1.0 Scope: This Purchase Description (PD) defines the Government’s minimum requirements for a NFPA Class A cabinet oven primarily used for the curing of Power Thermal Management System Controller (PTMS) components. The oven will be used to cure epoxy of the assembled controller in Shop 94501, Building 129. This purchase description defines the minimum requirements needed for a “turn key” batch oven procurement to include existing equipment removal, delivery, unloading and rigging, installation, testing, and training.

2.0 Applicable Documents: The latest edition of the documents below shall be used.

3.0 Essential Characteristics: The oven shall meet the requirements of NFPA 86. The oven shall, at a minimum, meet the following requirements:

3.1 Building Electrical Service Available: 208 volt, 3 phase, 60 Hz, 40 Amp maximum. The contractor shall use electrical service identified on drawing PE-21867.

3.2 Oven Footprint: The oven shall be an NFPA Class A Oven and shall conform to NFPA 86 standards for ovens and furnaces. The oven’s interior chamber dimensions shall be a minimum of 38 inches wide by 38 inches deep by 36 inches high. The total footprint of the oven including all accessories shall not exceed 75 inches wide by 54 inches deep by 100 inches high. The door to the oven’s inner chamber must be accessible from the long (75”) side. The oven shall be designed to fit within the amount of floor space allotted. The oven shall come equipped with one (1) rollout shelf located at the bottom of the oven workspace with a minimum distributed weight capacity of 150lbs. The oven interior and control panel shall be fabricated using type 304 Stainless Steel. The oven shall not inhibit the travel of any material handling bridge crane system over the entire footprint of the crane travel, which may be within the general area of the oven. The equipment shall be designed and positioned allowing access to all serviceable components of the oven. Available footprint is shown on FRC East drawing PE-21867. With bid proposal vendor shall provide dimensioned equipment footprint and all ancillary equipment for Government Facilities Planning & Engineering review to ensure equipment will fit in the allotted space. The contractor shall describe in detail and provide adequate technical drawings of their proposed solution. The contractor shall specifically illustrate how the proposed oven layout solution fits into the provided horizontal and vertical space constraints on FRC East drawing PE-21867. The final orientation and location of the new oven, within the allotted space shown, shall be reviewed and determined by the Government after contract award.

3.3 The oven’s normal operating temperature shall be 120 ºF - 250 ºF. The maximum continuous operating temperature shall be no less than 500ºF. The ovens temperature uniformity shall be +/- 10ºF at all set points.

3.4 The ovens control enclosure shall be NEMA 250 Type 12 rated. The oven’s temperature power control shall be solid-state digital with dual displays with in single degree increments. Programming temperature control shall be digital indicating set-point microprocessor based. All heating shall be electric in nature. An over-temp controller shall be used to protect the oven chamber from high temperature damage. The oven shall have an audible and visible alarm for over temperature situations. A Watlow F4T programmable temperature controller with accuracy of +/- 0.1% shall be installed on the oven. LED pilot lights shall be equipped to indicate when the blower, exhauster, and heaters are energized. Calibration procedures shall be provided for all components requiring calibration (i.e. temperature controller, etc.), see Section 5.7.

3.5 All electrical enclosures and connections shall be NEMA 250 Type 1 rated. Interlock switches shall be provided on the control panel. Heating of the oven shall be accomplished using Silicon-Controlled Rectifier (SCR) power control with backup contactor. The oven shall include Incoloy sheathed tubular heating elements. The heating elements shall have their terminals extending through the oven wall and no wiring shall be exposed to oven temperatures.

3.6 The oven walls and floor shall have a minimum of Six (6) inch thick industrial insulation. Oven recirculation shall be a minimum of 800 CFM with a high-pressure heavy-duty blower driven by a 3/4 –HP electric motor. To ensure maximum temperature uniformity, adjustable louvers shall cover the entire area of supply and return ductwork within the work chamber. Airflow shall deliver uniform horizontal right to left airflow through and past the parts. The oven shall be painted with heat resistant paint in the manufacturer’s standard color(s).

3.7 The oven door shall be heavy duty constructed, double-sided steel hinged, have positive resilient heat seals, and shall be equipped with explosion-venting latches.

