About this file

This document is a Sole Source/Brand Name Justification for the purchase of a High-Speed Particle Image Velocimetry (PIV) system for the Anechoic Flow Facility at the Naval Surface Warfare Center Carderock Division (NSWCCD). The justification explains that the required components, including a high-speed camera, high-speed timing unit, and acquisition/processing software, are only available from the manufacturer LaVision, Inc. due to proprietary rights and the need for compatibility with existing Carderock PIV equipment and data. The estimated value of the requirement is below the Simplified Acquisition Threshold. The related federal contract opportunity is a combined synopsis/solicitation for the procurement of the LaVision PIV system components and software, with a NAICS code of 334516 and a small business size standard of 1,000 employees. Interested parties may submit capability statements by 04:00 PM EST on August 13, 2024, but this is not a competitive procurement. The government intends to solicit only from LaVision, Inc.

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 3 Template Effective February 2023

USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN

SIMPLIFIED ACQUISITION THRESHOLD MEMO

FROM:

CODE: 7201

TO: Code 02 SUBJECT: Sole Source Justification for Use of Other than Full & Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE

NSWCCD Code 7270 is requesting the purchase of High-Speed Particle Image Velocimetry (PIV) components required to complete and PIV system for the Anechoic Flow Facility (AFF) located at Carderock. The purchase consists of a high-speed camera, high-speed timing unit, acquisition/processing software, and the associated components (e.g., cables and hardware adaptors). Part of Code 7270’s mission is to support ship design and mutli-body flow interactions. To do so, this high-speed PIV system is required. The estimated value of this requirement is $

MANUFACTURER: LaVision, Inc ADDRESS: 211 W. Michigan Ave.

Suite 100 Ypsilanti, MI 48197

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME:

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 3 Template Effective February 2023

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

3. Other Reasons:

B. SOLE SOURCE (select all that apply)

1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights,

2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

LaVision has no authorized resellers or distributors.

3. Other Reasons: High-Speed PIV is a non-intrusive, laser-based flow measurement technique that can be used to quantify flow fields around test articles/models of interest. Code 7270 will use this technique to measure flow fields associated with naval systems in the Anechoic Flow Facility at Carderock. These types of flow measurements are critical to support ship design and multi-body flow interactions, which are all important areas for the Navy. PIV is a highly specialized technique and so there are not many companies that can provide the components to needed to actually take the desired flow measurements. Furthermore, the AFF is a fairly large wind tunnel, so the PIV system needs to be of a high enough quality to measure a large volumetric region within the tunnel test section. This further limits the hardware/software available that are suitable for AFF applications..

Furthermore, there are existing system components that are already owned by Carderock that can only interface with LaVision PIV components.

The system that is being requested consists of two main components and their associated hardware: a high-speed camera and acquisition/processing software. The camera and high-speed timing unit are compatible with existing lasers, software, and other cameras currently owned by Carderock. Purchase of these components from any other company would result in a non-functional PIV system. Furthermore, components available from other companies lack the required resolution for a tunnel the size of the AFF. The acquisition/processing software is also unique in that it interfaces directly with the camera and timing unit being requested as well as the existing PIV components at Carderock. No other software can interface with the PIV components currently at Carderock. Furthermore, the AFF has a significant amount of current and archived data that can only be processed and analyzed by the requested software. Since no other company can provide the components needed to meet the technical requirements for a PIV system suitable for the AFF or provide hardware/software that is compatible with existing components/data at Carderock, this purchase must be processed as a sole source.

C. LIMITED SOURCE (FAR 8.405-6):

Item required must be a brand name product, or feature of a product, particular to one manufacturer.
