JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Crane Division, (NSWC Crane), SWESD Contracting Operations Division, Small Arms Branch (0232).

2. Description of the Action Being Approved

This action will result in award of a firm-fixed price contract on a sole source basis to procure Weibel Radar Tracking System upgrades, to Weibel Scientific, Inc., 44001 Indian Fields Court, Lansdowne, VA 20176-1641. This action will include user training as well as two option quantities of 1 EA to upgrade an additional two systems in support of the U.S. Marine Corps Systems Command and other U.S. Military activities.

3. Description of Supplies/Services

This proposed action will upgrade equipment for the Weibel Radar Tracking System. Specifically, a complete rebuild of the TC 700 Radar Tracking System Pedestal to the AP 700 configuration. All parts in the pedestal will be replaced with current technology.

The estimated total value for this contract, including options, is $600,000. A projection of the proposed contract utilization by funding type is as follows:

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1). Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority

The statutory authority permitting other than full and open competition applies to the proposed procurement based on Weibel Scientific, Inc., is the only manufacture of Real Time Processing equipment for Weibel radar tracking systems and holds proprietary data rights.

The Weibel Radar Tracking System is the radar system used by the Expeditionary Systems Evaluation Division (ESED) and the U.S. Army proving grounds in conducting ammunition and weapons evaluation for the U.S. Marine Corps (USMC) and the U.S. Army (USA).

ESED began purchasing tracking radar systems in 1993 when the use of such systems became mandatory for conducting ammunition acceptance testing. At the time, as is today, Weibel tracking radars were the industry standard.

ESED procured the first two of its three Weibel Radar Tracking Systems from Weibel Scientific in May of 1993 under full and open competition via a U.S Army (Aberdeen Proving Ground) contract (DAAD05-92-D-7026). The third system was also procured from Weibel Scientific in February of 2002 under full and open competition via Aberdeen Proving Ground contract (DAAD05-99-D-7018/FC01). A previous upgrade was purchased via sole source procurement with Weibel Scientific in 2008 under contract N00164-08-C-JN41. Since 1993, ESED has spent $3.8M for procuring, updating and maintaining Weibel tracking radar systems.

Weibel Scientific Corp. is continually seeking new methods and technologies to provide the latest innovations to their radar tracking equipment in order to provide the customer the most up to date technology. As such their radar pedestal has advanced to include a newer model, AP 700 to the original model TC 700. ESED has used the TC 700 for over 20 years and now must upgrade to the AP 700 due to the fact that in March 2015, Weibel Scientific Corporation will no longer support TC 700 technology. By upgrading to the AP 700, ESED will be able to have a better, more accurate and responsive pedestal for its radar tracking system.

This upgrade is required to continue conducting quality evaluation of U.S. Marine Corps and U.S. Army ammunition stockpiles by keeping pace with the ever improving technology of weapons and ammunition.

The upgrade provides a significant savings for the government since the existing outer case and framing is reused and all parts are replaced with state of the art components instead of purchasing a new AP 700 to replace the TC700.

Weibel Scientific holds proprietary and patent rights to the tracking radar systems currently owned by ESED. These rights would have to be purchased in order for other vendors to be able to provide radar systems capable of meeting current DoD standards.

ESED inquired into Weibel’s interest in selling these rights.

Weibel indicated that they were not interested in releasing their proprietary rights.

Market research revealed that the cost for purchasing three complete comparable systems would be approximately $1.8M each plus start-up cost from other radar vendors. Duplication cost would be over $5.4M to re-obtain the current tracking radar capability.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

A synopsis was issued on 10 APR 2015, via posting on the Federal Business Opportunities (FEDBIZOPS) website. No responses have been received as a result of the synopsis. No additional market research was conducted because it is not practical, for the reasons discussed in paragraph 5 above, for any company other than Weibel Scientific, Inc. to provide the required supplies and services.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated costs to the Government will be fair and reasonable. It is anticipated that various cost and price analysis techniques will be utilized to determine the price to be fair and reasonable in accordance with FAR 15.404-1(c).

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWC Crane has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWC Crane will assess whether competition for future requirements is feasible.
