STATEMENT OF WORK

1. BACKGROUND

This PR is to obtain materials required to construct test pads for the F35 Joint Strike Fighter aboard MCALF Bouge.

Delivery of materials will be required to begin no later than 1 August 2017, in order to allow the Intermediate

Testing Force (ITF) sufficient testing days prior to SDD contract termination.

2. SCOPE OF WORK

2.1 REQUIREMENT

Contractor shall provide the materials as indicated in schedule in 2.2.4. Contractor shall perform per all specifications and contract requirements.

2.2 CONTRACTOR SPECIFICATIONS

Contractor Shall:

2.2.1 Arrange Pre-Installation meeting(s) with points of contacts (POC) listed below within (3) business days of contractor award. Purpose of this meeting is to coordinate both conduct of and delivery/installation schedules to include finalizing delivery location and method of materials. Government POCs are as follows:

2.2.2 DELIVERY

Delivery shall be coordinated with the above listed POC (Government) representative. REQUEST DELIVERY

NOTIFICATION A MINIMUM OF ONE WEEK PRIOR TO DELIVERY/INSTALLATION. The successful offer or shall provide a Project Manager available for telephonic and/or onsite coordination throughout the entire project. The Project Manager shall have authority to represent the company to coordinate all services and issues.

All work will be conducted during the normal operating hours listed above.

Note 1: All materials must be delivered to designated drop points and will be spread dumped.

CONTRACTOR'S UNAUTHORIZED WORK PERFORMANCE. The Contractor shall not Perform work that deviates from contract requirements and specifications. If the Contractor deviates from contract requirements and specifications without approval of the CONTRACT ADMINISTRATOR/OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.

BASE ACCESS

Access Control specifications to be incorporated in solicitations and contracts:

1. In order to gain access to Marine Corps Base (MCB), Camp Lejeune and/or Marine Corps Air Station (MCAS), New River, non-Federal Government and non-DoD issued ID cardholders require identity proofing and vetting to determine fitness and eligibility for access. Specifically, a check of records through the National Crime

Information Center (NCIC) Interstate Identification Index (III) is the installation’s minimum background check for access to MCB, Camp Lejeune and/or MCAS, New River for non-Common Access Card holders, to include entrance of visitors.

2. MCB, Camp Lejeune and MCAS, New River applies the following non-Federal Government cardholder criteria to determine the authorized type of access control credentials:

a. Contractors: RAPIDGate or 30-Day Pass followed by 4-DayPass*

b. Sub-Contractors: RAPIDGate or 30-Day Pass followed by 4-Day Pass*

c. Vendors: RAPIDGate or 30-Day Pass followed by 4-Day Pass*

d. Suppliers: RAPIDGate or 30-Day Pass followed by 4-Day Pass*

e. Service Providers: RAPIDGate or 30-Day Pass followed by 4-Day Pass*

f. Delivery Personnel: RAPIDGate or 30-Day Pass followed by 4-Day Pass*

A. Public-Private Venture (PPV) Housing and Installation Volunteers: Local Population Credential (The following are examples of Installation Volunteers: (Red Cross, Community College Instructors and Students, Commissary Baggers, Naval Hospital Volunteers, Family Readiness Volunteers, Wounded Warrior Volunteers, and any other organization approved by the Commanding General, Marine Corps Installation East-Marine Corps Base

4-Day pass* or enroll in the RAPIDGate Program. RAPIDGate is a voluntary program due to associated costs. The Government will not be responsible for any access delays. Delays that may result from inadequate planning are contractor responsibility. Any and all costs associated with RAPIDGate are the sole responsibility of the contractor.

* Contractors will be issued a one-time pass for 30 days. Upon expiration of the 30 day pass, they will only be issued a 4 day pass every 4 days thereafter, for the duration of the contract.

52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014) (TAILORED)

Contracting Department, Marine Corps Installations East-Marine Corps Base, Camp Lejeune, NC Request For

Quotation (RFQ) M67001-17-Q-0038 is being issued to procure constructions supplies to build a runway. This procurement is conducted in accordance with FAR Part 12 (Acquisition of Commercial Items) utilizing Simplified

Acquisition Procedures (FAR Part 13.5).

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

This procurement is for runway construction supplies to include sand, gravel, and crushed stone. The proposed acquisition is reserved 100% for Small Business Set Aside.

The associated NAICS Code for this procurement is 212321. The industry description for this NAICS code is

Construction Sand and Gravel Mining. The size standard is 500 employees. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95, effective 19 January 2017 and DFARS Change

Notice (DCN) 20161222 effective 22 December 2016.