3.8 The ovens ventilation shall have a Four (4) inch diameter exhaust outlet. The exhaust outlet shall include a blast gate damper for adjusting exhaust flow. A fresh air inlet shall be provided to make-up air to offset exhaust loss, to include an adjustable damper for balancing internal oven pressure. Necessary safety equipment for processing up to .1 gallon of flammable solvent with a LFL of 3350 SCF/Gallon or less shall be provided, to include but not limited to a purge timer to provide time delay, exhauster air flow safety switch, recirculating blower airflow safety switch, and a 130 CFM powered force exhauster driven by a 1/3-HP electric motor. The exhaust fan shall be mounted on top of the oven.

3.9 The oven shall come equipped with an installed Honeywell DR4300 circular chart, single pen recorder.

3.10 Delivery: The oven shall be delivered no later than 20 weeks after contract award. The contractor shall provide the footprint or drawing of equipment with all facility requirements within 21 days after contract award.

3.11 Installation: The contractor shall be responsible for a complete “turn-key” set-up and installation of the new oven including utilities hook-up from the point of connection to the equipment. The contractor shall connect the oven to the existing FRC Exhaust. During installation of the new oven, the contractor shall comply with all applicable parts of the US Army Corps of Engineers Safety and Health Requirements Manual, EM-385-1-1. Installation shall meet the following requirements.

3.12 Oven Curing Processes.

3.12.1 The processes and ingredients that will be used for the oven being procured.

1. 250 degrees F for one hour to cure 1826 B2 sealant.

1. 120 degrees F for eight hours also to cure 1826-B2 sealant.

1. 150 degrees F for 1.5 hours to cure 10P20-13 and EC213 HC primer (base and catalyst)

1. 150 degrees F for 1 hour to cure 4221T17925 and 0200T129 paint (base and catalyst)

1. 125 degrees F for 8 hours to cure P/S 890 B-2 sealant 1.

3.13 Training: The contractor shall provide a minimum of one (1) eight (8) hour day of training for operators and maintenance. Training shall cover all aspects of operation of the oven as well as troubleshooting and regular maintenance tasks.

3.14 Technical Manuals: Two (2) sets of printed technical manuals and one (1) digital set on CD-ROM shall be provided. The CD-ROM shall be delivered 30 days prior to delivery of the unit; the printed manuals shall ship with the unit. Documentation shall include at a minimum: wiring diagrams, operations, installation, maintenance, preventive maintenance, illustrated parts break down, recommended spare parts list, vendors literature, mechanical schematics, and electrical/electronic schematics. The technical manuals shall provide a best practice approach to the preventive maintenance actions. Tasks shall be clearly defined, include all special options and specify periodicity. All technical data furnished shall be written in the English language, and all measurements shall be notated in the SAE Standard. Technical manuals shall include a pre-operational checklist for all items that need to be checked or verified prior to operating the oven. In addition, the manuals shall include complete step-by-step instructions for both start-up and shutdown,

3.15 Calibration Procedures. A calibration procedure shall be provided for each component requiring calibration or verification. The calibration procedure shall be formatted in accordance with NAVAIR 17-35TR-04. An example calibration procedure will be provided by the Government at the request of the contractor. Government calibration personnel will advise the contractor in producing a suitable calibration procedure. A first draft calibration procedure shall be provided to the Government at the time of delivery. At the completion of installation, an initial calibration and verification shall be performed by the contractor with the inclusion and hands-on involvement of Government calibration personnel. During this initial calibration and verification, the Government shall provide comments and change recommendations related to the calibration procedure to the contractors. A final calibration procedure shall be provided within 14 day after completion of initial onsite calibration and start-up.

3.16 Warranty: The contractor shall warrant their equipment for a minimum period of one (1) years from date of Government acceptance of the system. Warranty shall include parts, travel expenses, and labor required for warranty repair.

4.0 Contractor Requirements:

4.1 Prior to installation of any equipment, the contractor shall lockout/tagout all energy sources in accordance with OSHA 29 CFR 1910 and then notify the Government for final approval. In addition, the Government may also choose to dual lockout/tagout the equipment. The contractor shall deliver the removed material and accessories to the Hazardous Material Berm (B4466), behind Building 133. The contractor shall give the Hazardous waste personnel at a minimum of 48 hours’ notice before moving the equipment to the Berm. No metal shall be removed from the FRC East; all metal shall be delivered to the FRC East Recycle Center, Building 4785.

