CLASS JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Systems Command (NAVAIR) Headquarters

2. Description of the Action Being Approved.

This Class Justification and Approval (CJ&A) authorizes and approves the issuance of cost and fixed-price type orders on a sole source basis under Basic Ordering Agreement (BOA) N00019- 20-G-0007 with Raytheon Missiles & Defense (RMD) of Tucson, Arizona, to procure supplies and services for the Tomahawk Cruise Missile Program for U.S. Navy, other services, and Foreign Military Sales (FMS) customers. Authority to act under this class justification expires 31 August 2025.

3. Description of Supplies/Services.

NAVAIR anticipates executing BOA orders for the development, production, reliability, sustainment, and disposal of the Tactical Tomahawk RGM-109E/UGM-109E Missile (TACTOM) systems, both encapsulated in various capsules and canisters, and their components.

Efforts under this CJ&A will include engineering, systems engineering, analyses, studies, prototyping, model based system engineering, requirements analysis, test, logistics, obsolescence/Diminishing Manufacturer Sources and Material Shortages, Cost Reduction Initiatives (CRI), risk reduction activities, and external program support/supplies/services for the Tomahawk Weapons System.

NAVAIR anticipates acquiring the following supplies and services to support the USN, FMS, and other DoD service requirements to include, but not limited to:

• Engineering/Systems Engineering and Logistics efforts related to operational readiness and reliability, system configuration, designs, prototyping, system safety, software, firmware, and/or related hardware.

• Weapon system mass properties or changes to weight of the weapon system, engineering change proposals, interoperability, system performance or system performance capabilities.

• Training or training improvements, support equipment, environmental requirements, integration, compatibility and installation of shipboard and/or air components and interfaces.

• Energetics, power/propulsion, service life extension and/or special tooling and test equipment, logistics support plans, supportability due to engineering changes, maintenance plans, test program support, depot and recertification and/or logistics support analysis data, and development or creation of technical data packages (TDPs).

• Modification and support for overall system and system interface, test and integration efforts, including operational test events or quick reaction assessments.

• Design, fabrication, assembly, testing and results verification of prototypes or models to support engineering studies or analyses.

• System security engineering, obsolescence of key hardware components, firmware, and Computer Software Configuration Items.

• Technical, engineering, investigations/studies, maintenance and documentation support, ancillary to the execution of Operational Test Launches, Functional Ground Tests, Production Acceptance Testing, related U.S. Navy Testing, and unique test support activities in support of non-typical flight tests.

• Services, support, analysis studies and material necessary to repair, inspect, modify, and/or return to ready-for-issue condition items of Government property.

• Services, support, analysis studies and material necessary to support emerging/new capabilities.

• Algorithm development supporting Maritime Strike Tomahawk (MST) emerging requirements including targets, engagement logic parameters, and kill chain improvements, or releases of improved software algorithms.

• Sparing studies, Failure Reporting, Analysis and Corrective Action System, and Failure Mode, Effects and Criticality Analysis.

• Test data analysis and software code fixes.

• Component life studies and age limitations, qualifications, and service life extensions of assemblies, components, or mission unique items.

• Prototype Mid-body Range Safety Subsystem replacement kits, alternative systems, or equivalents to meet system safety requirements.

• Prototype upgraded power and propulsion solutions to emerging requirements, to include engine design modifications.

• Analysis and design for additional sensor capability, to include hardware, software, firmware requirements, integration planning, and recommendations.

• Design, modify and build containers for MST assemblies and kits.

• Research and analysis for improved guidance electronics and sensor processor capability.

• Analyses supporting Concepts of Employment and tactics, airworthiness, and operational performance of the missile and included components.

• Modeling and simulation development, performance predictions, and recommendations for upgrades to missile performance based on emerging threats and quick reaction assessments.

• Rapid turn-around assessments of capability, performance, and modeling/simulation to support urgent need scenarios.

• Non-recurring and recurring effort required to identify, analyze, project and track obsolescence and obsolescence impacts on the system/program, as well as design, redesign, resolve, and implement obsolescence solutions. Identify, evaluate, analyze, select, plan and execute viable CRIs that will reduce costs, and/or increase efficiencies of the program.

• Government Furnished Property management of PMA-280 equipment to include conducting annual wall-to-wall physical inventory of all Government Furnished Equipment (GFE), and report on all Government Furnished Material (GFM) and GFE per respective Contract Data Requirements Lists (CDRLs); monthly GFM CDRL and quarterly GFE CDRL.

• Tomahawk recertification planning and procedures.

RMD is the only known source that currently possesses the required technical knowledge, expertise, data, and facilities required to produce and maintain the TACTOM missile to meet U.S. Navy Fleet and FMS customer requirements. As a result of a competitive procurement in 1994, RMD was selected as the sole producer of the TACTOM AUR missile and depot maintenance and owns the technical data rights. RMD owns both the Level III TDP and the manufacturing documentation for the TACTOM and associated Government Special Tooling, Special Test Equipment and Government Property due to the performance-based nature of the TACTOM development and production contracts. The U.S. Navy has not procured TDPs adequate for competition of the TACTOM missile and associated support. Further, RMD is not willing to sell the U.S. Navy the Level III TDP, which would be required for a competitive procurement.

In summary, RMD is the only source that possesses the current technical, configuration, manufacturing data, and unique expertise required to perform the tasks required under each anticipated order.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance, and Information (PGI) 206.302-1 a sources sought was published on beta.SAM for the RMD BOA on 21 July 2020, with no responses received. Individual orders will be synopsized on the beta.SAM website. Any responses will be evaluated prior to award.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this CJ&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in paragraph 5, NAVAIR has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible. Because this effort is a follow-on for supplies and services previously awarded on a non-competitive basis, in accordance with DFARS PGI 206.304(a)(i), the prior CJ&A was provided to the approval authority for review. Approval of this CJ&A signifies the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
