JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

Upon the basis of the following justification, I hereby approve the issuance of the contractual action described below:

JUSTIFICATION

1. Identification of Agency and Contracting Activity.

Department of the Navy, Office of Naval Research (ONR).

2. Nature/Description of Action.

ONR intends to issue a sole source, bridge contract in PRISM to Accelerated

Development & Support Corporation (ADS) to provide programmatic, technical, information technology (IT), administrative and logistic support services to the Naval

Research Advisory Committee (NRAC) Program Office (Code 00NR). This bridge contract will cover a period of performance from 26 August 2018 to 25 February 2019 and will also include FAR clause 52.217-8 “Option to Extend Services”, to potentially extend services on a month to month basis for up to an additional six months.

3. Description of Supplies/Services.

Task order N00178-08-D-5314 EE05 currently provides programmatic, technical, information technology (IT), administrative and logistic support services to the NRAC

Program Office. Code 00NR is responsible for overseeing Federal Advisory Committee

Act compliance and providing administrative, logistical and technical support of the

NRAC. Under the bridge contract, the contractor shall continue to provide these support services to Code 00NR through 25 February 2019. This contract will provide 4.75 full-time-equivalent support personnel. The estimated value of the base six-month bridge action including labor and other direct costs is $485,339.20. However, due to the potential for exercising the option to extend services under the 52.217-8 clause for an additional 6 months, the total potential value of this action is $970,678.36.

4. Identification of Statutory Authority.

The statutory authority permitting other than full and open competition is 10

U.S.C. 2304(c)(1), Only one responsible source, as implemented by Federal

Acquisition Regulation (FAR) § 6.302-1 -- Only One Responsible Source and No

Other Supplies or Services Will Satisfy Agency Requirements.

5. Demonstration that Nature of Acquisition Requires Use of Cited Authority.

J&A No. 08-18

The current task order expires on 26 August 2018. ONR has been working to award a follow-on task order for these services prior to the expiration of the current vehicle, however additional time is needed in order to complete the procurement process. Delays were encountered in the finalization of the

Performance Work Statement due to unexpected absences from the Program

Officer and the need for revisions of the required personnel qualifications. ONR

Contracts felt the original draft personnel qualifications were complex and potentially restrictive of competition. Subsequent discussions and revisions involving Code 00NR, Contracts, and Legal resulted in delays in completing the

PWS for the follow-on competition.

Code 00NR continues to require the support services described herein. Under these circumstances, only the incumbent contractor, Accelerated Development and Support Corporation (ADS), can successfully provide the support services

NRAC requires during the relatively short bridge period. ADS has been successfully performing these services under task order N00178-08-D-5314 EE05 since 26 August 2013, and it is the only source fully capable of continuing performance during the bridge period to avoid disrupting the operational capability of Code 00NR until the Government is able to complete the follow-on source selection.

6. Description of Efforts to Ensure Other Potential Sources Were Sought.

Pursuant to FAR 6.302-1(d)(2), a Notice of Intent to Award a Sole Source was posted to the Government Wide Point of Entry, www.fbo.gov, on 19 June 2018.

No responses were received.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer shall determine the cost to be fair and reasonable prior to award utilizing proposal analysis techniques described in FAR 15.404.

8. Description of Market Research.

Market research specific to this action was not conducted because only the incumbent contractor can successfully provide continuity of services during the bridge period. A Notice of Intent to Award a Sole Source was posted to FBO on

19 June 2018 and no responses were received from any other interested parties.

9. Any Other Supporting Facts.

If ADS does not continue to provide uninterrupted services and a bridge contract is not established, there will be significant negative impacts to the overall operations of

ONR Code 00NR. NRAC has two proposed studies for 2018, one for the Navy and

J&A No. 08-18 one for The Marine Corps sponsored by senior Navy and USMC officials: the Under

Secretary of the Navy, Mr. Thomas Modly and Lieutenant General Robert S. Walsh, Commanding General and Deputy Commandant, Marine Corps Combat Development

Command, respectively. Both Studies affect where the Navy will invest funding in future years. The proposed topics were requested by the Navy/ Marine Corps to help in the current decision-making process. Without this contract in place, neither of the studies can move forward.

10. Listing of Interested Sources.

A Notice of Intent to Award a Sole Source was posted to www.fbo.gov on 19

June 2018. No interested sources responded.

11. Actions Taken to Remove Barriers to Competition.

As discussed herein, the Government will complete a competitive source selection for the programmatic, technical, information technology (IT), administrative and logistic support services for Code 00NR on or before 25 February 2019 via

Seaport.

12. Statement of Delivery Requirements.

The contractor shall provide monthly status reports, ad hoc reports and presentations, and a final report as described in the statement of work for the bridge contract.

13. Reference to the Approved Acquisition Plan (AP) or Equivalent Documentation.

A Management and Oversights Process for the Acquisition of Services-

Streamlined (MOPAS) has been approved for this requirement.

14. Explanation of all actions attempted to make the immediate acquisition competitive and the cost /benefit analysis reflecting costs associated with obtaining competition and anticipated benefits.

The bridge contract discussed herein is expected to cover the relatively short period of time required for the successful completion of the source selection and award process for the recompete competitive task order covering five years of support service requirements for Code 00NR.
