Performance Work Statement (PWS)
Introduction
Marine Corps Installations East (MCIEAST) implements policies, develops regional strategies and plans, prioritizes resources and provides services, direction, and oversight through assigned U.S. Marine Corps Installations in order to support the Operating Forces, tenant commands and activities. Marine Corps Air Station (MCAS) Cherry Point and Marine Corps Base (MCB) Camp Lejeune provide operational control over bombing target/strafing areas at each respective installation at and require aircraft services (fixed-wing or rotary) to meet regulatory guidelines.
Marine Corps Air Station (MCAS) Cherry Point Complex comprises nine widely dispersed properties located in
Carven, Carteret, Jones and Pamlico counties in eastern North Carolina, including several outlying airfields and bombing targets (BT-9 and BT-11). These properties cover approximately 26,073 acres of land and 18,000 acres of water, and are strategically located to meet operational and training requirements of the United States Marine Corps.
The bombing targets, BT-9 located in Pamlico County and BT-11 Piney Island located in Carteret County are the subject of this statement of work. Each locations has a defined, Code of Federal Regulations (33 CFR 334.420) area controlled by the Commanding Officer, MCAS Cherry Point.
MCIEAST Camp Lejeune comprises approximately 143,000 acres of land range area within Onslow County, North
Carolina and controls, via CFR (33 CFR 334.440), water based range training areas within New River and the
Atlantic Ocean (N-1/BT-3 complex).
Per the Endangered Species Act (ESA) and the Marine Mammal Protection Act (MMPA), all Federal activities that have potential to impact federally protected species must adhere to specific conditions of Biological Opinions and
Letters of Authorization/Concurrence rendered under section of the respective regulations. MCAS Cherry Point has consultations and coordination with the National Marine Fisheries Service specific to sea turtles, Atlantic sturgeon, and bottle-nose dolphin specific to BT-9 and BT-11. Pre-mission aerial surveys, along a specific identified route, are required to meet regulatory requirements. MCB Camp Lejeune has a MMPA Letter of Concurrence which requires a pre-mission survey of the N-1/MT-3 prior to live fire activities.
Period of Performance
The period of performance for services rendered within this contract is stated below. The option periods may be exercised at the discretion of the Government per Federal Acquisition Regulation (FAR) 52.217-9 Option to Extend the Term of the Contract (MAR 2000).

