INTRODUCTION

This acquisition will be conducted in accordance with FAR Subpart 13.5.

The United States Marine Corps MCIEast Contracting Department intends to procure Firefighting Protective

Ensemble. M6700117Q0051 is issued as a Request for Quotation (RFQ) to provide firefighting protective gear to

MCAS Bueafort, SC.

The RFQ documents and incorporates provisions and clauses that are in effect through Federal Acquisition Circular

FAC 2005-95, Effective 19 Jan 2017 and DFARS Change Notice DPN 20161222, effective 22 Dec 2016.

This solicitation is 100% Small Business Set a Side. The associated North American Industrial Classification

System (NAICS) code for this requirement is 339113 and the small business size standard is 750 employees.

The provision at 52.212-1, Instructions to Offerors – Commercial Items applies to this acquisition.

The technical quote is to be submitted with vendor’s identifying information ONLY on the cover page of the technical quote. Failure to follow this instruction may result in rejection of the quote.

OPERATIONAL ATTRIBUTES

Operational Attributes for the Expeditionary Firefighting and Rescue/Aircraft Rescue Firefighting

Structural Fire Fighting Protective Ensemble Set

1. The Marine Corps Expeditionary Firefighting and Rescue structural firefighting protective ensemble shall meet the standards set forth by NFPA 1971, Standard on Protective Ensembles for Structural Fire Fighting and

Proximity Fire Fighting (Latest Edition) and all other standards stated within NFPA 1971 (Threshold = Objective).

Rationale: The structural firefighting ensemble must meet NFPA 1971 and all applicable standards to enable mission accomplishment and protect our Marine Corps Firefighters.

The following are additional design requirements that supersede or limit NFPA 1971standards for Marine Corps

Expeditionary Firefighting and Rescue/Aircraft Rescue Fire Fighting based on mission profile:

2. NFPA 19716.1.2.1states: Shall be permitted as a single layer or multiple layer configurations.

MC requirement: Multiple layer structural firefighting protective ensemble garments shall be permitted with inspectlon ports large enough to invert the liner for inspection.

Rationale: Multiple layers will allow forreplacement of individual layers instead of replacing a complete ensemble and will make cleaning and inspecting easier for the unit.

3. NFPA 19716.1.5.1states: Such closure systems shall be secured with positive locking fasteners including, but not limited to, hooks and dees or zippers.

MC requirement: Hooks and Dees are not authorized.

Rationale: Hooks and Dees have a history of failing advance inspections. Hooks and Dee fasteners tear away from the outer shell.

4. NFPA 19716.1.9.2 states: Each coat sleeve shall have a protective wristlets or other interface component permanently attached to the coat sleeve.

MC requirement: Only wristlets are authorized.

Rationale: For ease of donning gear wristlets provide the most rapid and effective option.

5. NFPA 19716.1.9.3.3 states: Where a hood is permanently attached to the coat, a collar shall not be required.

MC requirements: Permanently attached hoods are not authorized.

Rationale: Permanently attached hoods are more susceptible todamage, both the hood itself and the point of attachment.

6. NFPA 19716.1.12 states: When life safety harnesses, escape belts, and ladder belts penetrate the outer shell, are incorporated as part of a garment closure system, or are temporarily or permanently attached to the garment, the harness or belt components shall meet the applicable requirements of NFPA 1983, Standard on

Life Safety Rope and Equipment for Emergency Services, and the optional requirements for flame resistant life safety harnesses or optional requirements for flame resistant belts.

Rationale: Technical Rescue Is currently not a defined mission of EFR.

7. NFPA 19716.2.2.1 states: Trlm shall be at least 76 mm (3 in.) wide and shall have both retroreflective and fluorescent surfaces.

MC requirements: The Marine Corps requirement shall be a minimum of 3 in wide and shall have both retroreflective and fluorescent surfaces.

Rationale: Due to possible deployed operations and for uniformity retroreflective and fluorescent surfaces should not exceed the Marine Corps requirements.

8. NFPA 19716.2.2.2 states: The retroreflective surface of trim shall be at least 16 mm (5.18 in.) wide.

MC requirements: The Marine Corps requirement is 22 mm (7/8) wide.

Rationale: Due to possible deployed operations and for uniformity retroreflectivesurface should not exceed the Marine Corps requirements.

9. NFPA 19716.2.2.3 states: Trim used to meet the minimum trim pattern requirements shall have a minimum fluorescent surface of 50 mm2/linear mm (2 in.2/llnear in.} of trim.

MC requirements: The Marine Corps requirement is 75 mm2/linear mm (3 in.3/tinear in.) of trim.

