JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center (NSWC) Crane Division.

2.

Description of the Action Being Approved Award of a Firm Fixed Price contract on a sole source basis for EA-18G aircraft RF cables and connectors to assembly Factory System Bench(s) (FSBs) and provide sparing for the FSBs.

3.

Description of Supplies/Services The required supplies are for Times Microwave Systems parts needed to assemble FSBs and provide sparing for sustainment of all the FSBs that will reside at the NSWC Crane Division EA-18G AEA Depot. The parts to be procured are 24 RF cable sets and two connector kits. The specific cables and P/Ns are listed in Attachment 1. Delivery requirements will be 140 days after award for the basic quantity and 140 days after option exercise for the option quantity. The option will be exercised no later than September 30, 2017. Two cable sets and the connector kits will be awarded as the basic contract, with an option for a third cable set.

The FSB is used to test and verify the system level testing for the EA-18G’s AN/ALQ-218 and (AU) 9 & 16. These units are used as a tactical jamming receiver for the EA-18G Aircraft. Without the capability and capacity to verify the system level testing the Crane Depot will not be able to meet requirements needed to supply NAVSUP for the EA-18G fleet. This in turn will compromise the mission and the Navy.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

The estimated requirements under this J&A are valued at $1,032,870.68 and will utilize Aircraft Procurement Navy funds.

Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1). Only one responsible source.

5.

Rationale Justifying Use of Cited Statutory Authority These cable and connectors sets are used to simulate the EA-18G’s AEA Suite currently installed in approximately 150 jets. Since the purpose of the FSB is to test at the AEA suite system level these cables must be sole-sourced to Times Microwave Systems due to the specific characteristics they possess. The cable sets and connectors shown in attachment 1 are matched sets meaning the phase matching and electromagnetic performances are matched to one another. Crane does not own the complete data package to these products. These Cables and Connector kits are only manufactured by Times Microwave System and are installed on the current EA-18G’s in theatre. They also are being installed by Boeing on any new builds, the manufacturer of the EA-18G. Consequently, if the government were to try to purchase any other type/brand of cables and connectors it would require a complete modification/redesign of the interconnection configuration for the EA-18G AEA Suite and all Weapon Ready Assemblies (WRAs). This would result in an increased cost and a schedule delay to the government of an estimated $40M and five years respectively to test and qualify any configuration changes.

6.

Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

The proposed contract was synopsized on the Federal Business Opportunities (FEDBIZOPS) website on May 15, 2015. No responses have been received from any companies other than Times Microwave. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than Times Microwave to provide the required supplies and services.

7.

Determination of Fair and Reasonable Costs The Contracting Officer will utilize cost data, comparison to similar items, and past procurement history from Boeing to Times Microwave Systems to determine the prices paid by the Government for the supplies covered by the J&A to be fair and reasonable.

8.

Actions to Remove Barriers to Competition For the reasons set forth in Paragraph 5, NSWC Crane Division has no plans at this time to compete future purchase orders or contracts for the types of supplies covered by this document. If another potential source emerges, NSWC Crane Division will assess whether competition for future requirements is feasible.