Performance Requirements
Aircraft Services - Marine Corps Air Station Cherry Point
Orientation Flight.
Contractor is required to complete an orientation flight, coordinated through Range Control and after receiving a
Range Safety Brief, along a pre-defined flight-path (map provided) for demilitarization with procedure and airspace protocols. Contractor’s airspace cooperators shall sign a Hold Harmless Agreement (provided by Government).
Contractor is required to provide a morning range survey at the beginning of every weekday (Mon-Fri) along a pre-defined flight-path (map provided). The total number of survey days will be 252 (52 weeks x 5 days/week - 20 days for federal holidays).
To account for daylight savings time, each survey is to start no earlier than 1/2 hour after astronomical sunrise. Nominally, the start of surveys would be no later than 0630 and to be complete by 0800 dependent upon the time of year.
The aircraft must maintain a height between 100-300 meters (328 to 984 ft.) above water surface level.
The aircraft must maintain a safe forward airspeed not to exceed 115 mph 100 knots).
The pilot is required to validate that no persons or watercraft (hunters, fisherman, moving or stationary watercraft of any description) are located on the government property of BT-11 or within the CFR controlled boundaries of BT-9/11 as determined by visual survey along the flight path. If the person or watercraft is within the CFR prohibited area or on land which is identified as MCAS Cherry Point property, the aircraft shall "buzz" the vessel by completing an advisory circle around the identified person/vessel at a safe altitude.
Photographic Recordation.
In addition to reporting and recording all visual observations, the contractor is required to acquire digital imagery of all persons or watercraft (hunters, fisherman, moving or stationary watercraft of any description) that are located on the government property boundary of BT-11 or within the CFR controlled boundaries as determined by visual survey along the flight path.
Deviation from the flight path above will be required to obtain a photograph.
At a minimum, a single tip-wing (or rotor) circle shall be made on the camera side of the aircraft to ensure proper framing and image capture. It is anticipated that the "buzz" advisory circle in 3.1.2.4 above shall be used to execute this paragraph.
The imagery shall be obtained with a digital SLR type camera with the following minimum specifications:
Photographic quality shall not be less than 24.0 mega-pixels.
Auto focus and vibration reduction zoom 80-400mm F/4.5-5.6D camera lens.
Sun/glare reduction shroud/filter as appropriate.
Date/time stamp.
Images shall be stored on a 16-32 GB internal SD card and downloaded to CD/DVD media (read-write capable) post mission. Each CD/DVD shall be labelled as to date range of the imagery contained on the media. All images provided to the Government shall be compatible with DoD systems.
Each image shall have GPS coordinates (lat/long in minutes, degrees, seconds or MGRS) noted for the location of observation. An annotation shall be made to the Master Data Collection Form indicating the number of images captured for a specific observation/record.
All images considered the property of MCAS Cherry Point and shall not be distributed beyond that noted in this contract.
Photographic Transfer.
Individual images or series of images of observed persons or watercraft on MCAS Cherry Point Properties shall be transmitted via electronic mail to the Technical Point of Contact the day of an observation. A complete record of all photographic images obtained shall be delivered to the Technical POC each month or as requested via the U. S.
Army Aviation and Missile Research Development and Engineering Center (AMRDEC) Safe Access File Exchange
(SAFE) transfer site. This web-site allows for secure file transfer to and from *.mil to non *.mil locations. This site is approved for use throughout DoD. The URL for the site is https://safe.amrdec.army.mil/SAFE/.
Data Collection.
All observation/visual contacts of persons or watercraft shall be immediately reported to Range Control as they occur.
Sighting information for persons/watercraft shall include:
Basic description identification (person, boat, large vessel, small vessel)
Location information shall be provided in military grid reference system (MGRS), WGS-84, 18 South
Duration of the observation
Response to "buzzing" (Y/N)
The pilot is required to record observations of marine mammals (bottlenose dolphins, whales, or manatee) or sea turtles along the designated flight path. All sighting shall be reported to range control with location and type (species) prior to checking off of the range. All sightings made in the immediate vicinity of the water based targets of BT-9 and BT-11 are to be report as they occur.
Sighting information shall include:
Species identification
Group size
Behavior (e.g. travelling, milling)
Location and relative distance from the water based bombing targets
Direction of travel relative to the water based bombing targets
Duration of the observation
Date, time, and visual conditions (weather)
Data collection forms shall be submitted to EAD and Range Management on a monthly basis.
Daily Coordination
The flight crew is required to abide by all FAA regulations and to possess appropriate ratings.
The flight crew shall conduct a review of weather from departure airport/aerodrome and review ASOS weather at bombing target - eleven (BT-11) for the duration of the flight. Crew may cancel the survey based on weather and will not be required to make it up later in the day. Visual flight rule minimums (1,000' vertical, 3 mile-horizontal) shall be used as a basis for weather related cancelation.
In the event of weather related cancellation, or other circumstance, the crew shall notify Range Control at
252-466-4040/2936. Contractor shall be compensated in accordance with the terms of the contract for services that have been prepared to be rendered.
Aircraft Services - Marine Corps Base Camp Lejeune
Orientation Flight.
Contractor is require to complete an orientation flight, coordinated through Range Control and after receiving a
Range Safety Brief, along a pre-defined flight-path (map provided) for familiarization with procedure and airspace protocols.

