J&A No. MCIEAST 1909
JUSTIFICATION AND APPROVAL (J&A)
FOR USE OF BRAND NAME OR EQUAL DESCRIPTIONS, OR PROPRIETARY SPECIFICATIONS AND STANDARDS, IN SOLICITATIONS
1. Contracting Activity.
Contracting Department Marine Corps Installations East 1116 Birch Street Camp Lejeune, NC 28547
2. Description of the Action Being Approved.
Inclusion of brand name or equal item descriptions in Request For Quotation M67001-19-Q-0025 for dormitory and barracks enlisted quarters type furniture.
3. Description of the Supplies/Services.
The following items to be procured on a brand-name or equal item description are:
Refrigerator/Freezer/Microwave Combination Units
Current year, fiscal year 2019, Operation & Maintenance/Marine Corps (O&MMC) funds will be utilized to fund this procurement.
The estimated delivery date for this procurement is 60 days after date of contract.
4. Statutory Authority Permitting Other Than Full and Open Competition.
N/A. Full and Open Competition will be utilized. This document meets the regulatory requirement at DFARS 213.501(a)(ii) to execute the justification and approval addressed at FAR 13.501(a) in order to use brand name or equal descriptions. FAR Subpart 13.5 procedures are being utilized for this acquisition in accordance with 41 U.S.C. 1901.
5. Rationale Justifying Use of Cited Statutory Authority.
Governing regulatory guidance (Unified Facilities Criteria (UFC), Interior Design, UFC 3-120-10) and MCO11000.22 CH1v.2 , Bachelor Family Housing Management directs developing interior design requirements or Furniture, Fixtures, and Equipment (FF&E) be integrated with a facility's Structural Interior Design (SID).
All provided specifications coordinate with NAVFAC and ROICC's SID/paint schemes. The required Whole Room Concept includes individual whole-room packaging to accommodate high-volume installation. These items are being procured through DON's mandatory NAVY BPA suite for furniture.
Market research has not identified a fully competitive market that can provide a complete WRC that meets all requirements (i.e., specs, design, packaging).
Through an Integrated Product Team approach, multiple stakeholders to include but not limited to NAVFAC Interior Designers (ID), other departments, Marines, and manufacturers provide recommendations into to design of projects. Regular evaluation of prior projects, best practices, interior design improvements, end-user comments, etc. are employed and are assisting our efforts to not only narrow the gap between Milcon and FSRM projects interior designs but also move us towards more coordinated and standardized inventory packages for the BEQs. The modest standardized packages contribute to reduced number of manufacturers for like items, support interchangeability of parts where applicable, and minimize the number of warranty procedures this office must manage, etc. within fiscal, regulatory, and administrative constraints.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The Department of the Navy mandates the use of the Furniture Blanket Purchase Agreement (BPA) for all furniture requirements. The Base Property Division is requesting the removal, disposal and installation of the Refrigerator/Freezer/Microwave combination appliances in the specified barracks. Currently a SIN is not available on the Navy BPA for the procurement of appliances. The removal and disposal service is not available on GSA Advantage. Therefore this procurement will be solicited via open market on the Federal Business Opportunities website.
In accordance with FAR Part 10, market research was conducted using the following three methods: Furniture BPA screening of available vendors, SAM.gov, and a review of GSA FSS. Market research revealed several vendors who are capable of satisfying the requirement.
7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, the activity has no plans at this time to eliminate the use of brand name or equal descriptions from future solicitations for the types of supplies/services covered by this document; however, this will be reassessed during follow-on acquisition planning.