BASIS FOR AWARD: Award will be made to the Lowest Price Technically Acceptable quote with relevant satisfactory past performance.

EVALUATION. The Government intends to make a single Firm Fixed Price award to satisfy this requirement on an “all or none” basis. Award will be made on the initial evaluation of quotes received in response to this RFQ.

Therefore, quoters are cautioned to ensure that initial quotes contain your best terms from a technical and price standpoint. The following factors will be used to evaluate quotes:

TECHNICAL: Evaluated in accordance with solicitation requirements to meet or exceed salient characteristics.

DELIVERY: Your quote must clearly state the ability to meet the Government’s required delivery date of 1 August

2017 and CLIN delivery schedule annotated in the Statement of Work.

PRICE: All quotes must be the Contractor’s Best Pricing.

PAST PERFORMANCE: Quoter shall submit "Past Performance Information." Information provided in the quote shall include similar contracts with Federal, State and local governments, as well as commercial businesses. Similar contracts are defined as those similar in scope, magnitude, and complexity to this procurement.

The Government will evaluate the quoter's, and (if applicable) its principal subcontractors' demonstrated past performance within the last three (3) years in delivering quality products/services and in meeting requirements on similar programs. The currency and relevance of the information, source of the information, context of the data, and general trends in contractor's performance, quality, service, schedule and customer satisfaction will be considered.

The degree to which the quoter can demonstrate that it has successfully applied continuous systematic improvement to resolve past performance problems will be evaluated. Problems not addressed by the quoter will be considered to still exist.

References other than those identified by the quoter may be contacted by the Government and used in evaluating the quoter's past performance. Past performance is an indicator of how current and/or previous customers assess contractor performance under a specific contract performed for them and address the full range of all functions required to make any contractual relationship work. Successful past performance indicates that a contractor understands and has the resources to successfully execute a contract; however, it does not necessarily mean a contractor has the resources and skills necessary to perform the specific work requirements of this solicitation.

In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available, the quoter may not be evaluated favorably or unfavorably on past performance. Quoters without a record of relevant past performance will receive a neutral rating.

Submission Requirements for Contractor Past Performance Reference Form. Quoters shall furnish with their quotation no more than three (3) past performance references for contracts which required the same or similar type services using the format shown in Section J, Attachment #1, entitled Contractor Past Performance Reference Form.

Quoters shall provide all the information designated for the Contractor Past Performance References on the form provided for contracts which have been completed or terminated within the last 3 years. A Past Performance

Questionnaire Form will be sent to each referenced agency. Make sure your reference information is up to date. Do not give the name of references unless you have made sure that the individual can be reached at the referenced telephone number, e-mail address, and postal address that you have provided.

The Government intends to evaluate quotes and award a contract without discussions with vendors. Vendors should not expect requests for clarification or additional information from the Government. Therefore, the vendor's initial quote should contain the vendor's best terms from a price and technical standpoint. However, the Government reserves the right to conduct clarification and/or discussions with vendors if later determined by the Contracting

Officer to be necessary and in the best interest to the Government. The Government may reject any or all quotes if such action is in the public interest and may waive informalities and minor irregularities in quotes received.

SAM. Offeorors must be registered in the System for Award Management (SAM) database. Information in SAM shall be current, if not; completion of the attached FAR provision 52.212-3 Certifications and Representations is required with quotation. Information on registering in SAM may be obtained from www.sam.gov or calling 866-

606-8220.

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal. (a) Definitions. As used in this provision --

“Administrative merits determination” means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

“Arbitral award or decision” means an arbitrator or arbitral panel determination that a labor law violation occurred, or that enjoined or restrained a violation of labor law. It includes an award or decision that is not final or is subject to being confirmed, modified, or vacated by a court, and includes an award or decision resulting from private or confidential proceedings. To determine whether a particular award or decision is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

“Civil judgment” means—

(1) In paragraph (h) of this provision: A judgment or finding of a civil offense by any court of competent jurisdiction.

(2) In paragraph (s) of this provision: Any judgment or order entered by any Federal or State court in which the court determined that a labor law violation occurred, or enjoined or restrained a violation of labor law. It includes a judgment or order that is not final or is subject to appeal. To determine whether a particular judgment or order is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

“DOL Guidance” means the Department of Labor (DOL) Guidance entitled: ``Guidance for Executive Order 13673, `Fair Pay and Safe Workplaces' ''. The DOL Guidance, dated August 25, 2016, can be obtained from www.dol.gov/fairpayandsafeworkplaces.

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

Sensitive technology--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

“Veteran-owned small business concern” means a small business concern--