Rationale: Due to possible deployed operations and for uniformity retroreflective surface should not exceed the Marine Corps requirements.

10. NFPA 19716.2.3.3 states: Where a staggered pattern is used in the lower circumferentialtrim band, the lower edge of the upper trim piece shall not be higher than the upper edge of the lower trim piece.

MC requirements: Staggered pattern is not authorized.

Rationale: Due to possible deployed operations and uniformity staggered trim pattern will not be used.

11. NFPA 19716.2.3.4 states: The back of the coat shall also have a minimum of either two vertical stripes of trim, perpendicular to the bottom band and with one strip located on both the left and right sides of the back of the coat, or a minimum of one horizontal band of trim at thechest/shoulder blade level located within 75 mm (3 in.) above or below the sleeve-to-body underarm garment seam.

MC requirements: Only the one horizontal band of trim is authorized.

Rationale: Due to possible deployed operations and uniformity only the horizontal band will be used.

12. NFPA 19716.4.5.2 states: The helmet with theface shield or the face shield/goggle component deployed shall be positioned in accordance with the HPI as described in 8.1.14 on a facial feature head form as defined in 3.3.43.

Where the crown clearance of the helmet is adjustable, the helmet shall be mounted with the least amount of clearance.

MC requirements: Helmet with the face shield is authorized.

Rationale: Due to uniformity only the helmet with the face shield will be authorized.

13. NFPA 19716.4.7 states: Where helmets are provided withan SCBA face piece that is attached or integrated with the helmet, the helmet with the SCBA face piece Installed shall meet all applicable design and performance requirements of this standard.

MC requirements: Helmet with SCBA face piece attached or integrated with the helmet is not authorized.

Rational: Helmet shall be available for use during operations in which SCBA is not required.

14. NFPA 19716.5.2 states: Helmets shall consist of at least all of the following assembled components:

(1) Shell

(2) Energy absorbing system

(3) Retention system

(4) Fluorescent and retroreflective trim

(S) Ear covers

(6) A face shield or goggles, or both

MC requirements: Additional assembled components are authorized.

Rationale: Units can add additional assembled components such as flashlight holders as needed to increase operational success and mitigate hazardous conditions.

15. NFPA 19716.5.2.2 states: Where the goggle component is selected in accordance with 6.5.2(6), the goggles shall be permitted to be unattached, not assembled, to the helmet.

MC requirements: Goggle component are not authorized.

Rationale: Due to uniformity goggles are not authorized.

16. NFPA 19716.5.4 states: Helmet ear covers or the portion of the helmet providing the coverage of the ears, when deployed, shall provide at least the following coverage:

(1) 95 mm (33/4 in.) measured 50 mm {2 in.} forward of the coronal plane

(2) 120 mm (43/4 in.) measured 25 mm {1 in.) forward of the coronal plane

(3) 130 mm (51/8 in.) measured at the coronal plane

(4) 130 mm (51/8 in.) measured at the midsagittal plane at the rear of the headform

MC requirements: The Marine Corps requirement will be (1) 95 mm (33/4 in.) measured 50 mm (2 in.) forward of the coronal plane.

Rationale: The greatest protection is required due to probability of aircraft fire/rescue operations.

17. NFPA 19716.7.2.3 states: Where a glove is made up of multiple layers, all layers of the glove shall be individually graded per size.

MC requirements: Multiple layer gloves are not authorized.

Rationale: Increases the time to don PPE and potential of not wearing PPE properly.

The following are other requirements not stated in the NFPA 1971. These requirements will ensure uniformity of equipment within the Marine Corps units.

1. Color of garment: The color shall be tan.

2. Thread: The thread shall be the same color as the garment.

3. Pockets: All pocket closures shall be made either with hook and loop fastener tape a minimum of 1.5 inches

(3.8 cm) wide, witha flap, or with snaps.

One (1) pocket shall be provided and double stitched to the bottom of each front body panel where it can be fully utilized when used with an SCBA. The 2-inch expansion pocket shall measure no less than 8- inch wide by

8-inch high or greater than 10-inch wide by 10-inch high.

A portable radio pocket option shall be provided for either the left or right chest. The 2.5-inches deep pocket shall measure approximately 3.5-inches wide by 8-lnches high and double stitched to the outer shell with one drainage grommet in the bottom of the pocket. The flap shall be two layers of outer shell material %-Inch wider than the pocket width and notched on each side to accommodate a radio antenna from either side. Flap length shall measure 6-lnches in length and secure by means of non-flammable and fire resistant hook and loop fastener tape. Flap hook and loop tape shall be 3-inches in length to facilitate adjustable closure. The pocket shall be lined with impervious barrier material and placed between the two layers of outer shell material in the pocket flap.

