GYM EQUIPMENT AND INSTALLATION

Statement of Work (SOW)

Project: 23rd MAR 4th MARDIV Gym Equipment Package

The site address is:

1. Scope: The purchase, delivery, and installation of commercial gym equipment in San Bruno, CA at the site address listed above for 23d Marine Regiment, 4th Marine Division.

2. Project Manager: All required actions will come through the Government Project Manager (PM). The

Government PM will be Master Sergeant Hugo Roman 760-509-6825 (hugo.roman@usmc.mil).

3. Contractor POC: Contractor will provide a project point-of-contact (POC) within 5 days of award. Project POC shall provide:

a. Project plan and milestone schedule 5 days after contract is awarded.

b. Confirmation of coordination for item delivery, project installation, and inventory control with Government

PM within 10 days of contract award.

c. Project closure meeting once project is complete will be coordinate with Government PM (virtual via MS

Teams/Skype or in-person).

d. Performance of work executed within normal business practices.

e. Contractor Project POC will coordinate all changes with Government PM/Contracting Office.

f. Invoice acceptance and processing for payment will occur only after project is completed with all required deliverables.

4. Schedule: Installation date and scope of work should be completed no later than 30 days after the contract has been awarded. However on a case by case basis, if an adjustment to the installation schedule needs to be arranged; coordination with the Government PM is required and can only be approved by the Government PM.

a. Site Visit Dates: Monday – Friday 0800 – 1600 (call Government PM for access)

b. Installation will be conducted during normal working hours, Monday – Friday 0800 – 1600, or at the customer’s discretion and during non-holiday hours.

c. Installation will be completed no later than 30 days from the award date.

5. Contractor Services:

- Contractor is responsible for accurate measurements and proper placement of all equipment requested, inside delivery and installation of all equipment.

- Contractor is responsible for shipping and installation to the area that the equipment is to be delivered and installed, whether temporarily stored or otherwise.

- Contractor must use a trusted/known source for equipment installation. “Trusted/known” will be defined as a service provider that will not void any warranties by utilizing their services. If Contractor utilizes a temporary employment agency (i.e. “Labor Ready”), the workers must have the skill sets for and prior work experience installing commercial quality fitness equipment.

- Contractor is responsible for the installation of all equipment, including applicable flooring based on square footage measurements provided.

6. Discrepancies: The Government reserves the right to refuse final acceptance until all discrepancies have been satisfactorily resolved. The contractor shall prepare a project discrepancy list, report detected issues during meetings, and track all discrepancies until resolved. The Government shall review and monitor all discrepancies and deliverables. The discrepancy list shall include any problem(s) identified during inspections that are conducted by either the contractor or Government, or both. The contractor shall retain a history of discrepancies. Problems identified at any time during the course of this project shall be documented, provided to the Government, and corrected prior to final acceptance.

7. Quality Assurance:

A. This section identifies the method of the Government’s Quality Assurance Plan (QAP) will use to verify the quality of the contractor’s performance.

B. Re-performance of unacceptable services at no additional cost is the preferred course of action when appropriate.

C. If adverse conditions or other factors beyond the Contractor’s control are the cause for failure to meet contract specifications, no remedy will be assessed against the Contractor for failure to perform provided each incidence is documented by the contractor and submitted to the Government PM for approval by the Contracting Officer (KO). If the parties do not agree that the cause is due to factors beyond the Contractor’s control, the Contractor may proceed with a dispute under the contractor’s FAR Clause 52.212- 4.

D. Government PM shall be notified on progress of installation/repairs in order to allow scheduling to witness work at the site.

E. FAILURE TO INSPECT. If the Contractor fails to notify the Government PM that the work is ready for inspection, or the Contractor fails to attend an inspection after notification, then the Government PM may conduct an inspection at his/her own convenience, and his/her findings shall be considered as if they had been mutually agreed upon in a joint inspection, and the Contractor will be considered to have chosen not to correct any deficiencies. See the paragraph entitled “Government Remedies” below for the consequences of this situation.

F. GOVERNMENT REMEDIES. The KO will follow the Service Delivery Summary below, FAR 52.212-4, Contract Terms and Conditions-Commercial Items and 52.246-4 Inspection of Services, for Contractor’s failure to perform satisfactory services or failure to correct non-conforming services.

8. Changes: The Government PM is not authorized to make any changes to this contract. Only a warranted

Contracting Officer (KO) is authorized to make changes to this contract. In the event the contract effects any change at the direction of any person other than the KO, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase incurred as a result there of.