4.2 The contractor shall connect the utilities to the new oven. If any of the utilities are not required for the new oven, the contractor shall appropriately cap off back to the source. Any materials, tools, and labor required for utility hook-up shall be the responsibility of the contractor (i.e. conduit, ductwork, electrical power disconnect, etc.).

4.3 All electrical work shall be completed by a contractor holding a current electrical contractor’s license issued by the North Carolina Board of Examiners of Electrical Contractors in accordance with the provisions and requirements of Chapter 87, Article 4 of The General Statutes of North Carolina. The contractor shall provide proof of license as part of their proposal. All work shall be completed in strict compliance with the articles and requirements of NFPA 70 and in strict compliance with the requirements set forth in the CFR 1910.331 through 1910.335 OSHA “Safety Related Work Practices”. All installed wiring shall be properly sized stranded copper wire. Each circuit shall have an equipment-grounding conductor installed. An installed conduit run shall not be considered to meet the requirement for an equipment grounding conductor. Each 120 or 277 volt circuit shall have a separate grounded conductor (neutral). No shared neutral conductors shall be permitted under any circumstances. All switches, receptacles and other wiring devices shall be commercial grade or better. The contractor shall contact the Facilities Infrastructure Planning & Engineering Branch, Code 6.3.1.3 after completion of work for inspection and approval.

4.4 Unless otherwise specified herein, or where the Government gives special approval, all resources (e.g. labor, material, tooling, and equipment) required and/or used during unloading, placing, and installation shall be provided by the contractor. All piping, interconnecting hoses, cables, disconnects, connectors, etc. shall be supplied and installed by the contractor. The contractor shall provide all personnel, tools, and equipment required for complete mechanical and electrical installation. The contractor shall not at any time borrow or use any of the Government’s tools or equipment. The contractor may use the air source, water, and electrical power for installation as required.

4.5 For any work requiring burning/welding/soldering, the contractor shall obtain a hot work permit from the Cherry Point Fire Department. The contractor shall provide the person’s name, company name, and contact number for the contractor performing the work. Cherry Point Fire Department contact is 252-466-2241.

4.6 The contractor shall obey all Federal, State, and Fleet Readiness Center East Safety Requirements. All contractors shall wear safety shoes when entering the FRC East and the required Personal Protection Equipment (PPE) for the task they are performing and the PPE required in the area they are working (i.e. safety glasses, hearing protection, etc.). At any time during the demolition or installation process there is exhaust emitting equipment or fork trucks (i.e. propane) being used the contractor must provide continuous Carbon Monoxide (CO) monitoring. The contractor shall clean the work area daily before leaving and properly store material and equipment.

4.7 Set-up and installation shall be clearly documented in the manuals (Section 5.6) as to the description of system installation procedures and all installation requirements. All installation hardware and special hardware shall be supplied with the system. All installation work shall occur during the Government’s normal daily work hours of 6:30 am and 3:00 pm Monday through Friday, except Federal holidays. The contractor shall coordinate the work to minimize impact on facilities production operations. The installation shall be complete within 10 calendar days after delivery of the equipment to the Government site.

4.8 The contractor shall be responsible for, and be required to make good at his own expense, all damages to any work or materials in place on the premises, or included in this contract, during the execution of this contract.

4.9 Contractor must provide the connection from the oven’s exhaust outlet to the existing ventilation stack located above drop ceiling in accordance with NFPA 91 - Standard for Exhaust Systems for Air Conveying of Vapors, Gases, Mists, and Particulate Solids (2015 Ed.). Any required modification to the ventilation stack i.e.: tools, supplies needed, and labor are to be the contractors responsibility.

