PERFORMANCE WORK STATEMENT

MARINE AIR-GROUND TASK FORCE (MAGTF) INTEGRATION TRAINING SUPPORT

1.0 INTRODUCTION:

This is a non-personal services contract to provide exercise design, exercise control, assessment and knowledge management / information management (KM/IM) support services to the Marine Air Ground Task Force Training Command (MAGTFTC), Tactics and Training Exercise Control Group (TTECG), Marine Corps Mountain Warfare Training Command (MCMWTC), and Marine Air Weapons Training Squadron 1 (MAWTS-1).

The contractor shall assist MAGTFTC G3, staff, directorates, and subordinate commands in providing technical expertise to execute the MAGTF Training Program (MAGTFTP). The contractor shall provide exercise design, exercise control, and assessment for Marine Expeditionary Brigade (MEB) level exercises that incorporate live battalions, squadrons, regimental staffs, group staffs, and other constructive unit formations.

The contractor will provide desired products that include Plan of Action and Milestones (POA&M), Quality Assurance plans, and Monthly Program Management Reports. The contractor will provide draft input for Exercise Standard Operating Procedures (SOPs) and Master Scenario Event Lists (MSELs).

1.1 Objectives:

MAGTFTC is tasked by the Marine Air-Ground Task Force (MAGTF) Training Program (MAGTFTP) order (MCO 35000.11F) with the development of standardized service level training programs to increase training readiness of Marine forces for deployment and employment as a MAGTF in complex, expeditionary environments, including:

1.1.1 Regularly-occurring Integrated Training Exercises (ITX) focusing on horizontal integration of battalion/squadron-sized units from the air, ground and logistics components of the Marine Corps.

1.1.2 Regularly-occurring Mountain Exercises (MTX) focusing on the technical aspects of mountain and cold weather operations and tactical integration of the MAGTF across the warfighting functions.

1.1.3 Regularly-occurring Talon Exercises (TLX) focusing on technical aspects of tactical integration of the MAGTF within an aviation centric event and across the warfighting functions.

1.2 Locations:

1.2.1 MAGTFTC and the Marine Corps Air Ground Combat Center (MCAGCC) are commanded by a single, dual-hatted 1-star or 2-star Marine Corps General Officer. The two commands are heavily integrated and work to provide standardized service level training events, facilities, and other general support for numerous Marine Corps units, as well as US Army, Air Force, Navy, Special Forces, National Guard, Coalition partners, state and local agencies. The mission of MAGTFTC/MCAGCC is to conduct relevant live-fire combined arms training, urban operations, and Joint/Coalition level integration training that promotes operational forces readiness as well as to provide the facilities, services, and support responsive to the needs of resident organizations, Marines, Sailors, and their families today and tomorrow. Over 30,000 military and civilian personnel work aboard MCAGCC. The base is also home to various I Marine Expeditionary Force (I MEF) units and other tenant units and organizations. MCAGCC covers over 12,000 square miles that incorporates a mainside, ranges and training areas. The Combat Center is located in the Mojave Desert about 150 miles east of Los Angeles in San Bernardino County, California, and 50 miles north of the city of Palm Springs. The MAGTFTC G3 is responsible for coordinating and synchronizing the execution of service level training events aboard MCAGCC. The main place of performance for the contractor will be the locations listed below:

1.2.1.1 Tactical Training Exercise Control Group (TTECG) is located aboard MCAGCC. This organization is a directorate of MAGTFTC and led by an O-6/Colonel Director. This organization plans and executes the ITX.

1.2.2 Marine Corps Mountain Warfare Training Center (MCMWTC) is located in the Pickel Meadow of the Toiyabe National Forest. The MCMWTC is 21 miles northwest of Bridgeport, CA and 100 miles south of Reno, NV. The training elevation ranges from 6,800 feet to nearly 11,500 feet above sea level. This organization is a subordinate unit to MAGTFTC and led by an O-6/Colonel as the Commanding Officer. This organization plans and executes the MTX.

1.2.3 MAWTS-1 is a located aboard Marine Corps Air Station (MCAS) Yuma, AZ. This organization is a subordinate unit to MAGTFTC and led by an O6/Colonel as the Commanding Officer. This organization plans and executes the TLX as an event synchronized within the twice annual Weapons Training Instructor (WTI) exercise.