9. SAFETY GUIDANCE:

Contractors shall adhere to all relevant safety guidance, including (but not limited to):

(a) EM 385-1-1 – U.S. Army Corps of Engineers Safety and Health Requirements Manual

(b) OPNAVINST 5100.23 (series), Navy Occupational Health and Safety Program Manual

(c) MCO 5100.29 (series), Marine Corps Safety Program

(d) MCO 5100.8, Marine Corps Occupational Safety and Health (OSH) Policy Order

(e) NAVMC DIR 5100.8, MARCOR OSH Program Manual

Government PM shall immediately report accidents/injuries sustained during contract performance to the KO and responsible agency safety officials.

The Contractor’s quoted descriptions shall reflect the characteristics and level of quality that will satisfy the Government’s need as described in the Schedule of Supplies/Services. The quoter must clearly demonstrate that they can meet the solicitation requirements and the requested delivery start date. Delivery lead time after receipt of order for supplies and period of performance for services if different than listed in the solicitation document.

List by line item if the delivery lead time differs from one line item to another. This should be visible on the face of the quote and not incorporated as a link or other attachment.

It is the Government’s intent to award a single firm-fixed price award on an “all-or-none” basis to satisfy this requirement using procedures in accordance with FAR Part 12, Acquisition of Commercial Items, and FAR Part 13, Simplified Acquisition Procedures.

This requirement is a 100% set-aside to small businesses. The applicable NAICS is 339920 and the small business size standard is 750 Employees.

Payment Terms: NET 30. In accordance with DFARS 252.232-7006, invoices under the resulting contract shall be submitted electronically via Wide Area Workflow (WAWF). Specific instructions for invoicing through WAWF are contained in the solicitation.

Any direct customer contact by Quoters is not authorized during the solicitation phase or your quote may be at risk of being eliminated from consideration for this solicitation.

No telephone calls will be accepted regarding this solicitation. Interested quoters shall submit any questions, in writing, electronically to SSgt Robles, L. at lizbeth.robles@usmc.mil.

Quotes shall be submitted no later than 20220912 at 1:00 pm C.S.T. Quotes shall be submitted electronically via electronic mail (e-mail) to SSgt Robles, L. at lizbeth.robles@usmc.mil. Each email may not exceed 5MB in size due to this agency’s server/network restrictions. Vendors may submit multiple emails to ensure a complete quote is received prior to the solicitation closing date and time. Vendors are responsible for ensuring their quotes have been received via email by this date and time specified. Delivery delays that cause a quote to be late are not the responsibility of the Government agency.

Quoters shall provide their full vendor name and any doing business as names as certified in the mandatory System for Awards Management at www.sam.gov. Quotes shall also include a vendor point of contact information (name, phone, and email), address, CAGE Code, and Unique Entity Identifier (UEI) number.

Descriptive literature is required with all quotes for “equal” products (where “brand name or equal” items are being requested). Quoters should submit sufficient descriptive literature to permit the contracting agency to assess whether the product proposed meets all the salient characteristics specified in the solicitation. Quoters quoting "equal" items should provide the brand/make, model, description of the items.

It is the quoters responsibility to furnish sufficient information and detailed specifications to the government to determine acceptability of the quoted item(s). Failure to provide product quotes that meet the salient characteristics may result in quote being considered non-responsive.

52.212-2, Evaluation-Commercial Products and Commercial Services Addendum (Nov 2021)

The Government reserves the right to award no contract at all, depending on the quality of quotes submitted. The Government intends to evaluate quotes and issue an order without discussions with vendors. Vendors should not expect requests for clarification or additional information from the Government. Award will be based on the initial evaluation of quotes received in response to the solicitation. However, the Government reserves the right to conduct discussions with vendors if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; and may waive informalities and minor irregularities in quotes received.

A comparative evaluation to obtain best value will be performed in accordance with FAR 13.106-2(b)(3) using:

-price;

-and non-price factors of: technical capability and past-performance.

The government reserves the right to select a response that provides benefit to the government that exceeds the minimum, but is not required to do so.

The awarded response may exceed the identified requirements in one or more ways and may or may not provide the lowest price, but does provide benefit to the Government as determined by the KO.

The Government is not bound to make award to a response that exceeds the requirements if it provides no value or benefit to the Government.

The Government may use information such as DoD PPIRS, SPRS and FAPIIS data available from Government sources to evaluate a Quoter's past performance.

Potential awardee will be screened for responsibility in accordance with FAR 9.104.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or…