Contractor is required to provide an on-call aircraft range survey prior to military live-fire exercises in the N-1/BT-3 impact area and the H-Range to ensure that no marine mammals or watercraft are in the impact area. Contractor will be notified of range survey requirement for MCB Camp Lejeune 14 days prior to date of performance.
The aircraft must maintain a height of 750 feet above surface.
The aircraft must fly a path consisting of two survey lines 2 nautical miles apart and parallel to the coast. The first line must be between 1-2 miles off the beach front, and the second 3-4 miles off the beach front.
If a marine mammal or watercraft is spotted along any survey line within the N-1/BT-3, the pilot must immediately notify BLACKBURN via VHF radio noting the information contained in 3.2.3 below. Additionally, the pilot must notify Navy Guard Boat personnel via Marine Band Radio (frequency to be provided) with vessel location information.
Specifically for persons/watercraft observations within the CFR area (land, marsh, or water) the aircraft shall "buzz" the vessel by completing an advisory circle around the identified person/vessel at a safe altitude.
The pilot and/or crew shall complete Marine Species Awareness Training (MSAT). The video/training is available online and link will be provided.
Data Collection.
The pilot is required to validate that no persons or watercraft (hunters, fisherman, moving or stationary watercraft of any description) are located within the N-1/BT-3 impact area. All observation/visual contacts shall be immediately reported to Range Control/BLACKBURN as they occur.
The pilot is required to record observations of marine mammals (bottlenose dolphins, whales, or manatee) along the designated flight path. All sightings shall be immediately reported to Range Control/BLACKBURN with the following information:
Sighting information shall include:

Data Collection Forms shall be submitted to EMD and Range Control/BLACKBURN on a monthly basis (as flights occur).

The flight crew is required to abide by all FAA regulations and to possess appropriate ratings.
The flight crew shall conduct a review of weather prior to departure from airport/aerodrome (ASOS or other) from an appropriate location and maintain awareness for the duration of the flight. Crew may cancel the survey based on weather. Visual flight rule minimum (1,000' vertical, 3 mile horizontal) shall be used as a basis for weather related cancellation. When canceling, crew shall notify Range
Control/BLACKBURN. Contractor shall be compensated in accordance with the terms of the contract for services that have been prepared to be rendered.
Non-Personal Services
The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Contracting Officer immediately.
Performance Standards
a) STD: Contractor is required to provide a morning range survey at the beginning of every weekday (Mon-Fri) along a pre-defined flight path.
AQL: 100%
b) STD: Survey to start no earlier than 1/2 hour after astronomical sunrise. Nominally, the start of surveys would be no later than 0630 and to be complete by 0800 dependent on the time of year.
c) STD: Aircraft must maintain a height between 100-300 meters (328 to 984 ft.) above water surface level.
d) STD: Aircraft must maintain a safe forward airspeed not to exceed 115 mph (100 knots).
e) STD: Pilot is to validate that no persons or watercraft are located on the government property of BT-11 or within the CFR controlled boundaries of BT-9/11 as determined by visual survey along the flight path. f) STD: Acquire digital imagery of all persons or watercraft that are located on the government property boundary of
BT-11 or within the CFR controlled boundaries as determined by visual survey along the flight path.
g) STD: Images shall be stored on a 16-32 GB internal SD card and downloaded to a CD/DVD media (read-write capable) post mission. Each Cd/DVD shall be labelled as to date range of the imagery contained on the media. Each image shall have GPS coordinates noted for the location of the observation. An annotation shall be made to the Master Data Collection Form indicating the number of images captured for a specific observation/record.
Safety
Mishap Notification and Investigation: The contractor and its subcontractors (if applicable) shall promptly report pertinent facts regarding mishaps involving Government property damage or injury to Government personnel and to cooperate in any resulting safety investigation. The contractor shall notify (via telephone) the cognizant contracting officer, the contracting officer’s representative, and/or other applicable members within four (4) hours of all mishaps or incidents. The Government person notified by the contractor will in-turn notify the Safety office. Contractor notifications made after duty hours shall be reported to the appropriate installation Command Post. If requested by the cognizant contracting officer, the contracting officer’s representative, and/or the cognizant program manager, the contractor shall immediately secure the mishap scene/damaged property and impound pertinent maintenance and training records until released by the investigating safety office. If the Government investigates the mishap, the contractor and the subcontractors shall cooperate fully and assist the Government personnel until the investigation is completed.
Government Furnished Materials
The Range Management Department and/or Range Control Office will provide a one-time range safety brief prior to the initiation of surveys. Flight within the restricted area will be authorized and a mission number provided by
Range Control.
Orientation map of MCAS Cherry Point properties will be provided.
Map of the defined flight paths for MCAS Cherry Point and MCB Camp Lejeune will be provided.
Initial format of Data Collection Form (to be reproduced by Contractor).