1.2.4 Other. At times, MAGTFTC has the ability to utilize ranges within what is considered the Southwest Range Complex to support and enhance TTECG, MAWTS-1, and MCMWTC training events. These ranges are utilized to execute a training event such as a deep strike/aerial interdiction that support these organization's training event.

2.0 GENERAL REQUIREMENTS

2.1 Performance Standards. The Contractor shall provide the necessary resources and infrastructure to perform this contract (See Paragraph 5.2 of the PWS).

2.2 Government Responsibilities and Interface. The Contracting Officer Representative (COR) will have technical oversight and will execute responsibilities related to performance, deliverable acceptance, invoice certification, and coordination of work effort. The Regional Contracting Office (RCO) Procuring Contracting Officer (PCO) will interface with the prime Contractor’s representative for payment and administration issues.

2.3 Technical Performance Quality. The Contractor shall be responsible for establishing a staff compliment of personnel capable of handling the responsibilities of execution and coordination of team resources as defined in this performance work statement (PWS).

2.4 Applicable References. The Contractor shall use the below references as a guide to the extent necessary to accomplish the tasks as stated in this PWS. 3.0 SPECIFIC REQUIREMENTS.

The Contractor shall provide Subject Matter Expertise (SME) across all elements of the MAGTF (command, ground combat, aviation combat, and logistic combat elements) and all the warfighting functions to include Command and Control, Fires, Maneuver, Intelligence, Logistics, Force Protection and Joint (including Special Operations), Interagency, Intergovernmental, and Multinational functions in the execution of a MTX, ITX, and TALONEX. The contractor must be prepared to begin services within 14 days of award and to provide personnel by-name assignments in accordance with this performance work statement.

The contractor will deliver a Plan of Action and Milestones (PO&AM) to the Contracting Officer Representative (COR) within 14 days of contract award.

The contractor will deliver monthly Program, Status & Management Reports (PSM&Rs) to the COR no later than the 10th day of the following month from the work accomplished from the first to the final calendar day of the previous month.

This report shall be provided in hardcopy and electronic form using any version of Microsoft Office applications. The monthly report shall include, at a minimum:

· Contractor name, contract number, period that the report covers

· Comparison of planned and actual task order performance

· Task progress during the past month and plans for the forthcoming month

· Problems or delays (actual or anticipated) requiring Government action and summary of action required

· Personnel turnover

· Utilization of subcontractor(s)

· Future staffing projections

The Contractor must fill vacancies that arise within 14 days. All contractor personnel assigned to this effort must have a valid driver’s license, have the ability to meet installation access requirements, and be eligible for a US Secret Clearance prior to the start date.

3.1 MTX. MTX is a service sponsored exercise that is executed in a complex, high altitude environment in order to provide an assessment of a unit’s core Mission Essential Tasks (METs). MCMWTC staff coordinates the venue to train technical aspects of mountain and cold weather operations and tactical integration of the MAGTF across the warfighting functions. MTX is conducted at the MCMWTC and associated ranges and training. MTX, at times, will be aligned in a way that logically and plausibly integrates with ITX. This alignment allows for a more challenging command and control and implementation of the MAGTF in an exercise event.

The Contractor shall provide the following support upon request:

3.1.1 Exercise Planning.

3.1.1.1 The Contractor shall assist the MCMWTC in all aspects of exercise planning, providing subject matter expertise as required during the exercise life cycle of MTX.

3.1.1.2 The Contractor shall participate in exercise planning events to assist the MCMWTC staff in defining Exercise Force training requirements.

3.1.1.2.1 The initial planning conference (IPC) occurs 180 days prior to Training Day (TD) 1 of MTX via teleconference. The contractor shall participate in the teleconference.

3.1.1.2.2 The main planning conference (MPC) occurs 90 days prior to TD 1 of MTX at MCMWTC. The contractor shall provide on-site representation during the MPC.

3.1.1.2.3 The final planning conference (FPC) occurs 30 days prior to TD 1 of MTX via teleconference. The contractor shall participate in the teleconference.

3.1.1.3 The contractor shall assist, prepare and present exercise design, scenario related briefings, and participate in working groups and training events.

3.1.1.4 The Contractor shall recommend event responsibilities, control, organizational structure, and assignments that support training goals and objectives during execution of MTX as part of the exercise planning.

3.1.2 Exercise Preparation.

3.1.2.1 The Contractor shall assist the MCMWTC S-3 to develop a scenario that integrates with the common scenario framework that supports the Large Scale Exercise (LSE). The common scenario is maintained by the MAGTF-TC G3. The resulting effort will nest logically and plausibly with the overarching common scenario. Scenario concepts and updates associated with MTX shall be based on METs and training objectives defined by MAGTFTC.

