About this file

This document contains a sole source justification for annual maintenance of TA Instruments equipment. The justification requests sole source award of a contract to TA Instruments for maintenance from April 1, 2024 through March 31, 2025 of several pieces of equipment including a 5500 TGA, 2500 DSC, RCS 90, TMA Q400, DMA Q800, GCA, and DXF-200. TA Instruments is identified as the original manufacturer of the equipment and holds proprietary rights to all data, drawings, schematics, and spare parts. The justification argues that only TA Instruments has the trained personnel and software access needed to enable timely and accurate repairs in compliance with the manufacturer's intellectual property. The Naval Sea Systems Command plans to award an indefinite delivery/indefinite quantity contract under solicitation number N0016424Q0113 for this annual maintenance to an unknown vendor for an unknown amount on or around March 12, 2024.

DXF2-0049.

POP: 4/1/24 - 3/31/25

TA Instruments is the original manufacturer of this equipment and have proprietary rights to all data, drawings, schematics and have in-house, both trained and licensed technical personnel as well as a stockpile of repair/replacement parts. These elements are all necessary and critical to enable both timely and accurate repairs of the TA Instruments equipment identified above. TA Instruments does not give access to their proprietary software, which is protected by patent. Without access to this software, the equipment cannot be repaired or maintained by any other company. Should access be given to another company, that company and the government would be liabel and open to litigation by TA Instruments.

If the Government does not utilize TA Instruments for this maintenance, the equipment cannot be trusted to provide accurate information. We would face costs of or more to procure all new equipment and approximately to secure funding and award a contract.
