About this file
This justification and approval document outlines a sole source contract award by the Department of the Navy Strategic Systems Programs to EMCUBE, Incorporated. The contract provides highly specialized engineering and program management services supporting Trident II facility operations, D5 and D5 LE missile production and operational planning, D5 LE-2 missile technologies, and flight test support efforts. The base period is one year starting October 2021 with four optional one-year extensions through September 2026. Services include subject matter expertise in facility engineering, missile production problem investigation, flight test and support equipment design, and LE-2 technology planning. EMCUBE is the incumbent and only source considered capable of performing the work without unacceptable three-year delay due to their extensive experience and expertise with the Trident program since 1999. The total estimated value is $20.6 million including funding from operations and maintenance, weapons procurement, and research budgets. The contracting office will determine fair and reasonable pricing.

c. It is anticipated that this contract will contain a provision to increase the level of effort items by up to thirty (30) percent that is intended to acquire additional man-hours appropriately within scope over the level of effort provided for in the basic contract.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1) and FAR 6.302-1(a)(2)(iii). Only one responsible source and no other supplies or services will cost-effectively satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
a. The proposed procurement provides for follow-on specialized technical engineering services to support the Fleet Ballistic Missile (FBM) program which have been deemed only available from the original source, EMCUBE, and that award to any other source would result in an unacceptable delay of schedule to the Government. EMCUBE Technologies has provided engineering technical support services on the FBM Program for more than 22 years. EMCUBE has supported SP20, SP201, SP100, and SP27 on efforts including the Low Cost Test Missile Kit (LCTMK) program, D5 Life Extension Program (D5LE), Strategic Weapons Facilities, and SSP Technical Personnel Development. As such, EMCUBE’s employees have the knowledge and understanding of the technical aspects of the FBM program necessary to conduct this type of highly specialized technical engineering services.
b. The proposed effort outlined in the Statement of Work will consist of the following:
1) Provide Subject Matter Expert support in Facility Engineering Technical Services to include facility activation planning.
2) Provide support for Problem Investigations in Missile Production.
3) Provide Subject Matter Experts in missile component design, missile electrical and mechanical support equipment design, testing, and operational use.
4) Support LE2 pre-development planning and technical interchanges.
5) Provide lessons learned from previous studies, inquiries, and assessments for
Facility Engineering and Technical Services.
6) Provide Subject Matter Experts in Submarine Launched Ballistic Missile
(SLBM).
c. EMCUBE is the original source for this specialized service. They possess in-depth knowledge and expertise of the TRIDENT program in the areas of Facility Activation, Missile Production, Flight Test Support and Support Equipment Integration, and program transitions like that from D5 to D5 LE. Their experience with the FBM program allows them to provide immediate response to emergent problems and to mitigate the program risk by reducing likelihood of repeating previous mistakes or introducing past design, testing, and production errors.
d. To acquire the existing knowledge, experience, and expertise that EMCUBE currently possesses, an alternate source would need to receive extensive training in order to become subject matter experts in SLBMs, missile production, previous SSP program transitions like that from D5 to D5LE, missile support equipment, and missile flight tests. It is estimated that qualification would lead to a degraded quality of service for at least three (3) years. A three (3) year period was estimated based on engineering judgement of the minimum time it would take for new personnel to be trained in the FBM program and acquire the in-depth knowledge necessary to be able to provide this highly specialized technical engineering support. Degraded quality of support in missile production hardware problem investigations, Change Control Board (CCB) corrective actions and Material Review Board (MRB) dispositions could lead to delays in missile production, which could have significant cost and schedule impacts on multiple other contracts and could result in delayed missile deployments to the fleet or delivery of suspect hardware that might necessitate future recalls. Degraded quality of support in LE2 pre-development planning and technology demonstrations could delay critical design and programmatic decisions including facility activations and support equipment approaches which need to be appropriately integrated for the future of the FBM program. Degraded quality of support to current critical facility activation activities for Camp Navajo and Utah Test and Training Range (UTTR) could delay enablement of additional rocket motor storage potentially leading to a stop in motor production.
e. For the reasons stated above, EMCUBE is the only source to perform this effort without resulting in an unacceptable delay in receiving these highly specialized services.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A Sources Sought Notice (SSN), which is required by the Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance, and Information (PGI), was posted to the Government-wide Point of Entry (beta.SAM.gov) on 10 February 2021 and closed on 24 February 2021 in an effort to promote competition. There were no responses received. As a result, SSP concluded that EMCUBE, Inc. is the only company capable of satisfying the current requirement.
The proposed contract was synopsized to the Government-wide Point of Entry (beta.SAM.gov) on 3 March 2021 and closed on 17 March 2021. There was one potential source that expressed interest in this requirement. After informing the respondent that the procurement was intended for a follow-on requirement, the business entity did not further inquire for information regarding this procurement. Market research was conducted by SSP technical personnel and the report concluded there were no other contractors besides EMCUBE, Inc. that possessed the in-depth knowledge, specialized experience, and unique capabilities required to support the complexity of the SSP requirements.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer shall determine if the estimated costs for the services specified within this J&A are fair and reasonable to the Government. This will be accomplished by evaluating the contractor’s proposal with conducting cost and price analyses; utilizing previous cost history and technical recommendations; receiving assistance from DCAA; and ensuring compliance by applying Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) principles for elimination of unallowable cost elements.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in paragraph 5, SSP has no plans at this time to compete future requirements for the types of supplies/services covered by this J&A. If another potential source emerges, SSP will assess whether competition for future requirements is feasible.