3.1.2.2 The Contractor shall deliver Scenario concept products to include the Road to Crisis, Operational Environment, and Higher & Adjacent Headquarters (H&AHQ) Operational Order (OPORD).

3.1.2.3 Assist in the preparation of products such as intelligence reports, operational reports, and social media products for use in execution of the exercise.

3.1.2.4 Assist in the preparation of the Master Scenario Event List (MSEL).

3.1.2.5 The contractor will assist the MCMWTC S3 in product reviews to ensure scenario products remain consistent with current and/or emerging concepts and doctrine.

3.1.2.6 The contractor will deliver products no later than 30 days after the MPC.

3.1.3 Exercise Execution. The contractor shall support the numerous facets involved for exercise execution on-site that include:

3.1.3.1 Coordinate exercise control to include replication of notional military units (friendly and enemy) to include joint and coalition military forces, Host Nation and US governmental organizations, non-governmental organizations, civilians on the battlefield, and special events as required by the Government.

3.1.3.2 Prepare procedures and processes to manage exercise execution, i.e. exercise control, that include event scripts, intelligence dissemination matrices, information management plans and Command and Control (C2) system architecture diagrams of the exercise event.

3.1.3.3 Maintain a Master Scenario Event List (MSEL) exercise matrix that facilitates training objectives and exercise control.

3.1.3.4 Inject MSEL items such as intelligence, operational and social media products in a way that stimulates the exercise force and facilitates the execution of the exercise.

3.1.3.5 Assist the MCMWTC S-3 in the set-up, operation, and maintenance of computer network, hardware and software as part of a response cell construct appropriate for the exercise.

3.1.3.6 Operate a response cell up to an O-7 level of a Marine Expeditionary Brigade Combat Operations Center (COC) in order to maintain control of the MAGTF. COC personnel require familiarity and current experience in both MEB MAGTF level operations and the Marine Corps Planning Process.

3.1.5.7 Function as role players within a response cell to ensure the MCMWTC staff can assess the exercise force in their ability to achieve training goals and objectives.

3.1.3.8 Monitor activity within response cells to ensure all role player positions correctly operate network hardware and software that supports the exercise event.

3.1.3.9 Role play and represent all actions of an Opposing Force (OPFOR).

3.1.3.10 The Contractor shall ensure necessary Government-owned support equipment, training material, audio/visual equipment, and furniture are in place prior to the event.

3.1.3.11 The Contractor shall provide exercise Observer/Controllers (OCs) down to the company level of the exercise force for designated events during MTX. The Contractor shall designate OCs as subject matter experts (SMEs) on the tasks they will be assigned to observe and control.

3.1.3.12 Use GSA Vehicles as Directed or use Contactor-owned Vehicles as directed for OCs during the execution of MTX.

3.1.3.13 All Contractor provided support, as defined throughout this PWS, shall be in place two (2) days prior to TD 1 of a given MTX.

3.1.4 Exercise Collection Plan and Assessment.

3.1.4.1 Assist the MCMWTC staff to develop a collection plan that captures accurate observations of the exercise force’s efforts to achieve training goals during the execution of the exercise. Recommend key events for observation that capture actions and reactions of an exercise force’s procedures, information management, accuracy of intelligence analysis, ability to combine operations and intelligence (ops/intel fusion), tactics, timeliness in reporting, as well as overall command and control.

3.1.4.2 Assist in documenting and providing observations to MCMWTC staff when required.

3.1.4.3 Provide post-event analysis and comments to the MCWTC staff in support of their assessment and feedback to the exercise force.

3.1.4.4 Prepare event reports, including an After Action Report (AAR) of each MTX. Properly document and archive key aspects of the exercise event for future exercises, historical purposes, and general reference. Recommend changes or improvements for future exercise events. Deliver products no later than 21 days after the end of each MTX.

3.1.5 MTX Standard Operating Procedure (SOP).

3.1.5.1 The Contractor shall assist the MCMWTC staff in establishing MTX SOP that documents best practices of exercise planning, preparation, execution and assessment as a method to standardize MAGTF-TC training events in support of the MAGTF-TP.

3.1.5.2 The Contractor will capture will capture the summer/winter and ITX-integrated variants of MTX as part of the SOP.