4. Suspenders. Only suspenders are authorized.

5. Fluorescent color: Slime green with silver in the middle.

6. Helmet color: White helmet is authorized for EFR Chiefs (OIC/SNCOIC/Material Chief/Training Chief); Red helmet is authorized for Station Captains (Section Leader and Assistance Section Leader); Yellow helmet is authorized for allother EFR Personnel.

7. Helmet lettering (optional): If helmet lettering is utilized it shall be white background with black writing, 1 inch letter, curved. As you wear it: left side will display "Unit", right side with have either "EFR or ARFF".

8. Garment patches and lettering: no patches are authorized. Option for Velcro name tape on lower back of coat Is authorized. Letters must be 3 in (2 in or smaller for longer names), reflecting and retroflective slime green color.

9. Face shield: Option to purchase gold shield or clear depending on mission profile.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) “TAILORED”

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

This requirement contains Brand Name, or Equal CLINs. Proposals will only be acceptable if quotes are provided for the brand name, or equal brands meeting the quality and specifications of the brand name, identified in those

CLINs.

Partial offers will be accepted from offerors.

This requirement is 100% set-aside for small businesses. All responsible small businesses may submit a response which, if timely received, will be considered by the Agency.

This procurement is subject to the Buy American Act. If the product you are quoting on is not American made, you must identify the country in which it is made.

A vendor’s quote must be written in a logical, practical, clear, concise and logically assembled manner, containing all pertinent information in sufficient detail to provide the evaluators with a clear understanding of the vendor’s approach and to permit evaluation of the proposed program. It is the responsibility of the vendor to present enough information to allow the various work efforts, support, and management approaches to be meaningfully evaluated without discussions.

The vendor’s initial quote should contain the vendor’s best terms from a price and technical standpoint. However, the Government reserves the right to have discussions with vendors if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotations if such action is in the public interest; accept other than the lowest quotation; and waive informalities and minor irregularities in quotations received. A quote must be internally consistent or the quote will be considered unrealistic and may be considered unacceptable. Evaluation of the technical approach will be based upon the extent to which the vendor thoroughly and accurately describes the overall technical solution.

The Government will issue a Purchase Order for this requirement. To be eligible for award all items quoted for this requirement will be most advantageous to the Government, price and other factors considered. Quotes will be evaluated in an efficient and minimally burdensome fashion. The Contracting Officer reserves the right to evaluate quotes without the use of formal evaluation procedures such as establishing a competitive range, conducting discussions, scoring quotations, and to make an award to other than the lowest quote.

Evaluation Factors: The following factors shall be used in the evaluation of quotes:

1. Technical Capability with two sub-factors

2. Past Performance

3. Price

1) Technical Capability: defined as the following:

(a.) Sub-Factor 1: Brand Name, or Equal. The vendor’s quote shall provide the Brand Name, or Equal items listed in the Technical Specifications and CLINs. Shall include a statement that the vendor “understands and will comply with all requirements set forth in the Technical Specifications”. Shall provide a detailed response that clearly demonstrates how the proposed product meets or exceeds the minimum requirements to each Technical

Specifications.

(b.) Sub-Factor 2: Timeless of Delivery: The Government desires 30 days ARO. Vendor shall clearly state if the quoter can meet the desired delivery of 30 days ARO or better. If not then vendor shall state delivery date.

The Technical Capability will be evaluated based upon the extent to which the vendor concisely and accurately describes the technical solution to providing all items listed in the solicitation,

2) Past Performance: defined as the following: For past performance, the vendor shall submit the attached Past

Performance Questionnaire, as part of its quote, information on previously performed contracts or on-going contracts that are similar to the item descriptions in the solicitation performed for Federal, State or local

Governments, and for commercial firms. Information shall be provided on either 1) all such contracts within the past three years, or 2) the last three such contracts performed, and shall be limited to the name and address of the organization for which the services were performed, a brief description of the services performed, and the phone number and/or email of a contact for each contract listed. The information may also include a description of any quality awards earned by the vendor. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Vendors lacking relevant past performance history will not be evaluated favorably or unfavorably on past performance and will receive a neutral rating. The vendor should provide the information requested above for past performance evaluation, or affirmatively state that it possesses no relevant directly related or similar past performance. The

Government may give greater consideration to the contracts that the Government feels are most relevant to the RFQ.

3) Price: defined as the following:

In evaluating the price portion of the proposals, the Government will evaluate the Offeror’s proposed price for completeness and reasonableness.

