.

Rocks, stones, and gravel delivered in the wastewater shall be considered evidence that the wastewater shall be considered evidence that the wastewater collection point was from the source tank bottom, or the truck’s tank was not thoroughly flushed prior to collection, and will be cause for rejection of the delivery.

6.0 SECURITY REQUIREMENTS

The contractor shall be able to be approved for DoD installation access by the physical security officer (i.e. the service technician shall be a US citizen and not have a felony conviction on his record). The contractor must obtain the required identification badges and follow security and safety regulations at all locations. Contractor personnel shall comply with all local base/installation security procedures required to gain access to US Government facilities. All contractor equipment, personnel and vehicles are subject to inspection and search by US government security officials (or designated representatives) upon entry to any government owned and/or operated installations and facilities. The Government reserves the right to visit and inspect, the Contractor’s assets used in support of this requirement.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.

52.204-26 COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES--REPRESENTATION (OCT

2020)

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(c) Representations.

(1) The Offeror represents that it [ ___ ] does, [ ___ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL

SERVICES (NOV 2021)

(a) The Government intends to award a contract to the responsible quoter who (1) conforms to the solicitation, (2) contains a price that is fair and reasonable, and (3) will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate quotations:

Factor 1 Price

Quotes must include a proposed price for each Contract Line Item Number (CLIN). The Government will determine prices to be fair and reasonable in accordance with FAR Part 13.106-3 based on, but not limited to, market research, current or previous purchases, prices for similar performance in a related industry, and comparison to an independent Government estimate.

Quoters responding to this solicitation are advised that, prior to award, the Government may request quoters to submit information/data to support price reasonableness such as copies of paid invoices for the same or similar items, sales history for the same or similar items, price list with effective date and/or copies of catalog pages along with any applicable discounts.

Factor 2 Technical Capability/Approach

The Government will evaluate the quotes for acceptability of Technical Capability.

Minimum Requirements:

The following are the minimum requirements a quote must meet to be deemed acceptable for the Technical Capability factor:

1) A quote is deemed acceptable for the Technical Capability factor if it meets all requirements as defined in the solicitation, the Performance Work Statement (PWS) and the minimum specifications.

2) Technical Capability/Approach evaluations will result in one of the following ratings:

An "UNACCEPTABLE" rating for Technical Capability/Approach factor will result in the entire quote being rated "UNACCEPTABLE" overall; an overall rating of "UNACCEPTABLE" makes a quote ineligible for award. A quote must contain sufficient information to enable evaluators to determine acceptability; if there is insufficient information to determine acceptability of the quote, the quote will be rated “UNACCEPTABLE” overall.

(b) Options. The Government will evaluate quotations for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quotation is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option (s).

(c) The Government shall mail or email a written notice of award to the successful quoter. Upon receipt, the quoter shall either commence performance, or have an authorized representative sign the award and return it to the Contracting Officer; a binding contract is formed upon the earlier of either of those actions.

(a) The Government may extend the term of this contract by written notice to the Contractor within 3 Days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 10 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 1 Year.
