This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 of the Federal Acquisition Regulations (FAR), as supplemented with additional information included in this notice. Offers are being requested and a written solicitation will not be issued.

The solicitation number M00264-22-Q-4586 is issued as a request for quotation (RFQ) using FAR Part 13 procedures.

This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-04.

This opportunity is 100% Set-Aside for Small Business and the associated North American Industrial Classification System (NAICS) code is 315210 with a small business size standard of 750 employees.

The action resulting from this opportunity will be a Firm Fixed Price (FFP) Purchase Order.

DESCRIPTION OF REQUIREMENT:

Shorts Salient Characteristics:

• Style: must be mesh basketball shorts

• Color: Must be olive drab

• Material: must be 100% Polyester

• Leg Length: all sizes must be at least 17 inches from bottom of the waist band to the knee/leg opening. Tolerance Intervals of +/- 0.5 inches will be considered

• Must have a white drawstring on the inside front of the shorts

• Must have a small mesh pocket located on the inside of the shorts approximately 4 ½ inches to the right of the drawstring. Tolerance Intervals of +/- 0.5 inches will be considered

• Small mesh pocket must be approximately 2 inches in width and 4 ½ inches in length

• Embroidery: all shorts must have a USMC gold and white Eagle Globe and Anchor

(EGA) and the capitalized letters “MCJROTC” embroidered on the front left leg of the shorts, per Exhibit A and B.

• Quality Assurance: To be considered for award, Quoters/Offerors are advised to provide 1 Large (L) sample pair of shorts that demonstrates appearance and measurements. Samples shall be provided at no expense to the Government; and returned at the Quoters/Offerors’ request and expense, unless the samples are destroyed per Quoters/Offerors’ request.

Embroidery Specifications

• From the bottom of the left leg to the top of the emblem must have a measurement of 5 inches

• EGA must be 2 ½ inches tall and 2 inches wide.

• Eagle, continents, and anchor are to be colored gold.

• Globe is to be colored silver with lines of latitude being colored black.

• MCJROTC letters must be centered and directly under the EGA

• Letters must be ½ inches tall and ¼ inch wide.

DELIVERY DATE AND LOCATION

Required Delivery Date: within 8 weeks after date of Purchase Order. Quoters/Offerors must specify the soonest possible delivery date.

Location: Multiple delivery locations per Exhibit C.

Note: FOB Destination required. Delivery charges must be included in item price

The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition.

The provision at 52.212-2, Evaluation-Commercial Items, applies to this acquisition as follows:

(a) The Government will award a contract resulting from this solicitation to the responsible quoter/offeror (Contractor) whose quote/offer conforming to the solicitation will be most advantageous to the Government.

(a)(1) The basis for award is PRICE AND OTHER FACTORS per FAR 13.106-1(a)(2).

(a)(2) Evaluation procedures per FAR 13.106-2(b)

All quotations or offers will be ranked in order of lowest price to highest price. The lowest-priced quote shall be evaluated first. If the lowest-priced quote/quoter; (i) conforms to all matters with respect to the solicitation; (ii) has satisfactory past performance and; (iii) provides a fair and reasonable price: then no other quotes/quoters will be evaluated for award.

Conforming to all matters with respect to the solicitation:

Quotes/Quoters must clearly demonstrate the quoted items meet or exceed the salient characteristics or extended description of supplies/services; must address each general and performance requirement with respect to the Statement Of Work; must specify delivery dates; and must meet all the terms and conditions of the solicitation.

Past Performance:

The apparent successful, prospective contractor shall have satisfactory past performance.

Past Performance shall be evaluated in accordance with FAR 13.106-2(b)(3)(ii) and DFARS 213.106-2(b)(i). Contractors are encouraged to submit letters of recommendation from other U.S. contracts.

Price:

Before making the award, the Contracting Officer will use FAR 13.106-3(a) to determine that the apparent successful, prospective contractor proposed price is fair and reasonable.

Quoters/Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with its quote/offer.

The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition.

The clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, and the below FAR clauses cited in the clause are applicable to the acquisition: 52.204-10; 52.209-6; 52.219-6; 52.219-28; 52.222-3; 52.222-19;

The Defense Priorities and Allocations System (DPAS) and assigned rating do not apply.

Quotes/Offers received after this date and time may be deemed ineligible for award.

Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract.