3.1.5.3 Deliver a draft SOP to the MCMWTC S-3 no later than 120 days after contract award.

3.2 ITX & TLX

The ITX & TLX are service sponsored assessment of core METs for exercise force units in a combined arms live fire environment. TTECG, a directorate of MAGTF-TC, executes ITX. This event provides a live fire and maneuver venue to train technical aspects of tactical integration associated with MAGTF operations. The event focuses on horizontal integration of the elements of the MAGTF through planning and execution of those events. ITX & TLX are conducted at MCAGCC and associated ranges and training areas to include China Lake, MCAS Yuma, and MCMWTC.

3.2.1 Exercise Planning.

3.2.1.1 The contractor shall support TTECG in all aspects of exercise preparation for ITX & TLX and provide SMEs as required during the exercise life cycle of ITX. The contractor shall generally focus on all warfighting functions with the priority going to Intelligence, Fires, and Maneuver.

3.2.1.2 The Contractor shall attend exercise planning events to assist in defining Exercise Force training requirements.

3.2.1.2.1 The IPC occurs 180 days prior to Training Day (TD) 1 of ITX & TLX via teleconference. The contractor shall participate in the teleconference.

3.2.1.2.2 The MPC occurs 90 days prior to TD 1 of ITX & TLX at TTECG. The contractor shall provide on-site representation during the MPC.

3.2.1.2.3 The FPC occurs 30 days prior to TD 1 of via teleconference. The contractor shall participate in the teleconference.

3.2.1.3 The contractor shall assist, prepare and present exercise design, scenario related briefings, and participate in working groups and training events. The Contractor shall assist TTECG in preparation by recommending ideas, concepts, and methods that support training goals.

3.2.1.4 The Contractor shall recommend event responsibilities, control, organizational structure, and assignments that support training goals and objectives during execution of ITX & TLX as part of the exercise planning.

3.2.2 Exercise Preparation. The contractor shall support the numerous facets involved for exercise preparation on-site that include:

3.2.2.1 The Contractor shall assist TTECG by developing scenario concepts that are integrated into the common scenario that supports the LSE. The common scenario is maintained by the MAGTF-TC G3. The resulting effort will nest logically and plausibly with the overarching common scenario.

3.2.2.2 The Contractor shall base Scenario related products on reports and trends of threats derived from classified and unclassified analysis of real world data, information, and intelligence from regions where a MAGTF will likely deploy for operations.

3.2.2.3 The Contractor shall deliver scenario products to include the Road to Crisis, Operational Environment, and Higher & Adjacent Headquarters (H&AHQ) OPORDs.

3.2.2.4 The Contractor shall provide Marine and joint air operations planning support to TTECG and for those training events that integrate aviation during an ITX. The Contractor will develop draft air flows and schedules to support training events based on available aviation assets participating in the ITX.

3.2.2.5 Assist in the preparation of the Master Scenario Event List (MSEL).

3.2.2.6Assist in the preparation of products such as intelligence reports, operational reports, and social media products for use in execution of the exercise.

3.2.2.7 The contractor will assist TTECG to ensure these scenario products remain consistent with current and/or emerging concepts and doctrine. Scenario concepts and updates associated with ITX & TLX shall be based on core METs and training objectives to be defined by TTECG.

3.2.3 Exercise Execution. The contractor shall support the numerous facets involved for exercise execution on-site that include:

3.2.3.1 Coordinate the numerous facets of exercise control on-site including replication of notional military units (friendly and enemy) as appropriate.

3.2.3.2 Prepare procedures and processes for exercise control that include event scripts, intelligence dissemination matrices, information management plans, air flows and schedules as well as C2 system architecture diagrams of the exercise event.

3.2.3.3 Maintain airflows and schedules and make recommendations for changes as appropriate in the execution of the exercise.

3.2.3.4 Maintain a MSEL exercise matrix that facilitates training objectives and exercise control.

3.2.3.5 Inject MSEL items such as intelligence to include human and signals intelligence, operational and social media products in a way that stimulates the exercise force and facilitates the execution of the exercise. The focus of MSEL items will be intelligence related in the execution of the exercise.

3.2.3.6 Coordinate all aspects of exercise support to include the integrating SME’s and OPFOR that support training goals. Exercise support also includes supporting TTECG to coordinate the use of ranges at MCAGCC, coaching and training of SME’s, and coaching and training of opposing forces that interact with the exercise force.

