STATEMENT OF WORK

Samsung Galaxy S2 8.0 Android Tablets MAG 11 3rd MARINE AVIATION WING (3D MAW)

Marine Corps Air Station (MCAS) Miramar, San Diego, California

1.0 OBJECTIVE: The objective is to provide 350 Samsung Galaxy Tablets S2 8.0 (32GB), 350 Full-Body Protective Beetle Defense Cases or Equivalent, 350 SANDISK Ultra 128GB MicroSDXC Memory Cards or Equivalent, and 350 MicroSD 2.0 USB On-The-Go (OTG) Card Readers/Writers for Androids in support of MAG 11 3rd MAW, MCAS Miramar, San Diego, California compatible with the KILSWITCH (Kinetic Integrated Low-cost Software Integrated Tactical Combat Handheld) application to be used on aircrafts in support of flight operations. The requirements of this acquisition is intended to equip deploying squadrons with tablet technology that will advance the Marine’s war fighting skills. The purpose of this acquisition is to provide the Marines with the necessary supplies needed to increase the aircrew’s live satellite, intelligence, and surveillance in supporting ground forces ability to coordinate and maneuver efficiently in a tactical environment and capability of rapidly ordering air strikes.

2.0 BACKGROUND: 3rd MAW will equip several deploying squadrons with Samsung Galaxy Tablets to allow units to utilize the KILSWITCH application. The integration of the Samsung Galaxy and KILSWITCH application will give Marines in the air and ground real-time situational awareness to be used for precision target mapping. The Android tablet (Samsung Galaxy Tab S2 8.0) is the only mobile device capable of integrating the KILSWITCH application. The integrated KILSWITCH application will give the Marine flight operations the ability to conduct, command, and control over supporting direct fires and movement of personnel by aircraft, vehicle, or foot. The Marines will have a satellite view of their surroundings, helping them pinpoint their location on a map as well as identify enemy targets faster and more accurately than ever before. Using tablets allows a quicker and more accurate response from 3rd MAW squadrons.

3.0 DESCRIPTION OF ITEMS:

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

52.212-1 ADDENDUM

INSTRUCTIONS TO OFFERORS

This solicitation is a 100% set-aside for Small Business pursuant to 52.219-6 under North American Industry Classification System (NAICS) Code 334111, Electronic Computer Manufacturing. The small business size standard under this NAICS Code are those employing no more than 1,250 employees.

Any quote that is submitted by a contractor that is not Small Business under NAICS Code 334111 will not be considered for award.

1. SUMMARY: This is a request for quotation utilizing the procedures of FAR Part 12 and FAR Subpart

13.5. Responses to this solicitation are considered quotations and not offer. In those instances where the words offer, offeror, and proposal are used, the reader should understand that the use of such words does not change the nature of this request for quotation. The resulting award will be a Firm-Fixed-Priced Contract. This requirement shall provide supplies in support of Marine Corps Air Station (MCAS), Miramar, MAG 11, 3rd Marine Air Wing (3D MAW), San Diego, California.

2. SUBMISSION OF QUOTATIONS: Quotations must be received no later than the date and time specified in block #8, page #1 – Pacific Daylight Time (PDT). Quotes shall be submitted via email to the attention of Drena McIntosh and Kenyadah M. Gamble at Drena.McIntosh@usmc.mil and Kenyadah.Gamble@usmc.mil. If the quote is submitted via multiple please number the emails (for example, “Email 1 of 3”, “Email 2 of 3”, and “Email 3 of 3”).

3. PERIOD OF ACCEPTANCE OF OFFERORS: The pricing terms and conditions of the quotations shall be valid for 90 days unless stated otherwise in the quote.

5. FORMAT OF QUOTES: This section specifies the content and limitations that the quoters shall use when submitting quotes. Submissions shall be in the format prescribed below and shall contain a response to each of the files identified. Incomplete submissions will not be considered. To be considered complete, a quote submission requires the following electronic files:

(a) File I: General

• Number of this RFQ Solicitation

• Offeror’s company name, address, administrative points of contact, DUNS number, Cage

(b) File II: Technical – The Technical portion shall not contain price information. The submission shall demonstrate that the quoter is fully capable of providing the items described in the Statement of Work (SOW), paragraph 3.0, Description of Items by addressing the following:

1. Technical quote shall meet the following minimum salient characteristics:

• 350 Brand-Name Samsung Galaxy Android Tablet S2 8.0, 32GB Android 6.0 Operating System or Greater to be used on an aircraft while in support of flight operations.

• 350 Beetle Full-Body Protective Defense Case or Equivalent with the highest quality standard of protection that is compatible with the procured Samsung Galaxy Tablet S2 8.0.

• 350 SanDisk Ultra 128GB MicroSDXC Memory Card or Equivalent that is compatible with the procured Samsung Galaxy Tablet S2 8.0 and MicroSD Flash Card Drive Readers/Writers.

• 350 MicroSD USB 2.0 Flash Card Drive Reader/Writer with Adapter or

Equivalent that is compatible with the procured Samsung Galaxy Tablet S2 8.0 and 128GB MicroSDXC Memory Card.

2. Meet delivery date of: Be able to deliver all items within 30 days after the date of the purchase order award.

(c) File III: Price-- A completed Standard Form 1449 (SF1449), Price Quote.

