1. Agency and Contracting Activity.

2. Description of Action Being Approved.
Marine Corps Installations Pacific (MCIPAC) Fire and Emergency Services Japan (FESJ) has a requirement for protective ensemble structural firefighting personal protective equipment (PPE) to equip firefighters with the essential equipment. The requirement will also replace existing PPE that is nearing end of life cycle. These are assets that must be fully compatible with the existing protective equipment that is in use throughout MCIPAC Fire and Emergency Services Japan departments located in various areas of mainland Japan and Okinawa. For the reasons described below, the Regional Contracting Office will award a contract on a brand name basis for structural firefighting personal protective equipment manufactured by Globe. As required by Currently, MCIPAC FESJ employs 220 firefighters, each are issued 2 turnout gear and will be serviceable for 10 years as required by NFPA 1852. All turnout gears issued to the 220 MCIPAC FESJ firefighters are “G-Extreme” manufactured by Globe.
3. Description of Supplies/Services.
MCIPAC FESJ has a requirement for protective ensemble structural firefighting (PPE), generally referred to as turnout or bunker gear, which is a combination of trousers, boots and jackets, or the entire combination of PPE and clothing. Turnout gear are utilized by firefighters within the organization to protect themselves while safely performing their duties and significantly mitigate risk and hazard (i.e. fires, hazardous materials and medical emergencies). Turnout gear must be manufactured in accordance with OSHA, NIOSH, and NFPA regulations.
The minimum government requirements are outline in a separate attachment.
MCIPAC FESJ O&M funds will be used for this requirement.
4. Statutory Authority Permitting Other Than Full and Open Competition.
This request is submitted pursuant to the authority of Title 10 U.S.C. 2304(c) (1) or 41 U.S.C.
253(c) (1), which provides that full and open competition need not be obtained where there is “only one responsible source and no other supplies or services will satisfy agency requirements”. (FAR 6.302-1(2) (ii) (A&B)).
5. Rationale Justifying Use of Cited Statutory Authority.
MCIPAC FESJ presently utilizes Globe “G-Extreme” turnout. The firefighters are fully trained and familiar with the use, maintenance, care and inspection of Globe turnouts. Historically, MCIPAC FESJ obtained the same Globe-manufactured products, and has established a local standard operating procedure for the maintenance, wear, and end-of-life replacement procedure. Currently, an enterprise level solution has not been identified to address the structural firefighting personal protective equipment. Currently, FESJ has the need to replace existing 80 sets that are nearing end of life cycle on 2017. The additional 30 sets will replace secondary sets that are issued to each firefighter that will be expiring on 2018.
Mix and match of another brand of garments will not guarantee a proper fit of garments if mixed with present garment. Per NFPA 1500, garment maintain a minimum overlap of 2 inches, which may be altered by introducing another brand or cut of garment into the inventory, thus affecting firefighter safety.
Based on the above, only Globe brand turnout gear can provide the standard equipment MCIPAC FESJ requires. Procuring the items that are manufactured by companies other than Globe would add unnecessary re-training and familiarization for personnel in maintenance schedules, procedures, and shelf-lives. To avoid unnecessary duplication of efforts and costs, a brand name award for Globe turnout gear for this effort is necessary and in the Government’s best interests.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible.
This effort will be synopsized in FedBizOps in accordance with the requirements for FAR 5.2.
The Contracting Office shall evaluate all responses received to determine if any other company can provide the required supplies/services. Market research in accordance with FAR Part 10 has been conducted and there are several vendors that can supply similar supplies/services however, the supplies/services are not compatible with the current turnout gear
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine that the price for this acquisition is fair and reasonable in accordance with FAR 13.106-2 and 13.106-3, and, to the extent deemed necessary by the Contracting Officer, using price analysis technique in FAR 15.404-1 (a) and (b).
8. Actions to Remove Barriers to Future Competition.
Due to only one brand being able to satisfy the agency’s requirements and because of the compatibility requirements to ensure proper fit and maintenance of the gear, there is no feasible alternative to remove barriers to competition at this point. In the future, when the entire MCIPAC
FESJ turnout gear inventory need to be replaced, the requirement will be procured on a competitive basis.
