MCC-10-RFQ-0063

This is a combined synopsis/solicitation prepared in accordance with the format in FAR Subpart 13.3, Simplified Acquisition Methods as supplemented with additional information included in this notice.

This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number is MCC-10-RFQ-0063 and the solicitation is issued as a request for quote (RFQ). The associated NAICS code is 541512 Computer System Design Services. The resulting agreement will be a BPA with call orders issued on a firm fixed-price basis with an anticipated BPA ceiling value of $60,000.

MCC requires additional licenses of KWiz Collaboration Bundle/Web Parts. MCC currently uses KWiz in its Sharepoint environment, which is comprised of 13 of the most commonly used web parts.

Of the 13 web parts, 6 are in active use, and 4 are in the testing phase.

The Web parts will be used as server controls, and will be added to the web page to enable the end users to modify the content, appearance, and behavior of web pages directly from a browser.

KWizCom web parts are used to meet several current business requirements that are not natively supported within SharePoint.

If an updated version of the KWiz Collaboration Bundle is required during the period of performance of this BPA, a modification to an existing call or a new call will be established to provide continued license renewal, maintenance, and standard support for the updated version of the software. The Standard Support Program for the KWiz Collaboration Bundle/Web Parts is as follows:

• 1 year of product version upgrades

• Up to 3 support incidents per year, up to 2 business days response time

• 18% of the product’s price ($99 minimum) a year

The contractor shall provide the following products/services:

• KWiz Collaboration Bundle/Web Parts

• Maintenance and standard support for single user licenses for

KWiz Collaboration Bundle/Web Parts

• Development Licenses for KWiz Collaboration Bundle

Additional licenses with standard support may be required on an as-needed basis.

SECTION II

CONTRACT TERMS AND CONDITIONS/CONTRACT CLAUSES

II.A TYPE OF CONTRACT

The Millennium Challenge Corporation contemplates award of a BPA with call orders issued on a firm-fixed priced basis.

II.B EXTENT OF OBLIGATION

The Government is not obligated to order any supplies or services under this Agreement. The Government is obligated only to the extent of authorized calls placed against this BPA.

II.C PURCHASE LIMITATIONS

An individual call placed under this agreement shall not exceed the limit of the ordering officer’s authority as specified in paragraph II.E.b.

II.D PRICING COMPLIANCE

The vendor warrants by performance of any call placed under this Agreement that the prices charged to the Government shall be as low as or lower than those charged the vendor’s most favored customer for comparable quantities under similar terms and conditions.

II.E ORDERING PROCEDURES AND LIMITATIONS

a. Call Orders – Calls placed under this Agreement may be made orally, by fax, by E-mail, or by regular mail. Each call will be assigned a call number.

b. Authority to Place Calls – Orders may be placed by any MCC warranted contracting officer.

II.F PERIOD OF PERFORMANCE

The period of performance for the BPA shall be five (5) years. Specific dates will be included at award.

II.G DELIVERY

a. All products or services requested under this Agreement shall be delivered to the address as specified by each individual call within 14 days of award.

b. All calls placed under this Agreement shall be shipped complete. No partial shipments will be accepted.

c. All deliveries shall be made within the time agreed upon by the vendor and the BPA caller when the call is placed.

d. Delivery of all items under this Agreement shall be F.O.B. Destination and shall be shipped “all transportation cost prepaid.”

e. The contractor shall ensure timely delivery of call orders.

f. The contractor shall acknowledge each call order received.

g. The contractor shall provide a delivery ticket of supplies delivered.

II.H PERFORMANCE LOCATION

The contractor will perform standard support services in their own facilities.

II.I

MCC 52.232-70 INVOICE INSTRUCTIONS (FEB 2008)

Invoices shall be paid in accordance with the Prompt Payment Act, thirty days (30) following receipt of a proper invoice. The Contractor shall submit each invoice electronically via email or fax to the following:

If it is determined that the amount billed is incorrect, the invoice may be revised by the Government, or the contractor may be required to submit a revised invoice.

