Maxwell AFB Beyond the Horizon Air & Space Show 2023
Statement of Work (SOW)
1. Scope of Work. The Contractor shall provide all personnel, tools, materials, supervision and other items and services necessary for Aerial Demonstration and/or Aircraft Static Display services. This contract will be awarded for all services to one contractor, contract will not be for partial services. Contract is for full and complete services in accordance with SOW scope and awarded to a single contractor. The contractor shall perform to the standards in this SOW.
2. Period of Performance: 4-7 April 2023
3. Contractor to Provide Aerial Demonstration and/or Aircraft Static Display services:
a. Shall coordinate all airshow planning and implementation activities with the Maxwell
Airshow Team (MAT) to ensure compliance with specific airshow objectives, rules, regulations, statutes and policies.
b. Shall furnish sufficient personnel, equipment, and materials to perform aerial demonstration and/or static display for all work specified within this SOW.
c. Shall coordinate all aspects of the arrival/departure, aerial demonstration, and parking plan with the MAT.
d. Shall be in place by 1600L, 4 April 2023.
e. Shall fly one 10-20 minute sortie around the Montgomery and Prattville area at safe, low
VFR altitudes to promote the airshow on 4 April. May accomplish concurrent with arrival.
f. Shall fly Night Show (5 April) afterburner passes. Intended to occur during civil twilight.
g. Shall act as a static display on Saturday and Sunday with optionality to fly on those days.
h. Shall defer to the MAT to resolve all issues, which include, but are not limited to, security, law enforcement, fire protection and prevention, emergency response and recovery, public affairs, logistics, and acquisition.
i. Shall coordinate with the MAT usage of radio communications and computer wireless connectivity.
j. Shall coordinate with the MAT any use of pyrotechnics.
k. Shall implement its Risk Management Plan as applicable.
l. Shall comply with FAA regulations/restrictions and coordinated flying schedule.
m. Shall be present for FAA restriction brief and airshow performer brief.
n. Shall provide SAC cards, liability insurance and DD2400s.
o. Shall provide names and driver’s license numbers for background checks and base access.
4. Aircraft to be Supplied:
a. MiG-17F
5. Performer Check-in Requirements. Upon arrival, before performers are allowed to participate as part of an air show, Federal Aviation Administration (FAA) officials shall review all civilian aircraft participants as follows (not all inclusive):
15.1 AIRCRAFT:
- The aircraft’s general condition
- The aircraft airworthiness and registration certificates (original documents)
- The operating limitations associated with Special Airworthiness Certificate (original documents)
- The Operating Certificate or Letter of Deviation Authority for large aircraft used in sport parachuting (only if non-military, registered civil aircraft)
- A copy of the record of the modifications to aircraft that accommodate sport parachutists and documentation of field approval by the FAA, or an STC (only if non-military, civil aircraft) (notarized copy is acceptable)
- Emergency parachute repack date, if installed within the previous 180 days (§ 91.307) used on acrobatic show aircraft
- Evidence of a current annual or yearly condition inspection (notarized copy is acceptable)
- If installed, evidence of current 24 month transponder certification (notarized copy is acceptable)
- If installed, evidence of current 12 month ELT inspection (notarized copy is acceptable)
15.2 PILOTS:
- A valid Pilot Certificate, except operators of ultralight vehicles.
- If required, a valid letter of authorization in lieu of type rating.
- A current medical certificate, except glider and balloon pilots and operators of ultralight vehicles.
- A current Statement of Acrobatic Competency, as required.
- A valid letter of authorization to conduct maneuvers at the crowd, if required.
- Formation flying credentials, as required.
- Photo Identification
6. Compensation. The Government hereby agrees to compensate the Contractor at the rate specified. Advanced payment is not authorized, nor will the government pay a deposit. This agreement is in full force from the date signed and when all required forms have been received by the Government. If the contractor is on site and ready to perform, but cannot perform due to circumstances outside of their control the Contractor will be paid 100% of the performance fee.
If the Contractor is physically unable to perform, has an equipment failure, or cannot perform for any reason, other than stated above, 100% of the fee or a percentage portion commensurate with the amount of specified routine (aerial demonstration) not performed will not be paid.
7. Donation. Based on Air Force policy the Contractor shall not solicit donations as additional compensation from the public on an Air Force installation unless the Contractor is a legitimate “War Bird” 501C3 private organization. The Contractor may not display signage or charge any person for an admission fee to tour an aircraft or display. However, unsolicited donations are permissible as long as no signage or person blocks or interferes with the entry by the public and the signage that is displayed says “donations” with no set fees or costs. Air Force shows are free to the public and charge no admission.
8. Sale of Items. Contractor has the right to sell items at the Air Show that are specific, copyrighted items pertaining to their aircraft. Items shall be limited to shirts, hats, buttons, posters, and aircraft tours bearing the aforementioned copyright items. (Donations of other sponsor will be accepted) The Government reserves the right to restrict sales of items other than those mentioned.
9. Contractor’s Liability Insurance. Contractor shall provide Maxwell Air Force Base with a copy of the pilot’s licenses (upon request). The Contractor declares that they will maintain personal liability insurance with limits of a million dollars ($1,000,000.00) per aircraft/occurrence for bodily injury or property damage. The Civil Aircraft Certificate of Insurance shall be provided upon request and before filling out FAA waiver prior to commencement of performance under this agreement. Civil Aircraft Landing Permit (DD 2401) and Civil Aircraft Hold
Harmless Agreement (DD 240-2) shall also be provided at that time. Certificate of Insurance, DD Form 2400, must be forwarded to the air show coordinator along with the DD Form 2401 (forms should be provided 30 days in advance).
