PERFORMANCE WORK STATEMENT
NETAPP HARDWARE AND SOFTWARE MAINTENANCE
1.0 INTRODUCTION. This requirement is for the purchase of non-personal services related to hardware manufacturer extended warranty support for the Assistant Chief of Staff (AC/S G6), Marine Corps Installations East
(MCIEAST) who is responsible for the security, operation and sustainment of all Command and Control (C2) network services for the region. These network(s) include the Wide Area Network (WAN), Base Area Network
(BAN), Local Area Network (LAN), Secure Internet Protocol Routed Network (SIPRNET) and the Non-Secure
Internet Protocol Routed Network (NIPRNET) as well as the infrastructure and end devices that make up these networks. This PWS identifies the support requirements for the hardware installed and operating in these
Government Owned Government Operated (GOGO) networking enclaves and environments.
2.0 SCOPE. The contractor shall provide the support requirements for the hardware installed and operating in these Government Owned Government Operated (GOGO) networking enclaves and environments. Per
SECNAVINST 5230.15 all commercial off the shelf software procured and used requires continuous vendor support to ensure identified operational problems and security vulnerabilities are rapidly mitigated by vendor provided patches. This requirement is for the purchase of one year of non-personal services related to manufacturer software subscription and support of licenses in order to fulfill the preceding requirement:
3.0 REQUIREMENTS.
3.1 GENERAL DESCRIPTION. Provide extended software and hardware sustainment for the assets identified under the Contract Line Item Numbers (CLINs) of this contract located aboard Marine Corps Base Camp
Lejeune, North Carolina.
3.2 SPECIFIC REQUIREMENTS.
3.2.1 NON-RETURNABLE DISK PLUS SERVICE RENEWAL. Applicable to CLIN 0001 of the contract.
3.2.2 SUPPORTEDGE SECURE FOR GOVERNMENT: ONSITE w/ NEXT BUSINESS DAY RESPONSE
OBJECTIVE FOR REPLACEMENT PARTS DELIVERY. Applicable to CLINs 0002, 0003, and 0004 of the contract.
3.2.3 REMOTE DIAGNOSIS FOR HARDWARE. Due to security requirements the contractor will not have remote access to hardware. Remote problem diagnosis and support shall be provided through telephonic communications between the contractor and a Government Technical Representative. The Government’s Technical
Representative has no authority to modify the terms of the contract, or agree to any additional costs. Only the
Contracting Office has the authority to modify the contract.
3.2.4 TECHNICIAN REQUIREMENTS. The contractor shall provide technicians certified to service the brand name hardware and software utilized per the CLINs. The contractor shall obtain any training, certification and licensing required to support tasks performed under this contract at their own expense.
4.0 SECURITY REQUIREMENTS. The contractor shall adhere to installation security policies while aboard
Marine Corps Base Camp Lejeune, North Carolina.
5.0 PLACE OF PERFORMANCE.
5.1 Onsite support will be provided aboard Marine Corps Base Camp Lejeune, NC
5.2 Performance may require shipping to Marine Corps Base Camp Lejeune, NC
6.0 PERIOD OF PERFORMANCE. The period of performance shall be for a period of one (1) year starting 1
September 2017.
7.0 GOVERNMENT FURNISHED INFORMATION AND FACILITIES. Government furnished information, such as building locations, required by the contractor for the performance of this contract will be provided with each request. All information received remains the property of the United States Government. The
Contractor may be in contact with data subject to the Privacy Act (Title 5 of U.S. Code, Section 552.a). Reports and data shall be identified and safeguarded accordingly. Agency procedures shall be followed. The Contractor shall ensure that contractor employees assigned to this requirement are briefed annually on properly identifying and handling privacy act data/ information.
There is no requirement for Government Furnished Facilities. If vendor provides “on-site” support, access will be granted as required.
8.0 GOVERNMENT POINT OF CONTACT. The Government points of contact will be provided at time of contract award.

9.0 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). The COR will evaluate the contractor's performance by using a QASP to assure services meet the requirements of this contract. The Government's QASP is not a substitute for Quality Control by the contractor.
9.1 PERFORMANCE REQUIREMENTS SUMMARY. The performance standards for this PWS are stated in the Performance Requirements Summary (PRS) below. The COR will assess the Contractor’s performance to ensure the Contractor is performing up to the specified standard.

