The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the contract or notice of award by adding
(1) five calendar days for delivery of the award through the ordinary mails, or
(2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term “working day” excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

SECTION SAP PROV - SAP PROVISIONS
The following have been modified:
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The following Best Value Factors listed will be used to evaluate the Quotes using Low Price Technically Acceptable Evaluation Criteria – GO – NO GO Criteria:

Technical Acceptance Factor #1: Technical Approach Quoters will need to provide product literature or a capabilities document which outlines how the vendor will provide various items IAW Specifications/Salient Characteristics.
Additionally, quoter will need to fully fill out BOTH the evaluation matrix and compliance matrix, found below, checking either “YES/NO – GO/NO GO” in regards to each requirement and quoter’s corresponding capability.
Both the evaluation/compliance matrixes and product literature/capabilities document will be evaluated by the Requiring Technical Activity (RTA) in conjunction to ensure technical acceptance.
Technical Acceptance Factor #2: Delivery Quoters will need to fill out the clause 52.211-8 for evaluation by the Government. All vendors who can meet the Governments required delivery date will be deemed technically acceptable.
Technical Acceptance Factor #3: Past Performance Past performance will be evaluated based on the Supplier Performance Risk System (SPRS).
IAW the provision 252.213-7000, the Government will review the Quoter's "Summary Report" for Product Service Code (PSC) information. The Government will also utilize the "Suppliers Risk Report". Below is a snapshot of the supplier color legend listed in the report in each report.
Summary Report:
The Government will review the summary report score for the PSC(s) associated with this effort only.
Supplier Risk Report:
The Government will review the supplier risk score as well as the suspected counterfeit area.
Past performance will be based on GO / NO GO basis. An unacceptable (NO GO) equals a yellow or red listing in the SPRS system for the PSC(s) in the summary report as well as the supplier risk score/suspected counterfeit area. A quoter with no past performance (scores in either summary or supplier risk report) will be evaluated as neutral.
