STATEMENT OF WORK
EW Strategy Implementation Plan Workshops Analysis and methodologies for developing an Electronic Warfare (EW) Strategy Implementation Plan.
1. SCOPE
This Statement of Work (SOW) defines the efforts required to conduct 4 workshops to assess DoD’s efforts to implement its new EW Strategy and adopt new ways of operating and fighting in the electromagnetic spectrum (EMS). This workshop shall include technical presentations, facilitated discussions, and operational vignettes, which shall explore opportunities and challenges associated with these trends. The results of this workshop shall be documented and delivered to the Government at the conclusion of each workshop.
1.1 Background.
One of the DoD’s most important missions is deterring aggression. Executing this mission usually requires a strategy to convince potential adversaries that their aggression will have a low or uncertain probability of achieving the desired result. Approaches DoD could take to create this effect include demonstrating an overwhelming ability to counter likely acts of aggression, obscuring posture and capabilities to create uncertainty regarding the defender’s true disposition, or showing the ability to punish adversaries in ways that deny them the benefits of their aggression.
DoD’s new EW Strategy describes objectives to pursue priorities for organizing the EW enterprise to ensure EMS superiority; training and educating for 21st Century EW and EMS operations; equipping the force with agile, adaptive, and integrated EW capabilities; and bolstering partnerships with industry, academia, interagency and allied partners. The EW Strategy Implementation Plan will translate these objectives into tasks to be conducted by the Services and Joint Force.
DoD is now developing the EW Strategy Implementation Plan, which these workshops will support. This effort will need to examine the objectives of the EW Strategy and assess DoD’s status and progress toward achieving these objectives, and determine which tasks are needed to execute the EW Strategy.

3.1 The Contractor shall facilitate 4 workshops that examine DoD’s progress toward implementing the EW strategy and support completion of the EW Strategy Implementation Plan by identifying which tasks need to be completed and how. The workshops will focus on the following topics, based on the priorities of the EW Strategy:
(a) Workshop 1: Organizing the EW enterprise and training for 21st Century EW and EMS operations;
(b) Workshop 2 and 3: Equipping the force with agile, adaptive, and integrated EW capabilities;
(c) Workshop 4: Bolstering partnerships with industry, academia, and foreign partners.
The Contractor will conduct the workshops to address all of these areas, and shall bring together a group or groups of technical experts, policymakers, and EMS system operators to present briefs on new technologies and operational concepts and consider how they may be applied to the EW Strategy Implementation Plan.
3.2 The Contractor shall: (a) record minutes of the workshop’s discussion topics, (b) analyze results of the simulated scenario and discussion topic responses of the participants, and (c) prepare a final report which shall include conclusions and recommendations for meeting the objectives from the workshop.

(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is ``not dominant in its field of operation'' when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(a) Except as stated in paragraph (b) of this clause, when any supply or service acquired under this contract is subject to any End User License Agreement (EULA), Terms of Service (TOS), or similar legal instrument or agreement, that includes any clause requiring the Government to indemnify the Contractor or any person or entity for damages, costs, fees, or any other loss or liability that would create an Anti-Deficiency Act violation (31 U.S.C. 1341), the following shall govern:
(1) Any such clause is unenforceable against the Government.
(2) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement.
