Justification and Approval for Other Than Full and Open Competition
1. Contracting Activity: Contracting Command – New Jersey
2. Description of Action: This justification is for award of a Fixed Price (FFP) contract with Unholtz-Dickie Corporation for procurement of a Medium Vibration System. The Government projects award for September 2020 and Fiscal Year 2020, Army Research, Development, Test & Evaluation (RDTE) funds will be used.
3. Description of Supplies/Services: Medium Vibration System to replace the existing MB C150 Vibration System suspension that became inoperable at high displacement vibration. Vibration System consists of: Air Cooled Electrodynamic shaker with 3-inch displacement, External shaker air cooling blower, DC Field Power Supply, Class D High Efficiency Power Amplifier, interface cables, Remote Panel, and Magnesium Head Expander with Operating Voltage of 480 volt 3 phase corner grounded delta. The Contractor shall deliver equipment, and provide on-site installation to include rigging, electrical, and plumbing, in accordance with the requirements listed in the Statement of Work (SOW).
The estimated value of this effort is and the period of performance is eighteen (18) months) from date of award.
4. Authority Cited: Title 10 United States Code 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Reason for Authority Cited: FAR 6.302-1(b)(1)(ii) applies when unique supplies or services available from only one or a limited number of sources or from only one or a limited number of suppliers with unique capabilities.
Market Research indicates the Vibration System falls within the commercial items definition as it is customarily used by the general industry and has been sold, leased, or licensed to the general industry. This action should be a Sole Source acquisition because market research shows there is only one Medium Size (18,000 lbs.), Air Cooled Shaker that is manufactured by Unholtz-Dickie Corporation, a business capable of providing the needed equipment and installation specified in the Statement of Work.
The mission of the QESA group is to perform natural and induced environmental testing of weapons, weapons/fire control systems, associated armament components, explosively loaded and inert munitions. To remain competitive it is essential that the laboratory have state of the art testing tools to subject test items to harsh environments. The new Vibration System must be able to deliver required performance (listed within Statement of Work), and be 100% Air Cooled maximizing reliability and reducing the cost of installation, operation and maintenance. The new Vibration System must be able to produce acceleration levels in accordance with the Statement of Work. Examination of other Vibration Systems’ specifications has revealed that Unholtz-Dickie (UD) Corporation is the only manufacturer of Vibration Systems with the following required capabilities.
a. The UD system is the only commercially available machine with 100% Air Cooling maximizing reliability and reducing the cost of installation, operation and maintenance.
b. The UD system is the only commercially available machine with dual internal guidance bearings along with shear mount and current spring elements to improve off-axis load balance and enhance long term shaker armature reliability.
c. The UD system is the only commercially available medium size machine that has internal pneumatic load support of 2,500 pounds. These specifications/capabilities will enable QESA to replicate Shock environment as specified within Statement of Work.
d. The environmental laboratory is required to determine confirmation of a product quality for reliable field operations. The newest weapons (i.e. smart munitions) require not only existing test techniques, but also the most advanced and latest testing techniques. This effort requires the UD Corporation, a
. The UD system will not only provide for the existing testing needs of today, but can expand to meet the testing needs of tomorrow.
e. Use of a system other than the UD will: Impact installation cost (equipment and refrigerants), maintenance cost (water/oil treatment), the extra space required to install water/oil cooling equipment, and will also require purchasing of new Chiller and associated heat exchange equipment because other systems use additional water and oil cooling to dissipate heat generated during operation. The hardware and installation labor cost of additional equipment is . The additional maintenance cost is per year and includes water treatment and descaling of heat exchanger. In addition to cost/maintenance factors the Laboratory work area does not have space for installation of additional equipment.
Based on the above, and as described in FAR 6.302-1(b)(1)(ii), full and open completion will not be provided for the acquisition of the Medium Vibration System.
6. Efforts to Obtain Competition: As required by FAR 5.201, and by the Small Business Act (15 U.S.C.637(e)) and the Office of Federal Procurement Policy Act (41 U.S.C.1708), the market research contains GSA Advantage Request for Quotation (RFQ) 1401757; and beta.SAM.GOV Sources Sought Notice PANNWJ-20-P-0000001795 as a notice to the
GPE for the proposed action. The Contracting Officer shall also publish the notices required by FAR 5.201 and any bids or proposals received shall be considered. However, effective competition is not anticipated because UD Corporation is the sole source identified through market research that is capable of meeting the Government’s requirements. A subcontracting plan will not be required for this acquisition because UD Corporation is a small business vendor.
7. Actions to Increase Competition: Current action is incorporating a new Vibration System with vintage Conditioning System. As testing requirements change, the technology to accommodate these requirements also changes. This evolution will provide possibilities for numerous manufacturers to compete by providing the newest technology.
8. Market Research: Market Research was conducted from 07 January 2020 through 21 January 2020 by the Combat Capabilities Development Command Armament Center (CCDC-AC), Futures Command, Armament Center, Enterprise & Systems Integration Center (FCDD-ACE-QEC) Quality Engineering & Systems Assurance (QESA). The Market Research Techniques used include: Reviewed trade journals (TEST Engineering & Management (Monthly subscription). Contacted knowledgeable people (Government and industry) in specific markets, Noise and Vibration Technologies, LLC (NVT GROUP).
Conducted market surveys to obtain information from potential sources, Noise and Vibration Technologies, LLC (NVT GROUP) and Blanket Purchase Agreements (BPAs).
Queried Government databases: Federal Procurement Data System – Next Generation (FPDS-NG), Past Performance Information Retrieval System (PPIRS), Contract Performance Assessment Reporting System (CPARS), General Service Administration (GSA), Small Business Administration (SBA) databases, e-Portals in Commerce (e-PIC), Contract Management in Research Tool in ASFI etc. that provide relevant information on acquisitions. Used Internet tools and performed Web searches for Electrodynamic Vibration Systems manufacturers. Issued formal requests for information, sources sought synopses, draft statement of work and solicitations in appropriate technical or scientific journals, and business publications. Posted GSA Advantage RFQ1401757, four (4) vendors were contacted, and Zero (0) quotes were received. Posted Sources Sought Notice PANNWJ-20-P-0000-001795 on beta.SAM.gov, and three (3) vendors provided responses, which were evaluated, as listed below. Reviewed catalogs and literature published by service providers (reviewed service manuals for MB Vibration Equipment).
Reviewed Federal Supply Schedule contracts, and other Government contracts.
9. Interested Sources: To date, three (3) interested sources have written to express interest in the acquisition. They are as follows:

Does make air-cooled shakers. UD has been in continuous business operation for over 60 years designing and supplying Electro-Dynamic VIBRATION TEST SYSTEMS to government and commercial customers.
The Offeror has complied and addressed all requirements of Sources Sought Notice. The Offeror stated in detail they will provide requested equipment, rigging and interconnection of new and existing equipment. The Offeror may clarify the height Magnesium Head Expander and how to achieve desired twelve (12) inch height. Technical Capability is Acceptable.

Our electrodynamic shaker systems offer high performance with high reliability. The complete solution comprises the latest control systems, energy-efficient power amplifiers, shakers and excellent global support, servicing and training. The Offeror has not complied and did not address all requirements of Sources Sought Notice.
Electrodynamic shaker physical details (size) exceed required limits. Cooling components details (lengths of hose) are missing. The Offeror did not address new equipment rigging and interconnection of new equipment. The Offeror did not address the rigging of existing equipment. The Offeror did not address Magnesium Head Expander. The Offeror did not address any Performance Requirements. Technical Capability is Not Acceptable.

Power amplifier details are missing. The Offeror stated they will provide requested new equipment, rigging and interconnection of new equipment. The Offeror did not address the rigging of existing equipment. The Offeror needs to clarify the height Magnesium Head Expander and achieve desired twelve (12) inch height. a. Procurement history:
(1) was awarded to . This requirement was accomplished using full and open competition and a lowest price technically acceptable (LPTA) source selection method. Two (2) offers were received, but only one was found technically capable to meet all of the Government’s requirements.
(2) The procurement history did not identify any unusual patterns or consecutive urgent buys. Additionally, no significant changes have been identified in the marketplace. The Market Research has identified only one acceptable vendor/source.

An independent Government cost estimate has been prepared for this requirement. In accordance with FAR 15.404-1(b)(2)(ii) and (v), price analysis will be performed to determine fair and reasonable pricing by comparing the proposed prices to historical prices paid, and to the independent Government cost estimate. Certified cost or pricing data will not be required for this commercial acquisition pursuant to the exception in FAR 15.403-1(c)(3).