1. The quoter shall submit a completed Standard Form 1449 (SF1449), including any solicitation amendments. Blocks 17a, 30b, and 30c of page 1 of the SF1449 shall be completed by quoters and Block 30a shall be signed by an authorized agent of the quoter acknowledging that the quoter has read and agrees to comply with the terms, conditions, and instructions provided in this solicitation.

2. The quoter must submit and complete any SF30 amendments issued to the solicitation. Each SF30 amendment shall be signed by an authorized agent of the quoter acknowledging the quoter has read and agrees to comply with all the terms, conditions, and instructions provided in the document.

3. Quoter shall complete all applicable provisions and clauses that require a response from the quoter.

4. The price quoted shall be provided in the schedule of supplies/services of the solicitation SF1449

– Contract Line Item Number (CLIN) 0001, CLIN 0002, CLIN 0003, CLIN 0004.

5. The quoter must complete the unit price and total price for each CLIN as well as a summation of the TOTAL contract price (aggregate total of CLINs 0001 through 0004).

6. Quoted unit pricing shall be stated in no more than 2 decimal places. Any price quote containing unit pricing exceeding two (2) decimal places will be deemed an incomplete submission.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be the lowest priced, technically acceptable (LPTA) quotation. The following factors shall be used to evaluate offers:

• Price

Evaluation Process:

First, the quotes will be placed in price order from lowest to highest based on the Total Price Quoted (TPQ). The lowest ranked TPQ offeror's technical quote will then be evaluated and receive a rating of Acceptable or Unacceptable. In order to be rated as acceptable, the technical quote must meet the Government's minimum requirements. Quotes deemed Unacceptable are those that fail to meet the Government's minimum requirements.

If the lowest priced offeror’s technical quote is rated acceptable, the evaluation process will stop at this point as that offer represents the best value to the Government. Award shall be made to that offeror without further consideration of any other offers. If the lowest ranked TPQ offeror’s technical quote is assigned an unacceptable rating or if the price is determined not fair and reasonable and poses an unacceptable risk to the Government, or if the offer is found to be non-responsible, the next lowest placed TPQ offer will be evaluated. This process will continue (in order of ascending TPQ) until an offeror is evaluated to have an acceptable technical rating, fair and reasonable price, and the offeror is deemed responsible or until all offers have been evaluated.

Evaluation Factors: The following factors shall be used to evaluate offers:

Factor 1: Technical Capability. Each offeror’s Technical quote shall be evaluated as Acceptable or Unacceptable as defined below:

To be rated Technically Acceptable, the offeror must provide a technically acceptable supplies which clearly meets the requirements of the Statement of Work (SOW) objectives. When evaluating the offeror’s technical quote, the Government will determine if the offeror has met the following minimum requirements:

• 350 Brand-Name Samsung Galaxy Android Tablet S2 8.0, 32GB Android 6.0 Operating Systems or Greater to be used on an aircraft while in support of flight operations. (Brand name only. An “Equivalent” will not be accepted for this item).

• 350 Beetle Full-Body Protective Defense Cases or Equivalent with the highest quality standard of protection that is compatible with the procured Samsung Galaxy Android Tablet S2 8.0, 32GB.

• 350 SanDisk Ultra 128GB MicroSDXC Memory Card or Equivalent that is compatible with the procured Samsung Galaxy Tablet S2 8.0 and MicroSD Flash Card Drive Readers/Writers.

• 350 MicroSD USB 2.0 Flash Card Drive Reader/Writer or Equivalent that is compatible with the procured Samsung Galaxy Tablet S2 8.0 and 128GB MicroSDXC Memory Card

2. Quoter is able to deliver all items within 30 days after the date of the purchase order award.

Factor 2: Price: The Offeror’s price quote will be evaluated to determine price completeness and reasonableness.

(b) Award will be made to the vendor whose proposal represents the best value to the government, based on a Lowest Price Technically Acceptable (LPTA) basis between price and non-price factors –Technical Capability.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JAN 2017)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(a) Definitions. As used in this provision-- “Administrative merits determination” means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

“Arbitral award or decision” means an arbitrator or arbitral panel determination that a labor law violation occurred, or that enjoined or restrained a violation of labor law. It includes an award or decision that is not final or is subject to being confirmed, modified, or vacated by a court, and includes an award or decision resulting from private or confidential proceedings. (1) In paragraph (h) of this provision: A judgment or finding of a civil offense by any court of competent jurisdiction.

(2) In paragraph (s) of this provision: Any judgment or order entered by any Federal or State court in which the court determined that a labor law violation occurred, or enjoined or restrained a violation of labor law. It includes a judgment or order that is not final or is subject to appeal. To determine whether a particular judgment or order is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.

“DOL Guidance” means the Department of Labor (DOL) Guidance entitled: ``Guidance for Executive Order 13673, `Fair Pay and Safe Workplaces' ''. The DOL Guidance, dated August 25, 2016, can be obtained from www.dol.gov/fairpayandsafeworkplaces.

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Enforcement agency” means any agency granted authority to enforce the Federal labor laws. It includes the enforcement components of DOL (Wage and Hour Division, Office of Federal Contract Compliance Programs, and Occupational Safety and Health Administration), the Equal Employment Opportunity Commission, the occupational Safety and Health Review Commission, and the National Labor Relations Board. “Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. “Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