To constitute a proper invoice, each invoice must include the following information and/or attached documentation:

(1) Name, address and telephone of the Contractor

(2) Date of invoice and invoice number

(3) Contract number (including task order or call number and contract line item(s)) also modification number, if applicable

(4) Description (quantity, unit of measure, unit price, and extended price) of the supplies/services rendered (including hours incurred and billing rate, as applicable to the contract)

(5) A schedule depicting the following information:

Cumulative Amount Invoiced

Authorized Value of Contract

Balance Remaining on Contract

If the contractor is billing for costs incurred over more than a single month, the costs for each month in which the costs were incurred and shall be segregated into the month they were actually incurred.

(6) Name of Contracting Officer’s Technical Representative (COTR); and

(7) Signature of authorized representative of the firm with the following invoice certification:

“The undersigned hereby certifies to the best of my knowledge and belief that: the sum claimed under this contract is proper and due, and all the costs of contract performance have been paid, or to the extent allowed under the applicable payment clause, will be paid by the Contractor when due in the ordinary course of business; the work reflected by these costs has been performed, and amounts involved are consistent with the requirements of this Contract.

II.J MCC 52.242-70 CONTRACTOR PERFORMANCE SYSTEM (CPS) REGISTRATION

(FEB 2006)

The Millennium Challenge Corporation (MCC) is using the National Institutes of Health (NIH) Contractor Performance System (CPS) to evaluate contractor performance (see FAR, Subparts

42.1502 and 42.1503). Contractors doing business with MCC are required to register in the NIH CPS accessible via the Internet at: https://cpscontractor.nih.gov. Inquiries regarding the registration process should be addressed to the NIH CPS help desk. The email address is cps-support-l@list.nih.gov and the telephone number is (301) 451-2771.

II.K MCC 52.204-70 CONTRACTING OFFICER’S TECHNICAL REPRESENTATIVE

(COTR) AND/OR PROJECT MONITOR (PM) (FEB 2009)

(a) The Contracting Officer may designate a Government representative to act as the Contracting Officer's Technical Representative (COTR) or Project Monitor (PM) to perform functions under the contract such as review and/or inspection and acceptance of supplies, services, including construction, and other functions of a technical nature. The Contracting Officer will provide a written notice of such designation to the COTR and/or PM and the Contractor. The designation letters will set forth the authorities and limitations of the COTR and/or PM under the contract.

(b) Modifications to this contract are effective only if reduced to writing and executed by the Contracting Officer. The Contractor is specifically prohibited from performing any work that is outside the scope of this contract without the approval of the Contracting Officer. The Contracting Officer cannot authorize the COTR or any other representative to sign documents (i.e., contracts, contract modifications, etc.) that require the signature of the Contracting Officer.

II.L 52.211-6 BRAND NAME OR EQUAL (AUG 1999)

(a) If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation.

(b) To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must—

(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation;

(2) Clearly identify the item by—

(ii) Make or model number;

(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.

(c) The Contracting Officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.

(d) Unless the offeror clearly indicates in its offer that the product being offered is an “equal” product, the offeror shall provide the brand name product referenced in the solicitation.

When Federal agencies develop, procure, maintain or use electronic and information technology, Federal employees with disabilities have access to and use of information and data that is comparable to the access and use by Federal employees who are not individuals with disabilities, unless an undue burden would be imposed on the agency. Section 508 also requires that individuals with disabilities, who are members of the public seeking information of services from a Federal agency, have access to and use of information and data that is comparable to that provided to the public who are not individuals with disabilities, unless an undue burden would be imposed on the agency.

II.N QUALITY MONITORING

The Contractor shall be in compliance with FAR Clause 52.246-2, Inspection of Supplies – Fixed Price when performing all services required under this BPA.
