NONCOMPETITIVE PROCUREMENT JUSTIFICATION

(Simplified Acquisition Procedures (SAPs) Micropurchase Threshold to $150K)

The service or product(s) listed on requisition(s) below is/are precluded from competition for reasons indicated below.

There are no suitable substitutes available.

Restricted to the following source. Provide original manufacturer’s name. (If a sole source manufacturer distributes via dealers, ALSO provide dealer information.)

Manufacturer: .

Manufacturer’s Dealer/Rep:

Description of the product or services required, the estimated cost, and required delivery date (products) or Period of Performance (services). AN/SPS-49 Performance Based Logistics – Organic (PBL-O) requires the purchase of the following Circuit Card Assemblies:

1.) Clock Generator CCA

2.) IFF Alignment CCA

Specific characteristics of the material or service that limit the availability to a sole source (unique features; function of the item;

unique capabilities; facilities or special equipment; etc.). Describe in detail why only this suggested source can furnish the requirements to the exclusion of other sources.

The Government has a requirement to support the AN/SPS-49 Radar through the NSWC Crane Performance Based Logistics – Organic (PBL-O) agreement with NAVSUP WSS. The AN/SPS-49 radar is a legacy system with increasingly difficult to procure items. In order to maintain the operational capability of the AN/SPS-49 Radar System within the US Navy Fleet, replacement Circuit Card Assemblies (CCAs) are required. The majority of the CCAs for the AN/SPS-49 Radar are classified as “unique and obsolete.” Obtaining these CCAs and their associated components has been challenging. Failure to provide the needed CCAs in the most expedient way will leave the AN/SPS-49 equipped ships without a functional Radar System, which would jeopardize the defenses of the ship.

ARPG Reference 08 ARPG-CR02-0001 Jun 2015 The Government previously performed an industry inquiry requesting quotes for the manufacture or emulation of the desired CCAs. Three companies responded with proposals to support the government’s needs. Of the three companies, only . was able to prove they had the expertise necessary and possessed the needed components to “build to print” the obsolete CCAs. s was the only respondent that offered to build to print without re-design engineering charges. They have access to privately held electronic components that have become unobtainable on the open market, as well as the resources to program AN/SPS-49 specific files to these components.

For non-personal services indicate the highly technical or specialized expertise required. Describe the contractor’s workforce, methods, materials or unique management or operating systems. If it is unique because of knowledge of key individuals, what is the basis of the knowledge that another firm could not obtain the same or equivalent expertise? Could another firm obtain the necessary highly specialized experience or technical capability in time to perform the requirement?

The required product(s) or service(s) represent(s) the minimum requirements of the Government and no other product(s) or service(s) can satisfy the need.

FILL IN ALL APPLICABLE BLANKS BELOW

The product(s) must be compatible in all aspects (form, fit, and function) with existing systems presently installed. Describe the equipment you have now and how the new item/service must coordinate, connect, or interface with the existing system. These CCAs are unique to the AN/SPS-49 radar. These new CCAs must meet all of the requisite performance specifications while maintaining the operational capability of the radar.

Patent rights, copyrights, trade secrets, technical data, secret processes, or other propriety data essential for contract performance limits competition. The proprietary data is: REX Systems has the complete Technical Data Package (TDP) from the original manufacturer Raytheon. The government, nor any other company, has this TDP. The complete TDP is a requirement in order to manufacture these CCAs. NSWC Crane approached REX Systems about purchasing the TDP, but this request was refused.

These are “direct replacements’ parts/components for existing equipment .

Other information to support a sole-source buy:

I CERTIFY THAT STATEMENTS CHECKED, AND INFORMATION PROVIDED ABOVE, ARE COMPLETE AND CORRECT TO THE BEST OF MY KNOWLEDGE. I UNDERSTAND THAT THE PROCESSING OF THIS SOLE-

SOURCE JUSTIFICATION PRECLUDES THE USE OF FULL AND OPEN COMPETITION.