Tradeoff process shall be the basis of Award: To evaluate price, quotes will be evaluated using a price/technical tradeoff. This process is appropriate because it is in the Government’s best interest to consider award for the best value. In evaluating the technical portion of the quote, the technical evaluators will evaluate the following factors and subfactors as described in the ―Basis of Award of the RFQ. The factors of Technical Capability and Past

Performance are weighted equally. All technical subfactors are weighted equally. All evaluation factors other than price, when combined, are approximately equal to the price factor. Proposal information provided for one factor may be used to assess other factors if the Government deems it appropriate. Failure to address part or parts of the technical factor caused by a lack of information may be assessed as a significant weakness or multiple significant weaknesses.

The quote must include four sections as follows:

Introduction of company shall not contain company identifying information on any page except the cover page.

Section 1: Introduction of company

Section 2: Technical (demonstration of the capability to perform all the requirements in this RFQ and Technical

Specifications as described above).

Section 3: Past Performance (See Attachment for Past Performance Questionnaire)

Section 4: Price: In evaluating the price portion of the proposals, the Government will evaluate the Offeror’s proposed price for completeness and reasonableness.

The Vendor’s quote shall be provided on each line item of the solicitation.

Vendor’s quote shall include an active Cage Code and Federal Tax Identification number in the cover page only.

Vendors are required to be registered with SAM database and have an active cage code at the time of award.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JAN 2017)

ALTERNATE I (OCT 2014)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(a) Definitions. As used in this provision--

“Administrative merits determination” means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to https://www.sam.gov/portal appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

“Arbitral award or decision” means an arbitrator or arbitral panel determination that a labor law violation occurred, or that enjoined or restrained a violation of labor law. It includes an award or decision that is not final or is subject to being confirmed, modified, or vacated by a court, and includes an award or decision resulting from private or confidential proceedings. To determine whether a particular award or decision is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

“Civil judgment” means--

(1) In paragraph (h) of this provision: A judgment or finding of a civil offense by any court of competent jurisdiction.

(2) In paragraph (s) of this provision: Any judgment or order entered by any Federal or State court in which the court determined that a labor law violation occurred, or enjoined or restrained a violation of labor law. It includes a judgment or order that is not final or is subject to appeal. To determine whether a particular judgment or order is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

“DOL Guidance” means the Department of Labor (DOL) Guidance entitled: ``Guidance for Executive Order 13673, `Fair Pay and Safe Workplaces' ''. The DOL Guidance, dated August 25, 2016, can be obtained from www.dol.gov/fairpayandsafeworkplaces.

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Enforcement agency” means any agency granted authority to enforce the Federal labor laws. It includes the enforcement components of DOL (Wage and Hour Division, Office of Federal Contract Compliance Programs, and

Occupational Safety and Health Administration), the Equal Employment Opportunity Commission, the occupational

Safety and Health Review Commission, and the National Labor Relations Board. It also means a State agency designated to administer an OSHA-approved State Plan, but only to the extent that the State agency is acting in its capacity as administrator of such plan. It does not include other Federal agencies which, in their capacity as contracting agencies, conduct investigations of potential labor law violations. The enforcement agencies associated with each labor law under E.O. 13673 are--

(1) Department of Labor Wage and Hour Division (WHD) for--

(i) The Fair Labor Standards Act;

(ii) The Migrant and Seasonal Agricultural Worker Protection Act;

(iii) 40 U.S.C. chapter 31, subchapter IV, formerly known as the Davis-Bacon Act;

(iv) 41 U.S.C. chapter 67, formerly known as the Service Contract Act;

(v) The Family and Medical Leave Act; and

(vi) E.O. 13658 of February 12, 2014 (Establishing a Minimum Wage for Contractors);

(2) Department of Labor Occupational Safety and Health Administration (OSHA) for--

(ii) OSHA-approved State Plans;

(3) Department of Labor Office of Federal Contract Compliance Programs (OFCCP) for--

“Forced or indentured child labor” means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

“Labor compliance agreement” means an agreement entered into between a contractor or subcontractor and an enforcement agency to address appropriate remedial measures, compliance assistance, steps to resolve issues to increase compliance with the labor laws, or other related matters.

“Labor laws” means the following labor laws and E.O.s:

(1) The Fair Labor Standards Act.

(2) The Occupational Safety and Health Act (OSHA) of 1970.

(3) The Migrant and Seasonal Agricultural Worker Protection Act.

(4) The National Labor Relations Act.

“Labor law decision” means an administrative merits determination, arbitral award or decision, or civil judgment, which resulted from a violation of one or more of the laws listed in the definition of ``labor laws''.

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act

(50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

“Veteran-owned small business concern” means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

“Women-owned small business concern” means a small business concern --

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least