Quality Assurance Surveillance Plan (QASP)
The Government shall monitor the Contractors performance under this Contract in accordance with the
Governments QASP.
Base Access
In order to gain access to Marine Corps Base (MCB), Camp Lejeune and/or Marine Corps Air Station (MCAS), New River, non-Federal Government and non-DoD issued ID cardholders require identity proofing and vetting to determine fitness and eligibility for access. Specifically, a check of records through the National Crime Information
Center (NCIC) Interstate Identification Index (III) is the installation’s minimum background check for access to
MCB, Camp Lejeune and/or MCAS, New River for non-Common Access Card holders, to include entrance of visitors.
MCB, Camp Lejeune and MCAS, New River applies the following non-Federal Government cardholder criteria to determine the authorized type of access control credentials:
Contractors: RAPIDGate or 30-Day Pass followed by 4-DayPass*
Sub-Contractors: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
Vendors: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
Suppliers: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
Service Providers: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
Delivery Personnel: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
Public-Private Venture (PPV) Housing and Installation Volunteers: Local Population Credential (The following are examples of Installation Volunteers: (Red Cross, Community College Instructors and Students, Commissary
Baggers, Naval Hospital Volunteers, Family Readiness Volunteers, Wounded Warrior Volunteers, and any other organization approved by the Commanding General, Marine Corps Installation East-Marine Corps Base Camp
Lejeune and Commanding Officer, MCAS, New River)
Contractor Common Access Card (CAC) Eligibility: Contractor personnel authorized CAC’s are exempt from
RAPIDGate enrollment.
Contractor personnel who are ineligible for a CAC will be required to either obtain a 30-Day pass followed by a 4-
Day pass* or enroll in the RAPIDGate Program. RAPIDGate is a voluntary program due to associated costs. For further information concerning contractor access, please contact the Contractor Vetting Office at 910-450-5978 or visit Marine Corps Base Camp Lejeune (http://www.lejeune.marines.mil/) or MCAS New River
(http://www.newriver.marines.mil/) websites. For information concerning enrolling in RAPIDGate please visit their website at www.rapidgate.com.
The Government will not be responsible for any access delays. Delays that may result from inadequate planning are contractor responsibility. Any and all costs associated with RAPIDGate are the sole responsibility of the contractor.
* Contractors will be issued a one-time pass for 30 days. Upon expiration of the 30 day pass, they will only be issued a 4 day pass every 4 days thereafter, for the duration of the contract.
Contractor’s Unauthorized Work Performance.
The Contractor shall not perform work that deviates from contract requirements and specifications. If the Contractor deviates from contract requirements and specifications without approval of the CONTRACT
ADMINISTRATOR/OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.
QASP