4.10 Acceptance and Testing: The contractor shall perform a complete testing and quality check at their facility that includes a multi-point oven uniformity test. The contractor shall provide the uniformity test results with the oven. The contractor shall provide a copy of their standard test procedure and quality assurance checklist to the Government at least 30 calendar days prior to delivery of the equipment. The contractor shall furnish all instruments, test programs, materials and tools required to perform and evaluate these tests. The measuring instruments shall have evidence of calibration traceable to the National Institute of Standards and Technology (NIST). The test programs and computer printouts shall become the property of the Government. Within five (5) calendar days after installation of the oven at the FRC East the contractor’s standard tests shall be completed. The equipment shall be visually examined for design, construction, materials, components, electrical equipment, and workmanship to determine compliance with the requirements of this purchase description as well as to determine none of the components were damaged during shipment or installation. The contractor shall perform tests to insure that all safety features including fail-safe devices, interlock switches, etc. are installed and are functioning properly. All testing shall be conducted during normal work hours of 6:30 am to 3:00 pm, Monday through Friday and shall take no longer than a maximum of three (3) working days to complete. Failure of the oven to pass any test or inspection shall be cause of rejection.

4.11 Safety: This system shall comply with all applicable Occupational Safety and Health Standards per 29 CFR 1910. In addition, this system shall not exceed 85-dBA noise level in accordance with Hearing Conservation and Noise Abatement Chapter 18, OPNAVINST 5100.23.

4.12 Lockout / Tagout (LOTO): A single point disconnect for LOTO shall be provided for the system preventing all stored energy from release. The contractor shall provide a procedure to bleed off any residual energy per 29 CFR 1910.147. A LOTO procedure shall be included in the manuals for reference prior to repair or maintenance of the system.

4.13 Hazardous Material: Contractors shall comply with FRCEASTINST 5090.1, before introducing to, or removing any hazardous materials from the FRC East. The contractor shall submit all MSDS sheets prior to bringing any hazardous materials on site at the FRC East.

5.0 CONTRACTOR'S UNAUTHORIZED WORK PERFORMANCE. The Contractor shall not perform work that deviates from contract requirements and purchase description. If the Contractor deviates from contract requirements and purchase description without approval of the CONTRACT ADMINISTRATOR/CONTRACTING OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.

ADDENDUM TO FAR 52.212-1

1) SUBMISSION OF QUOTES.

a) The vendor is responsible for ensuring that quotes are received in the Contracting Office no later than 1:00 P.M. (EST) on 04 May 2020 as indicated on page one (1) of this solicitation. Failure of vendor’s quote to be received prior to the hour and date specified may result in rejection of the quote.

b) Quotes may be submitted electronically via e-mail to larry.davis1@usmc.mil.

c) RFQ Number M67001-20-Q-1067 must be clearly shown in the subject line.

2) INSTRUCTIONS FOR THE PREPARATION OF QUOTES AND SUBMISSION REQUIREMENTS:

The vendor shall submit the following as part of their quote:

a) Information to determine Technical Acceptability:

i) The vendor’s technical quote shall include:

1. Information that demonstrates how their quoted productmeets the requirements for each line item, including the required delivery schedule.

b) Price Quote Instructions: The vendor’s price quote shall include:

1. Quoted firm-fixed price for each line item shown. Vendor must include unit price and total amount for each line item. Vendor shall quote FOB Destination pricing.

c) Completed SF1449 to include:

1. Signed/completed page 1 (Blocks 17 and 30)

ii) Completed Representations and Certifications: The following representations and certifications must be completed and returned as part of the vendor’s quote

FAR 52.212-3 (Note that vendor is only required to complete paragraph (b) if they have not completed annual representations and certifications via the System for Award Management (SAM) website.)

2.0 COMMUNICATIONS

a) Except as specified in paragraph (b) below, no order, statement, or conduct of Government personnel who visit the contractor’s facilities or in any other manner communicate with contractor personnel during the performance of this contract shall constitute a change under the “Changes” clause of this contract.

b) The contractor shall not comply with any order, direction or request of Government personnel unless it is issued in writing and is signed by the Contracting Officer or is pursuant to specific authority otherwise included as a part of this contract.

c) A Contracting Officer for the Marine Corps Installations East (MCIEast) Contracting Office is the only person authorized to approve changes in any of the requirements of this contract and, notwithstanding, provisions contained elsewhere in this contract, the said authority remains solely the Contracting Officer’s. In the event the contractor effects any change at the direction of any person other than a designated Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made.

