USE OF OTHER THAN FULL AND OPEN COMPETITION
TAMPA MICROWAVE REFURBISHMENT
1.Contracting Activity.
Second Marine Logistics Group, Expeditionary Contracting Office, Camp Lejeune, North
Carolina.
2. Description of Action Being Approved.
The subject action is a request to enter into a sole source new contract with Tampa Microwave, LLC (CC: 6PH44) for Microwave Antenna refurbishment and upgrade.
3. Description of Supplies/Services.
Provide the refurbishment of (9) Tampa Microwave Manpack Satellite Terminals. Consisting of the following: All system components disassembled, painted, inspected, replaced, and tested to the manufacturer standards of a new model. All antennas (9) upgraded to 65cm dish and feed per system. Includes a 1 year warranty for each individual system.
Refurbishment of Tampa Microwave satellite terminals will ensure reliability and extend the lifecycle of the current systems that were originally procured in the FY11 time frame. The upgrade of the satellite dish from 45cm to 65cm will increase performance by providing 2 x the gain (3db) of the originally fielded systems. The warranty will provide maintenance support for the next year alleviating the need to cut a contract for each repair action as we currently have to do for inoperative out-of-warranty systems.
These satellite terminals are employed across the MARFOREUROPE and AFRICA AORs by deployed rotational forces to provide NIPRNET and SIPRNET services. These services provide command and control (C2), situational awareness (SA), and logistics capabilities to commanders and staffs.
The first four units will be shipped off in FY16. The remaining five units will be shipped out
FY17.

The performance periods for this contract are as follows:

Pending Phasing period. Each of the nine serial numbers will have a designated refurbishment date. Once the unit is returned the warranty will begin.

4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 1903 as implemented by the Federal Acquisition Regulations (FAR) subpart 13.5, which authorize the use of a modified sole source justification under 10 U.S.C. Section 2304
(c)(1), as implemented by the FAR 6.302-1, Only One Responsible Source and No Other
Supplies or Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Tampa Microwave LLC has provided documentation indicating that they are the sole company capable of providing refurbishment and upgrade of their own equipment. There are no responsible vendors that are authorized to modify, repair, nor upgrade the existing Tampa
Microwave equipment already in possession of the Marine Corps.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible
An analysis of new equipment that is similar to the equipment that is currently in possession of the government was conducted. These items, on GSA schedule 70/132-9; Mfr Part No: GCS-
2105EAP-01T, would cost the government roughly three times as much money than refurbishing the older Tampa Microwave models that are currently in possession of the government.
Knowing this, it is MFEA’s opinion that it would be more advantageous to the federal government to refurbish the existing equipment Tampa Microwave equipment that is already in the possession of the government.
7. Determination of Fair and Reasonable Cost
In order to determine whether a fair and reasonable cost is quoted an analysis of the marketplace will occur. The vendor will provide a published price list and/or invoices of similar equipment and services sold to commercial vendors. In the event that is not sufficient a search of
FPDS-NG will occur in order to analyze same or similar contract requirements. Once a same or similar contract is found, the II MLG contracting officer will get in touch with the contracting agency responsible for the acquisition to determine fair and reasonable pricing.
8. Actions to Remove Barriers to Future Competition.
Since this requirement is falls under FAR 6.302-1, Only One Responsible Source and No Other
Supplies or Services Will Satisfy Agency Requirement the barrier to future competition is justificed, specifically under exception (ii)(A), substantial duplication of cost to the Government that is not expected to be recovered through competition. Until it has been determined in the best interest of the government to purchase new systems, refurbishment of the systems currently owned has been determined to be the most cost effective means of maintaining this technical capability.