Purpose
This Quality Assurance Surveillance Plan (QASP) is a government-developed document used to determine if the contractor's performance meets the performance standards contained in the contract. The QASP establishes procedures on how this assessment/inspection process will be conducted. It provides the detailed process for a continuous oversight process:
What will be monitored
How monitoring will take place
Who will be conduct the monitoring
How monitoring efforts and results will be documented
The contractor is responsible for implementing and delivering performance that meets contract standards using its
Quality Control Plan. The QASP provides the structure for the government's surveillance of the contractor's performance to assure that it meets contract standards. It is the government's responsibility to be objective, fair and consistent in evaluating contractor performance.
The QASP is not part of the contract nor is it intended to duplicate the contractor's quality control plan. This QASP is a living document. Flexibility in the QASP is required to allow for an increase or decrease in the level of surveillance necessary based on contractor performance.
The government may provide a copy of the QASP to the contractor to facilitate open communication. In addition, the QASP should recognize that unforeseen or uncontrollable circumstances might occur that are outside the control of the contractor.
Bottom line, the QASP should ensure early identification and resolution of performance issues to minimize impact on mission performance.
Authority
Authority for issuance of this QASP is provided under Part 46 of the Federal Acquisition Regulation, Inspection of
Services clauses, which provides for inspection, acceptance and documentation of the service called for in the contract or order. This acceptance is to be executed by the contracting officer or a duly authorized representative.
Roles and Responsibilities
The following personnel shall oversee and coordinate surveillance activities.
Contracting Office (KO)
The KO shall ensure performance of all necessary actions for effective contracting, ensure compliance with the contract terms, and shall safeguard the interests of the United States in the contractual relationship. The KO shall also ensure that the contractor receives impartial, fair, and equitable treatment under this contract. Determine and document the final assessment of the contractor's performance in the governments past performance tracking system.

Government Point of Contact
The GPC is responsible for providing continuous technical oversight of the contractor's performance. The COR uses the QASP to conduct the oversight/surveillance process. The GPC shall keep a Quality Assurance file that accurately documents the contractor's actual performance. The purpose is to ensure that the contractor meets the performance standards contained in the contract. The COR is responsible for reporting early identification of performance problems to the KO. The COR is required to provide an annual performance assessment to the KO which will be used in documenting past performance. The QASP is the primary tool for documenting contractor performance. The COR is not empowered to make any contractual commitments or to authorize any contractual change on the Government's behalf.
Contract Administrator
Contract Administrator (CA) monitors contract day to day operations and performance. The CA is the central

Performance Requirements and Method of Surveillance
This section describes the special requirements for this effort. The following sub-sections provide details of various considerations on this effort.
Contract Surveillance
The goal of the QASP is to ensure that contractor performance is effectively monitored and documented. The
Government Point of Contact's (GPC) contribution is their professional, non-adversarial relationships with the KO and the contractor, which enables positive, open and timely communications. The foundation of this relationship is built upon objective, fair, and consistent GPC evaluations of contractor performance against contract requirements.
The GPC uses the methods contained in this QASP to ensure the contractor is in compliance with contract requirements. The GPC function is responsible for a wide range of surveillance requirements that effectively measure and evaluate the contractor's performance. Additionally, this QASP is based on the premise that the contractor, not the government, is responsible for management and QC/QA actions to successfully meet the terms of the contract.
Surveillance Matrix
The Surveillance Matrix (Attachment 1) is the list of performance objectives and standards that must be performed by the contractor. This matrix details the method of surveillance the GPC will use to validate and inspect these performance elements. Inspection of each element will be documented in the GPC file.
Performance objectives define the desired outcomes. Performance Standards define the level of service required under the contract to successfully meet the performance objective. The inspection methodology defines how, when, and what will be assessed in measuring performance. The Government performs surveillance, using this QASP, to determine the quality of the contractor's performance as it relates to the performance element standards. The PRS should be used to form the foundation of the GPC's inspection checklist.
In evaluating the quality of contractor’s performance, the following performance ratings may be used.

Government’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor was effective.
Satisfactory Performance meets contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor’s proposed actions appear only marginally effective or were not fully implemented.
Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains a serious problem(s) for which the contractor’s corrective actions appear or were ineffective.
Appendix 1 - Surveillance Matrix