SPECIAL CONTRACT REQUIREMENT

1.0 CONTRACTOR ACCESS TO MARINE CORPS INSTALLATION AND THE FLEET READINESS CENTER EAST

1.1 Performance of this requirement requires access to Marine Corp Air Station (MCAS) Cherry Point and the Fleet Readiness Center (FRC) East. Contractor personnel shall follow all procedures for access to the Air Station in accordance with Air Station Order (ASO) 5560.6A, available at: http://www.cherrypoint.marines.mil/Portals/86/Docs/Cherrypointorders/5560.6A.pdf?ver=2016-03-29-110019-410 and FRC East Instruction 5000.1B, Enclosure 1, available at: http://www.navair.navy.mil/frce/sites/g/files/jejdrs421/files/2018-11/5000.1B%20JUNE%202017%20enc1.pdf Separate access requests are required for Base Access and FRC East access. Please note, due to the Real ID Act, some state driver’s licenses will not be accepted without a second form of identification, like a passport.

1.2 Marine Corps Installations transition to new access control system

Marine Corps Installations across the region are transitioning to a new government-owned access control system called Defense Biometric Identification System (DBIDS). This new and enhanced system will replace RAPIDGate and MCESS for contractors and other non-DoD-affiliated personnel requiring installation access. DBIDS is already installed at more than 320 sites with over 5 million registered personnel and unlike previous systems, this one is a free service.

Current RAPIDGate or MCESS credentials can easily be switched out for a DBIDS credential and new contractors can apply for a DBIDS credential using the same vetting requirements as previously required. RAPIDGate/MCESS credentials will be honored until December 31, 2018. After this date, all contractors will be required to have a DBIDS credential in order to access MCAS Cherry Point. In order to reduce wait time when exchanging your RAPIDGate/MCESS credential, it is highly recommended each applicant pre-register at https://dbids-global.dmdc.mil/enroll#!/.

Here’s what you need to know:

CURRENT DOD ID CARD HOLDERS

· If you currently hold a valid Common Access Card (CAC), dependent ID card, reserve ID card, or retiree ID card, issued by the Defense Enrollment Eligibility Reporting System (DEERS), no further action is required.

· You will be automatically enrolled in DBIDS when your ID card is initially scanned at the gate. Expect a one-time delay of 3-6 seconds as the DBIDS system initially registers your information.

CURRENT CONTRACTORS

· DBIDS credentials will be issued beginning September 24, 2018

· DBIDS credentials will be valid for the duration of your contract, not to exceed five years; however, re-vetting of individuals’ information will occur each year.

· Contractors can exchange their current RAPIDGate/MCESS credential for a DBIDS credential without re-vetting, however they will be required to bring the following items:

- Current RAPIDGate/MCESS credential

- Second form of government-issued identification (driver license, passport, etc.)

- Company Contract/Letter of Authorization

· New DBIDS credentials will be valid for the remainder of the contract (not to exceed 5 years), but individuals will be re-vetted each year.

· All contractors (MCAS Cherry Point) will be able to exchange their current RAPIDGate/MCESS credential at the MCAS Cherry Point Contractor Vetting Office, Building 251 (Pass and ID).

NOTE: Flight line access will still be granted at Physical Security using the procedures already in place.

NEW CONTRACTORS

· DBIDS credentials will be issued beginning September 24, 2018

· New contractors requiring access for over 60 days will receive a credential valid for up to one year.

· New contractors requiring access for less than 60 days will receive a temporary paper pass.

REMINDER: Beginning October 1, 2018, all personnel in possession of a RAPIDGate/MCESS credential will also be required to provide a second valid U.S. government form of identification. Beginning September 24, 2018, DBIDS credentials will be issued or exchanged in place of a RAPIDGate/MCESS credential. 1.4 Additional information regarding access to the Air Station is available by phone at 252-466-5921. Failure to submit the proper visit request information may result in denial of access to the facility.

1.5 The MCAS Cherry Point main gate is located off NC State Highway 101, Havelock, NC. Visitors without proper vehicle identification are required to check-in at the visitor’s center adjacent to the main gate.

