STATEMENT OF WORK

1. Scope. The contractor is to provide a Driver Risk Mitigation Course (DRMC) where students are taught how to recognize high risk driving (4 wheel PMV) circumstances, in non-tactical situations, and how to develop strategies to mitigate the threats from these circumstances. These high risk driving circumstances include driving with peers, optimistic bias, emotionality, drinking and driving, seat belt use, distracted driving, and fatigued driving and tailgating. Contractor will deliver one (1) evolution of four (4), five and ½ (5.5) hour DRMCs, over the course of two days at Marine Corps Auxiliary Landing Field (MCALF) Bogue. An evolution will consist of four (4) five and

½ (5.5) hour blocks of training for 32 students in each block, for a total of 128 students. The evolution of the DRMC will be conducted at MCALF Bogue by 30 September 2016. The course target audience is medium to high risk

Marines and Sailors. The course will assess students while driving during multi-tasking and divided attention exercises. These students will be fully challenged by ride-along instructors and courses that are a direct result of mishap/crash data for active duty military personnel. This course of instruction has been endorsed by the

Commanding General, MCIEAST-MCB Camp Lejeune.

2. Services. Provide one (1) evolutions of four (4), five and ½ (5.5) hour DRMCs, over the course of two days at

MCALF Bogue for a total of 128 students. The contractor will develop a competency-based curriculum materials for both classroom and on-track settings to address the specific skill deficiencies of the target population. The contractor will also design, develop, and implement program assessment for the course including formative and summative evaluation of teaching and learning as well as program delivery designed to teach safe driving skills and safety education consisting of classroom and on-track laboratory experiences based on the best vehicle control techniques, life skills training, and education/mentoring in order to: (a) target high-risk driving circumstances; (b) teach methods and techniques in both classroom and on-track developed to address lifestyle and psychosocial factors that can mitigate risky driving behaviors; (c) provide competency-based training in both the classroom and on-track that recognizes individual differences and is tailored to address the specific skill deficiencies of drivers; (d) address in both classroom and on-track immaturity and inexperience with respect to the driving task.

3. Instructors. Only instructors who possess comprehensive experience in advanced motor vehicle training and knowledge of the rules of the road will provide this service. Instructors will be provided at a ratio of at least one instructor for every two students. Instructors will have comprehensive experience in traffic control devices, vehicle capabilities, handling, vehicle dynamics, and mishap prevention. Instructors must be certified and have completed a course of instruction validated by an accredited institution of higher learning and/or research institute which produces knowledge that leads to new and more effective ways of improving the safety of the automotive and transportation environment by developing evidence-based countermeasures and products.

4. Period of Performance. One event at MCALF Bogue Field in Fiscal Year 2016.

5. Course Schedule. The DRMC will be conducted at MCALF Bogue before 30 September 2016. The evolution will train no more than 128.

6. Course Location. The DRMC will be conducted on Pad Two located onboard MCALF Bogue.

7. Cancellations. Cancellation of the DRMC due to weather or other unforeseen circumstances shall be mutually agreed upon by the contractor and government point of contact. Alternate dates will be scheduled by mutual agreement.

8. Deliverables by the contractor will include:

8.1. Conduct preliminary site visit to view proposed site and facilities, and review course design.

8.2. Provide. Provide one (1) evolution of four (4), five and ½ (5.5) hour DRMCs, over the course of two days for

32 students in each course (total of 128 students) at MCALF Bogue, NC.

8.3. Provide at least twelve certified instructors/ course workers who possess comprehensive experience in advanced motor vehicle training and knowledge of the rules of the road. Instructors will have comprehensive experience in traffic control devices, vehicle capabilities, handling, vehicle dynamics, and mishap prevention. Instructors must be certified and have completed a course of instruction validated by an accredited institution of higher learning and/or research institute which produces knowledge that leads to new and more effective ways of improving the safety of the automotive and transportation environment by developing evidence-based countermeasures and products.

8.4. Design and develop a professional program which is designed to teach safe driving skills and safety education consisting of classroom and on-track laboratory experiences based on the best vehicle control techniques, life skills training, and education/mentoring in order to: (a) target high-risk driving circumstances; (b) teach methods and techniques in both classroom and on-track developed to address lifestyle and psychosocial factors that can mitigate risky driving behaviors; (c) provide competency-based training in both classroom and on-track that recognizes individual differences and is tailored to address the specific skill deficiencies of drivers; (d) address in both classroom and on-track immaturity and inexperience with respect to the driving task. Program must be designed using research from accredited institution of higher learning which has a research-based interdisciplinary program focused on the critical human-vehicle-road interface and brings together nationally and internationally recognized researchers, educators, and government and corporate partners to improve the safety of the automotive transportation environment.

8.5. The program will include both pre-assessments and post assessments of the student’s knowledge as a tool to evaluate the effectiveness of the program.

8.6. The program will include a post course survey measuring knowledge gained and giving students the opportunity to provide feedback to both the contractor and to MCIEAST-MCB CamLej.

8.7. Collect data from participants and trainers (on-site) at the six program events and conduct data analysis of regarding assessment of participants and trainers for so improvement can be made for follow on events.

