PERFORMANCE WORK STATEMENT
1.0 Scope/Objectives: Force Reconnaissance Company, II MEF requires an evaluation of Force
Reconnaissance Platoon’s proficiency levels in selected tasks to enhance the existing capabilities within their command. This requirement will include subject matter expert (SME) debriefs (in multiple disciplines), materials, facilities, and miscellaneous support.
2.0 Training: The contractor will provide (7) training days of full spectrum-supported Situational Training
Exercise (STX) as a third party evaluator for a Force Reconnaissance Platoon to assess whether, or not, the unit has satisfied the core competency requirements found in the Mission Essential Task List (METL) Performance Execution Checklist (PECL).
2.1 Scenarios will include the use of multiple target/mission sites to include: live-fire capable facilities/buildings, and Mission Event Synchronization List (MESL)-fed triggers/branches. These must closely replicate the operational situations these forces can expect to encounter in a combat zone.
Scenarios must be derived from the frequently-executed mission profiles that expeditionary forces are currently experiencing in theater, to include (1) dynamic assault, (1) soft approach/deliberate clear, and (1) tactical call-out at a minimum. The facilities, or the contractor support staff must provide visual debriefing materials in the form of video recordings.
2.2 Contractor must provide SMEs / Instructors to effectively design, monitor, and evaluate the scenarios of the force being trained for all aspects of the STX. STX objectives must, at a minimum, include the following:
1. Time-Sensitive Target / Rapid Response Planning Process (R2P2) mission planning and Course of Action (COA) development.
2. Concept of Operations (CONOPS) briefing prior to mission approval
3. Actions in the Marshalling Area and Element Launches
4. Supporting Fires Planning and Close Air Support (CAS) integration (SIMCAS acceptable)
5. Movements to Target Areas
6. Actions in the Objective Area and on the Objective

4.0 Contractor Requirements:
1. Contractor will supply real-time command and control (C2) of opposing forces (OPFOR) during all scenarios and exercises involving force on force. These actions require an adversary/opposing force of no less than (8) personnel; uniforms and equipment for OPFOR are unrestricted.
2. Contractor will provide replacement doors and hardware for Shoot House re-configuration cycles;
facilities maintenance personnel must be available to replace, re-hang doors and re-fit breaching and shooting houses following exercises / runs.
3. Contractors will provide heavy equipment platforms to support logistical on/off-load profiles.
Contractor will include simulated cadavers, combat trauma mannequins and/or moulaged patient models to incorporate into the STXs. At least (2) cadavers are required, scalable to (1) if trauma training dummies are available for use.
4. Medical SMEs and Scenario Support Instructors must be current or prior medic / corpsman qualified in one of the following MOS’s / NEC’s (18D/8491/8403/8425/PJ). Instructors are considered highly-qualified if they possess experience as an operator within special operations (SO) or special missions unit (SMU) and have conducted urban operational profiles during the Global War on Terror (GWOT).
5. Contractor will provide SMEs in CQC/Tactical/CQB/Sniper Marksmanship Instruction.
6. Contractor will provide a SME within USSOCOM or Special Missions Units in
USSOCOM/USASOC/Marine Force Recon/NavSpecWar as a NCO, SNCO/CPO or Officer with successful tours within a Special Missions Unit.
7. Contractor will provide SME in Breaching/Explosives/Pyrotechnics with a minimum of (8) years of experience within USSOCOM or Special Missions Units in USSOCOM/USASOC/Marine Force Recon/NavSpecWar providing safe, relevant and positive explosives and / or Dynamic Entry training.
8. Combat Training Certification (SFARTEC, CQTC, or like) copies will be submitted with proposal.
9. Contractor will provide at least (1) target site/venue with adjustable configuration for different layouts for live fire STXs.
10. Contractor will provide at least (2) separate sites, each containing 3-4 separate target buildings in order to create diversity in the training environment for non-live fire STXs.
11. Contractor will provide all appropriate Local, State, Federal Inter-agency Liaison & Deconfliction necessary for the execution of the STX.
12. Contractor will provide White Cell Support to post exercise reception and debrief aspects of all of the evaluated Full Mission Profile (FMP) exercises executed within the STX phase of the training.
5.0 Place of Performance: The contractor’s training complex must be located within (1) hour of drive time of a Military Air Base to facilitate the arrival, departure, rest, refit and refueling requirements of the platforms providing the Transportation of Personnel and Things (TOP/TOT) of the force being trained. The contractor’s training complex should possess at a minimum, the training and logistical requirements listed:
1. Debrief Class Rooms Audio / Visual capable that seat up to (30) personnel per Classroom (to facilitate both the training body and any observers).
2. Secure anchor points for rappel, fast rope, ascension and high angle rescue training
3. Stand-alone 360-degree fully ballistic, interior and exterior explosive, mechanical and ballistic breaching capable live fire shoot houses.
4. Houses must possess overhead catwalks for evaluative and observation purposes and be reconfigurable to change house layouts in support of rapid house re-configuration cycles to minimize down time.
5. Houses must possess multiple explosive exterior entry points and interior explosive and mechanical breaching points. Contractor will provide all breaching mediums used in the rehearsals and dynamic entry profiles of the FMPs of the STX.