3.2.3.7 All Contractor provided support, as defined throughout this PWS, shall be in place 21 days prior to TD 1 of a given ITX.

3.2.4 Exercise Collection Plan and Assessment.

3.2.4.1 Assist the TTECG staff to develop a collection plan that captures accurate observations of the exercise force’s efforts to achieve training goals during the execution of the exercise. Recommend key events for observation that capture actions and reactions of an exercise force’s procedures, information management, accuracy of intelligence analysis, ability to combine operations and intelligence (ops/intel fusion), tactics, timeliness in reporting, as well as overall command and control.

3.2.4.2 Assist in documenting and providing observations to TTECG staff when required.

3.2.4.3 Provide post-event analysis and comments to the TTECG staff in support of their assessment and feedback to the exercise force.

3.2.4.4 Prepare event reports, including an After Action Report (AAR) of each ITX. Properly document and archive key aspects of the exercise event for future exercises, historical purposes, and general reference. Recommend changes or improvements for future exercise events.

4.0 SECURITY REQUIREMENTS.

All contractor personnel requiring access to classified information and assigned to these positions shall possess a secret clearance. The prime Contractor and all Sub-contractors (through the prime contractor) shall certify in writing to the Government that personnel supporting this contract are " U.S. Citizens" per DoD Directive 5220.22-M chapter 2 Section 2.

All personnel identified on the certification and/or supporting this contract shall be in compliance with DoD, DON, and Marine Corps Information and Personnel Security Policy to include completed background investigations (as required) prior to start. This contract shall include a DD-254 as an attachment. The Contractor shall have a valid Secret Facility Clearance. The Government shall assist the Contractor in gaining access to Government agencies and installations related to the systems in question.

5.0 DELIVERABLES

5.1 Schedule of Deliverables. Below (Table 1) is a national schedule of the deliverables associated with contract performance. Specific due dates will be accomplished at the POA&M review following the contract award. The COR and the Contractor shall concur on any changes to the schedule and ensure adherence to the revised timeline.

52.207-3 RIGHT OF FIRST REFUSAL OF EMPLOYMENT (MAY 2006)

(a) The Contractor shall give Government personnel who have been or will be adversely affected or separated as a result of award of this contract the right of first refusal for employment openings under the contract in positions for which they are qualified, if that employment is consistent with post-Government employment conflict of interest standards.

(b) Within 10 days after contract award, the Contracting Officer will provide to the Contractor a list of all Government personnel who have been or will be adversely affected or separated as a result of award of this contract.

(c) The Contractor shall report to the Contracting Officer the names of individuals identified on the list who are hired within 90 days after contract performance begins. This report shall be forwarded within 120 days after contract performance begins.

52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (JULY 2013)

(a) Definitions. As used in this provision--

Administrative proceeding means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

Federal contracts and grants with total value greater than $10,000,000 means--

(1) The total value of all current, active contracts and grants, including all priced options; and

(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).

Principal means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(b) The offeror ( ) has ( ) does not have current active Federal contracts and grants with total value greater than $10,000,000.

(c) If the offeror checked “has” in paragraph (b) of this provision, the offeror represents, by submission of this offer, that the information it has entered in the Federal Awardee Performance and Integrity Information System (FAPIIS) is current, accurate, and complete as of the date of submission of this offer with regard to the following information:

(1) Whether the offeror, and/or any of its principals, has or has not, within the last five years, in connection with the award to or performance by the offeror of a Federal contract or grant, been the subject of a proceeding, at the Federal or State level that resulted in any of the following dispositions:

(i) In a criminal proceeding, a conviction.

(ii) In a civil proceeding, a finding of fault and liability that results in the payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more.

(iii) In an administrative proceeding, a finding of fault and liability that results in--

(A) The payment of a monetary fine or penalty of $5,000 or more; or

(B) The payment of a reimbursement, restitution, or damages in excess of $100,000.

(iv) In a criminal, civil, or administrative proceeding, a disposition of the matter by consent or compromise with an acknowledgment of fault by the Contractor if the proceeding could have led to any of the outcomes specified in paragraphs (c)(1)(i), (c)(1)(ii), or (c)(1)(iii) of this provision.

(2) If the offeror has been involved in the last five years in any of the occurrences listed in (c)(1) of this provision, whether the offeror has provided the requested information with regard to each occurrence.

(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the System for Award Management database via https://www.acquisition.gov (see 52.204-7).

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.