8.8. Prepare, organize, and conduct all required classroom instruction, practical application exercises and examinations based on data from MCIEAST-MCB CamLej Safety Department, and research from accredited institutions of higher learning.

8.9. Develop a specific road course and skill enhancement drills to reduce mishaps and fatalities based on data from the MCIEAST-MCB CamLej Safety Department, and research from accredited or professional institutions.

8.10. A data collection method will be utilized to measure performance of selected students throughout the course;

this data will include braking distance and reaction distance.

8.11. Develop and provide training materials, curriculum and completion certificates for students. Each class will include classroom instruction, and expectations of the course. Classroom instruction will target high-risk driving circumstances, teach methods and techniques to address lifestyle and psychosocial factors that can mitigate risky driving.

8.12. Deliver a pre and post-course survey to measure the student’s knowledge level before the course and at the end of the course and deliver the results of this survey at the end of the course.

8.14. The contractor must provide at least 10 vehicles for the on-track training and staff for tear down and set-up outdoor classrooms and track. There is no access to electricity at the training location. The contractor will supply sufficient generators to meet electricity demands.

8.15. Provide event insurance relating to all safe driving events.

8.16. This program is not a tactical driving course and will not include or teach Precision Immobilization Technique

(PIT), multiple car Tactical Vehicle Intercept (TVI), and pursuit termination. This course will not teach any type of stunt, race, high-speed, or competition style of driving.

8.17. The contractor will deliver a Final Report within 3 month of the conclusion of the course, and will include a face-to-face presentation of final report, test project design and method, data collection and overall results and results per event, organization of data, conclusion and application of results, and recommendations for ongoing support, training, certification, and assessment with monitoring, evaluation, and quality improvement.

8.18. The contractor must have a history of working with the United States Marine Corps and provide a summary of that history with their bid submission.

9.0 Deliverables by MCIEAST-MCB CAMLEJ will include:

9.1. Coordinate a schedule for advanced motor vehicle training with the contractor not to exceed one (1) evolution of four (4), five and ½ (5.5) hour DRMCs, over the course of two days. One evolution will consist of four (4) five and ½ (5.5) hour blocks of training for 32 students in each block, for a total of 128 students.

9.2 Provide a roster of students prior to commencement of the course.

9.3 Provide water for the students.

10. Role of the Government Representative for Inspection, Acceptance and other duties.

10.1. Responsibilities. Performs surveillance and inspection of services required under this contract; determines the adequacy of contractor performance per contract specifications; acts as the Government’s representative at the work site; insures compliance with contract performance requirements; and advises the Contract Administrator of any factors that may cause performance delays. The Government Representative cannot authorize deviation from contract requirements. The COR’s name and telephone number are listed below:

MANPOWER REPORTING

5237.102(90) The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for training via a secure data collection site. The contractor is required to completely fill in all required data fields using the following web address https://doncmra.nmci.navy.mil .

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

THIS PROCUREMENT IS A SMALL BUSINESS SETASIDE. ALL RESPONSIBLE SMALL BUSINESS

SOURCES MAY SUBMIT A RESPONSE WHICH, IF TIMELY RECEIVED, WILL BE CONSIDERED BY THE

AGENCY.

Quotes will be evaluated and ranks according to price, from lowest to highest. The Government reserves the right to evaluate only the technical proposal of the lowest price offeror. Other technical proposals may not be evaluated unless the Government determines the lowest price offeror to be unacceptable or non-responsive. In the event that

Government determines the lowest price offeror to be unacceptable, the technical proposal of the next lowest price offeror will be evaluated. This process will continue until a technical proposal is determined to be acceptable.

Technical acceptability will be based on the demonstrated ability to meet the technical requirements, including the delivery requirement. A mere statement that the vendor “will meet the Government’s requirements” is insufficient;

the vendor must demonstrate how it will meet the requirement. Lowest Price Technically Acceptable (LPTA) will be evaluated on: (1) price; (2) technical (as stated in SOW); and (3) delivery.

To ensure technical compliance with the requirements, vendor quotes shall include the following information:

a. Vendor Specifications. Vendor’s quote must be written in a logical, practical, clear, concise and logically assembled manner, containing all pertinent information in sufficient detail to provide the Government with a clear understanding of the vendor’s approach and to permit evaluation of the proposed program. It is the responsibility of the vendor to present enough information to allow the various work efforts, support, and management approaches to be meaningfully evaluated without discussions

b. Vendor’s quote shall include an active Cage Code and Federal Tax Identification number. Vendors are required to be registered with SAM database and have an active cage code at the time of award.

c. Delivery Information. Clearly state if the quoter can meet the requested delivery as stated in each CLIN. If not, then state the best delivery date.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (APR 2016)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the

Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment

Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act

(50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned--

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term

“successor” does not include new offices/divisions of the same company or a company that only changes its name.

The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern--

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

"Women-owned small business concern" means a small business concern--

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least

51 percent of its stock is owned by one or more women; or

(2) Whose management and daily business operations are controlled by one or more women.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.

Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals

Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
