JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF BRAND NAME OR EQUAL DESCRIPTIONS, OR PROPRIETARY SPECIFICATIONS
AND STANDARDS, IN SOLICITATIONS
1. Contracting Activity.
Blount Island Command, Contract Support Management Office, Jacksonville, Florida
2. Description of the Action Being Approved.
The purpose of this J&A is to approve award of a sole source contract to Marine Travelift, 49 E.
Yew St., Sturgeon Bay, WI 54235.
3. Description of the Supplies/Services.
A Mobile Boat Hoist (MBH) is a critical component to lift, dry dock and portage Navy Watercraft at Blount Island Command. Marine Travelift 150C Mobile Boat Hoists (MBHs) Serial Numbers 3278-0906 and 3329-0907 have been reassigned from Amphibious Construction Battalion TWO (ACB2), Joint Expeditionary Base Little Creek, Virginia Beach, Virginia to Navy Support Management Branch (NSMB) Blount Island Command, Jacksonville, Florida.
This J&A authorizes sole source services from Marine Travelift as the Original Equipment Manufacturer (OEM) to disassemble the MBHs at ACB2, transport them to Blount Island Command, and reassemble the MBHs. Load tests will be required once reassembled. Marine Travelift will be required to support the load tests.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C Section 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
NAVFAC P-307 Navy Standards for Weight Handling Program Management provides the qualification requirements for contractor personnel involved in the operation, maintenance, inspection, testing, and certification of Navy Weight Handling Equipment (WHE). NAVFAC P-307 requires Original Equipment Manufacturer (OEM) technicians and personnel are trained to work on
V1.1, 03 October 2022 specific components. Additionally, OEM factory trained, and authorized technicians are exempt from NAVFAC P-307 requirements for crane maintenance.
Market Research was conducted for possible vendors to accomplish the task. OEM authorized dealers are appointed regional service areas and are not authorized to perform or provide services out of their respective service area. The OEM, Marine Travelift Corporate Headquarters was contacted and advised, as the prime, they can coordinate accomplishment of the tasks from one service area to another.
NAVFAC P-307 requirements and OEM service area constraints resulted in utilization of the OEM for this contract effort.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
NAVFAC P-307 dictates vendor qualifications and vendor criteria. For this MBH effort, the only OEM authorized service centers are Marine Travelift Mid-Atlantic for Virginia area and
It was determined that the OEM, Marine Travelift Corporate Headquarters, is the only source of technical and mechanical knowledge of all components of the MBH to inspect, disassemble, prepare for transport, transport, reassemble and make authorized repairs to their designed weight handling equipment that complies with NAVFAC P-307 regulations.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined that the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5 and 6 above, the Marine Corps has no plans at this time to compete future contracts for the types of services covered by this J&A. If another potential source emerges, the Marine Corps will assess whether competition for future requirements is feasible and will continue to conduct market research prior to future procurements.