10. Security Requirements. Installation Access Requirements: As prescribed by the AFFAR
5352.242-9000, Contractor access to Air Force installations, AFI 31-218, Motor Vehicle Traffic Supervision, and AFMAN 31-113, Installation Perimeter Access Control.
The contractor shall obtain base identification and vehicle passes, if required, for all contractor personnel who make frequent visits to or perform work on the Air Force installation(s) cited in the contract. Contractor personnel are required to wear or prominently display installation identification badges or contractor-furnished, contractor identification badges while visiting or performing work on the installation.
The contractor shall submit a written request on company letterhead to the contracting officer listing the following: contract number, location of work site, start and stop dates, and names of employees and subcontractor employees needing access to the base. The letter will also specify the individual(s) authorized to sign for a request for base identification credentials or vehicle passes. The contracting officer will endorse the request and forward it to the issuing base pass and registration office or Security Forces for processing. When reporting to the registration office, the authorized contractor individual(s) should provide a valid driver's license, current vehicle registration, and valid vehicle insurance certificate to obtain a vehicle pass. Government ID card holders may not use their credentials to sponsor an individual on to the base to perform work that's been contracted to an official contractor.
During performance of the service, the contractor shall be responsible for obtaining required identification for newly assigned personnel and for prompt return of credentials for any employee who no longer requires access to the work site.
All commercial/delivery vehicles will be directed to Gate 3 (Kelly St) or Gate 4 (Congressman
Dickenson for Gunter) for processing through the Commercial Vehicle Inspection (CVI) Area, when operational. During non-duty hours and holidays, commercial vehicle inspections will be conducted at Gate 1 (Maxwell Blvd) or Gate 4 only. Inspection members will conduct thorough inspections of the interior and exterior of the vehicle for items prohibited from the installation such as explosive devices, weapons and ammunition, drugs, and open or closed alcohol containers.
Upon completion or termination of the contract or expiration of the identification passes, the prime contractor shall ensure that all base identification passes issued to employees and subcontractor employees are returned to the issuing office.
Failure to comply with these requirements may result in withholding of final payment.
11. Notification of Environmental Spills. In the event the contractor spills or releases any unpermitted substance or hazardous waste into the environment, the contractor shall immediately report the incident to the Fire Department, the Contracting Officer (CO), and a member of the
MAT.
12. Traffic Laws. The contractor and their employees shall comply with base traffic regulations set forth in AFI 31-218, Motor Vehicle Traffic Supervision and AFMAN 31-113, Installation Perimeter Access Control. Personnel in violation may be issued a Central Violations Bureau Form 1805 traffic ticket.
13. Cellular Phone Operations Policy. The use of cellular phones while operating a motorized vehicle is prohibited on Maxwell-Gunter. Although discouraged, drivers are authorized to use devices, i.e. ear bud or ear boom, which allows their cellular phone to be operated hands-free.
The device must not cover both ears. This policy applies to everyone driving on Maxwell AFB and Gunter Annex. Personnel in violation may be issued a Central Violations Bureau Form 1805 traffic ticket.
14. Wireless Electronic Devices. The contractor will not establish their own Information Technology (IT) systems or networks (Local Area Networks [LAN], Wide Area Network [WAN], Cellular Phone/USB Modem as WAN, Wi-Fi as WAN, etc.), or camera system without the direct permission of the Program Manager and governing communications and responsible information systems office (42 CS).
15. Random Installation Entry/Exit Checks. Entry/exit vehicle checks are conducted by order of the 42 ABW Commander. These checks are conducted for the purpose of safeguarding the base and protecting government property by discovering and seizing stolen property, classified information and contraband. Refusal to submit to an installation (entry/exit) vehicle check may result in the loss of base driving privileges, revocation of base registration, or debarment action.
16. Firearm and Ammunitions. Transporting weapons or ammunition, concealed or otherwise, IS NOT permitted by any non-law enforcement personnel on Maxwell AFB/Gunter Annex at any time regardless of state issued concealed weapons/LEOSA permits. Violations may result in criminal prosecution under the applicable Federal laws.
17. Illegal Weapons. The below weapons are considered illegal, unless specifically authorized by competent authority, and are prohibited on Maxwell AFB/Gunter Annex. Violations may result in criminal prosecution under the applicable federal laws.
a. Switchblade knives or knives with any type of automatic blade release.
b. An incendiary/explosive weapon (e.g., grenades, flash bangs).
c. Fireworks
d. Homemade mortars, aka “tennis ball launchers” or similar devices.
18. Safety. The contractor must have a safety and health plan for their employees. The contractor shall instruct each employee in the recognition and avoidance of unsafe conditions and regulations to his work environment to control or eliminate any hazards or other exposure to illness or injury.
19. Accident/Incident Reporting and Investigation. The contractor shall record and report to the CSO all available facts relating to each instance of accidental damage to government property or injury to either contractor or government personnel. The contractor shall secure the accident scene and wreckage until released by the accident investigative authority through the CSO. If the Government elects to conduct an investigation of the incident the contractor shall cooperate fully and assist the government personnel until the investigation is completed.
20. Government Contractor. The Contractor and their employees will perform services under this contract in accordance with the terms and conditions of this contract to include the SOW as a Contractor and not as a Government agent or employee or joint venture. The Contractor and employees are employed to render professional aviation services only, and any payment by the Government, are compensation solely for such services rendered.
21. System for Award Management. The contractor must be registered with the System for Award Management (SAM) database. This will require a DUNS number. If the contractor is not registered with SAM, further information may be found at www.sam.gov.
