Air Base. If the tires do not last as long as the manufacturer’s life expectancy, it is still considered fair wear and tear due to the terrain at Ahmed Al Jaber Air Base and will be replaced at no additional cost to the Government. If the Contractor believes the tire(s) were damaged due to Government negligence, the Contractor may issue a written claim to the KO. Each claim will be dealt with on a case-by-case basis.

The condition of the loaner shall be the same as the primary MHE, thus will meet the same criteria’s outlined in Section 3, MHE Condition. In addition, the loaner shall be of equal or greater MHE type than the primary MHE. A loaner is of equal or greater MHE type if its rate is equal or greater and the utility is equal or greater than the primary MHE. If no loaner of equal or greater MHE type is provided within 24 hours, the daily lease rate of the primary MHE shall be deducted from the monthly invoice for every day the Government is without a MHE. Primary MHEs not returned within 30 days will be replaced, at the KO/TPOC’s approval, with another MHE of equal or greater MHE type and the Government will the equivalent or discounted daily rate temporarily until the requested MHE type is delivered.

4.7.For a MHE to be classified as a “lemon” the MHE must have (1) a defect which is under warranty and/or (2) have two failed repair attempts designed to bring the MHE up to manufacturer’s standards. If a leased MHE is deemed a “lemon,” the Government shall request a replacement MHE and full refund of the cost to repair the MHE if the repairs failed to bring the MHE to meet the manufacturer’s standards. If the repair is due to a defect, the cost to repair the MHE shall not pass to the Government. If the defect is substantial, as determined by the KO, the Contractor is given one (1) attempt to repair the defect. A substantial defect is a defect which impairs the MHE’s use. If the defect is not substantial, the Contractor is given two (2) attempts to repair the defect. If the repair is not due to a defect, the Contractor shall follow instructions in Section 8, Payment, and will be given one (1) attempt to repair a substantial malfunction and two (2) attempts to repair non-substantial malfunctions.