6. Houses explosive entry points or facades capable of accommodating a variety of explosive breaching charges up to a Net Explosive Weight (NEW) of point two nine (.29).
7. Compound wall around a building or structure that enable tactical call out training. Those walls must possess personnel and vehicular ingress and egress points / gates.
8. 1000m (+) Known Distance (KD) Rifle Range with raised firing points to support sniper team confirmation of data and data compilation
9. Multiple openings less than 24” in diameter
10. Multiple openings greater than 24” in diameter
11. Multiple entries: elevated & non-elevated
12. Openings located on the top, sides, and bottom of the trainer
13. Multiple access locations with and without obstructions
14. Access: Horizontal and Vertical
15. Elevated shooting platforms that overlook and can be used to engage targets on multiple live fire training ranges
16. Demolitions pit that facilitates up to a single shot 5 lb charge detonation
17. Contractor’s facility will possess DoD Compliant Arms, Ammunition Storage Rooms, Magazines and Bunkers IAW the DoD 5100.76-M (Physical Security Manual)
18. Contactor’s facility will be an approved DoD/BATF Class V Receiving Authority
19. Contractor’s facility must not have any day/night/weekend noise restrictions due to the type of training to be conducted
20. Contractor’s facility will possess a Lodging Facility that includes: adequate shower, restroom, laundry facilities, and internet access compatible with DOD computer systems. Lodging Facility must also be within walking distance of the training areas, and posses a team room large enough for gear stowage and with enough tables and chairs to accommodate up to (30) students
6.0 Period of Performance: The period of performance is from 15 – 21 March 2020. Contractors are required to work the entire (7) days of the evaluation.
7.0 Government Provided Equipment and Materials: The contractor will not be required to furnish any of the following, as the unit will be responsible for providing:
1. All arms, weapons systems, and ammunition.
2. All target materials to include stationary reactive steel, paper re-faces and specialty target arrays
3. Unit issue safety equipment and clothing per student to include the following: Hearing protection, shooting type gloves, eye-protection, basic first aid kits for use during STX, individual uniforms and equipment.
8.0 Privacy Act: Work on this requirement may require that personnel have access to Privacy Information.
Personnel must adhere to the Privacy Act of 1974, Title 5 of the US Code, Section 552a and applicable agency rules and regulations. Additionally, all data and information obtained during the event must NOT be retained and will be appropriately discarded (shredded/deleted) at the conclusion of the event.
9.0 Government Point of Contacts: The Government points of contact are not warranted Contracting Officers and do not have the authority to take any action, either directly or indirectly, that would change the pricing, quantity, place of performance, delivery schedule, or any other terms and conditions of the contract. The Government Technical Representative must be present for the training package and must be the contractor’s primary point of contact regarding execution of the training. The Government Technical Representative will be provided at the time of award.
10.0 Unauthorized Work Performance: The Contractor must not perform work that deviates from contract requirements and specifications. If the Contractor deviates from contract requirements and specifications without approval of the Contracting Officer, such deviation must be at the risk of the Contractor and any cost related thereto must be borne by the Contractor.

5237.102(90) The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for Close Quarters Tactics Training and Evaluation via a secure data collection site.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019)
The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications--Commercial Items.
(a) Definitions. As used in this provision--
Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing--
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. The Offeror represents that it [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will'' provide covered telecommunications equipment or services”, the Offeror shall provide the following information as part of the offer-
(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);
(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;
(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and
(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(c) Representation. The Offeror represents that it [ ___ ] does, [ ___ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) “TAILORED”
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Quotes will be evaluated and ranks according to price, from lowest to highest. The Government reserves the right to evaluate only the technical proposal of the lowest price offeror. Other technical proposals may not be evaluated unless the Government determines the lowest price offeror to be unacceptable or non-responsive. In the event that Government determines the lowest price offeror to be unacceptable, the technical proposal of the next lowest price offeror will be evaluated. This process will continue until a technical proposal is determined to be acceptable.
Technical acceptability will be based on the demonstrated ability to meet the technical requirements, including the delivery requirement. A mere statement that the vendor “will meet the Government’s requirements” is insufficient;
the vendor must demonstrate how it will meet the requirement. Best values will be evaluated on: (1) price; (2) technical acceptability; and (3) period of performance.
To ensure technical compliance with the requirements, vendor quotes shall include the following information:
a. Vendor Specifications. The manufacturer’s name and manufacturer’s complete part numbers of items shall be submitted in the quote.
b. Vendor’s quote shall include an active Cage Code and Federal Tax Identification number. Vendors are required to be registered with SAM database and have an active cage code at the time of submission of quote.
c. Period of Performance Information. Clearly state if the quoter can meet the requested period of performance as stated in each CLIN. If not, then state the best period of performance date.
Past performance will be verified via the Past Performance Information Retrieval System (PPIRS).
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Questions will not be accepted after 12:00 PM Eastern Standard Time on 6 February, 2020.
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (DEC 2019)
ALTERNATE I (OCT 2014)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision--
“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
“Sensitive technology”—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Veteran-owned small business concern” means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
“Women-owned small business concern” means a small business concern --
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
