DON SAP Guide Enclosure (4) 1
MEMORANDUM TO THE FILE
Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN
ACQUISITION
UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
IDENTIFICATION OF SOURCE:
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
The following imaging system and accessories are required for recording of thermal images and data captured during lab testing of various air countermeasure device (flares). The imaging system has a capability to capture the thermal output intensity of each flare device and to measure and record the data for effectiveness analysis. The flare data is analyzed for contract conformance and acceptance of flares to Government specifications. Without the
, the Government could not measure the thermal output of a flare and make a determination to accept or reject the flares.

IS BASED ON THE FOLLOWING (select all that apply):

A. _X_ ONLY ONE RESPONSIBLE SOURCE (select all that apply):
1. _X__ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
The Government has a requirement for a imaging system that has the several unique features that are not found on other brand imaging systems.
1. The system has a 1280x1024 pixel InSb detector with true 1.5-5um spectral response. This is a higher resolution than the standard 1280 pixels by 720 lines for a better aspect ratio of 1280 x 1024 is 5:4, not 4:3.
2. The system has programmable frame rates from 0.0015Hz to 180 fps full window.
This feature allows for up to 180 frames per second rate at 1280 x 1024 pixel resolution for true
HD high-speed images.
3. The system has a removable solid-state drive (SSD) hard drive for easily offloading of acquired data. This is a critical feature to allow the hard drive to be removed when classified imaging data is recorded and put in a locked filing cabinet for proper security handling of classified data. A new replacement SSD hard drive can then be inserted and used for other nonclassified projects. No other vendors have this capability of the removable hard drive.
4. The system has command and control features through the following connection ports; GigE, USB, RS-232, Camera Link or CXP.
5. The system has digital data available on the following connection ports; Gigabit
Ethernet, CoaXPress & Camera Link simultaneously.
6. The system has factory calibration support from -20C to 3000C with ambient temperature compensation.
7. The system has capability to handle Gemicam and Labview software development kit for interface hookup to external equipment.
The combination of all the unique features listed above allows the Government to use the system in a variety of test applications when evaluating decoy devices. It would take multiple brands of thermal imaging equipment to achieve the same type of tests required to evaluate the effectiveness of the decoy devices.

2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. ___ OTHER REASONS. Other reason not identified above. Provide details on mission impact if requirement is not solicited from only one source.
B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.
C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
1. Date on which the requirement was first identified:
2. Required delivery date/period of performance:
3. Explanation of why delivery/commencement of services by the date mentioned above is required:
4. If appropriate, include any additional pertinent information.
IV. CERTIFICATIONS/APPROVALS:
A. Technical / Requirements Certification: I certify that the facts and representation under my cognizance which are included in this justification are complete and accurate to the best of my knowledge and belief.
B. Certification/Approval.
Upon the basis of the above statements and information justification, I hereby approve, as the
Contracting Officer, the solicitation of the proposed procurement(s) using other than full and open competition.