10.0 CONTRACTOR UNAUTHORIZED WORK PERFORMANCE. The Contractor shall not perform work that deviates from contract requirements and specifications. If the Contractor deviates from contract requirements and specifications without approval of the CONTRACTING OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.
11.0 BASE ACCESS.
1. Marine Corps Installations East - Marine Corps Base Camp Lejeune and Marine Corps Air Station New River have implemented the new RAPIDGate program intended to enhance installation access control. However, RAPIDGate contains significant changes that may affect contractor’s and their employee’s access to these installations. In order to gain access to Marine Corps Base (MCB), Camp Lejeune and/or Marine Corps Air Station (MCAS), New River, non-Federal Government and non-DoD issued ID cardholders require identity proofing and vetting to determine fitness and eligibility for access. Specifically, a check of records through the National Crime Information Center
(NCIC) Interstate Identification Index (III) is the installation's minimum background check for access to
MCB, Camp Lejeune and/or MCAS, New River for non-Common Access Card holders, to include entrance of visitors.
2. MCB, Camp Lejeune and MCAS, New River applies the following non-Federal Government cardholder criteria to determine the authorized type of access control credentials:
a. Contractors: RAPIDGate or 30-Day Pass followed by 4-DayPass*
b. Sub-Contractors: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
c. Vendors: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
d. Suppliers: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
e. Service Providers: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
f. Delivery Personnel: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
g. 3. Contractor Common Access Card (CAC) Eligibility: Contractor personnel authorized CAC’s are exempt from
RAPIDGate enrollment.
4. Contractor personnel who are ineligible for a CAC will be required to either obtain a 30-Day pass followed by a
4-Day pass* or enroll in the RAPIDGate Program. RAPIDGate is a voluntary program due to associated costs. For further information concerning contractor access, please contact the Contractor Vetting Office at 910-450-5978 or visit Marine Corps Base Camp Lejeune (http://www.lejeune.marines.mil/) or MCAS New River
(http://www.newriver.marines.mil/) websites. For information concerning enrolling in RAPIDGate please visit their website at www.rapidgate.com.
The Government will not be responsible for any access delays. Delays that may result from inadequate planning are contractor responsibility. Any and all costs associated with RAPIDGate are the sole responsibility of the contractor.
* Contractors will be issued a one-time pass for 30 days. Upon expiration of the 30 day pass, they will only be issued a 4 day pass every 4 days thereafter, for the duration of the contract.

5237.102(90) The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for aircraft maintenance via a secure data collection site.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) Tailored
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
LOWEST PRICE TECHNICALLY ACCEPTABLE (LPTA)
THIS REQUIREMENT IS FOR “BRAND NAME” ITEMS.
The proposed acquisition is unrestricted. The associated North American Industrial Classification System
(NAICS) Code is 511210, Software Publishers. Offerors must be registered in the System for Award
Management (SAM) database. Information on registering in SAM may be obtained by calling (866) 606-
8220 or via the internet at http://www.sam.gov. The provision at 52.212-1, Instructions to Offerors -
Commercial Items applies to this acquisition.
The Government intends to award a single firm-fixed price contract on an “all or none” basis for all items.
The Government reserves the right to award without discussions, but reserves the right to engage in discussions if later determined to be in the best interest of the Government. This acquisition will be conducted in accordance with FAR Part 12, Acquisition of Commercial Items and FAR Part 13.5, Simplified Procedures for Certain Commercial Items.
Quotes will be evaluated and ranked according to price, from lowest to highest. The Government reserves the right to evaluate only the technical quote of the lowest price quote. Other technical quotes may not be evaluated unless the Government determines the lowest price quote to be unacceptable or non-responsive.
In the event that Government determines the lowest price quote to be unacceptable, the next lowest price quote will be evaluated. This process will continue until a technically acceptable quote is found.
Technical acceptability will be based on the demonstrated ability to meet the technical requirements as stated below.
Lowest Price Technically Acceptable (LPTA) will be evaluated based on: (1) price; (2) technical acceptability, (3) period of performance and (4) an evaluation of Past Performance Information Retrieval
System (PPIRS) history.

(a) Definitions. As used in this provision--
“Administrative merits determination” means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.
“Arbitral award or decision” means an arbitrator or arbitral panel determination that a labor law violation occurred, or that enjoined or restrained a violation of labor law. It includes an award or decision that is not final or is subject to being confirmed, modified, or vacated by a court, and includes an award or decision resulting from private or confidential proceedings. (1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

“Service-disabled veteran-owned small business concern”—