1.6 Contractors are required to wear personal protective equipment (PPE) consisting of hearing protection, eye protection, and safety shoes. PPE will not be provided by the facility. Contractor representatives without the appropriate PPE will not be allowed access to the facility.

2.0 IDENTIFICATION OF CONTRACTOR PERSONNEL

Contractor personnel shall identify themselves as contractor personnel by introducing themselves or when being introduced. Contractor personnel shall display distinguishing badges or other visible identification for meeting with Government personnel. Contractor personnel shall appropriately identify themselves as contractor employees in telephone conversations and in formal and informal written correspondence.

3.0 WORK PERFORMED ON MARINE CORP INSTALLATIONS

3.1 The worked described herein shall be performed at the Fleet Readiness Center (FRC) East, Bldg. 133, MCAS Cherry Point, NC and shall be performed during the FRC East’s normal working hours, Monday through Friday 0630 to 1500, unless otherwise requested by the contractor and approved in advance by the Government.

3.2 During the course of contract performance the contractor, as a resident of the installation and facility, shall adhere to all rules and regulations in effect at Marine Corps Air Station Cherry Point and the FRC East. Contractors are required to comply with all Federal and North Carolina State Environmental, Security, and Safety Compliance requirements along with other command policies as stated in the FRC East Information Brochure (FRCE Instruction 5000.1B, Enclosure 1 – see para. 1.1 above for website).

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019)

The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications--Commercial Items.

(a) Definitions. As used in this provision--

Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Contractors are not prohibited from providing--

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(d) Representation. The Offeror represents that it [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.

(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will'' provide covered telecommunications equipment or services”, the Offeror shall provide the following information as part of the offer-

(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number; and item description, as applicable);

(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;

(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and

(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2019)

(a) Definitions. As used in this clause--

Covered foreign country means The People's Republic of China.

Covered telecommunications equipment or services means--

(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or

(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means--

(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;

(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled--

(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or

(ii) For reasons relating to regional stability or surreptitious listening;

(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);

(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);

(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or

(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).

Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in Federal Acquisition Regulation 4.2104.

(c) Exceptions. This clause does not prohibit contractors from providing--

(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(d) Reporting requirement.

(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.

(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause:

(i) Within one business day from the date of such identification or notification: The contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.

(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i) of this clause: Any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services, and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.

(e) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (e), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) – TAILORED

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The award will be made using the best value process. For this reason, the final award decision may be made to other than lowest priced or highest technically rated quote. To determine the best value a comparative assessment of the quoter’s price, technical ability, past performance, and other evaluation factors identified elsewhere in this solicitation will be conducted. This comparative analysis will also consist of the relative importance of the evaluation factors, which when combined are:

Significantly more important than cost or price. As other evaluation factors become more equal, the evaluated cost or price becomes more important;

The final award decision may involve a trade-off among cost or price and other non-price factors. Factors that may be considered in the trade-off process include, but are not limited to:

· Item Criticality

· Weapons System Application

· Historical Delivery

· Quality Problems

· Concerns over limited sources and industrial base

· Benefits from obtaining new sources

Price. Evaluation of Price will be done on a comparative basis without examining the specific cost elements of the quoter’s price. However, if necessary the Contracting Officer may use alternate price analysis or cost analysis techniques to assist in making a determination that the quoted prices are fair and reasonable.

Technical. The quoter’s technical information will be evaluated based on the information provided by the quoter in accordance with the Addendum to FAR 52.212-1 and to the extent to which the proposed individual demonstrates the ability to provide the product or perform the services in accordance with the of this solicitation.

Past Performance. Past performance on other contracts, both private and government may be evaluated based on information provided by the quoter in accordance with the Addendum to FAR 52.212-1. The government may use past performance information from sources other than those listed in the submitted references, to include the Contract Performance Assessment Reporting System (CPARS), the Supplier Performance Risk System (SPRS), prior dealings with this contracting office and personal knowledge of quoter’s performance from individuals taking part in the procurement process. In addition, the government reserves the right to evaluate the past performance using any acceptable method set forth at FAR 13.106-2(b).

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (MAR 2020) ALTERNATE I (OCT 2014)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision-- “Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13…
