JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION FOR ACTIONS GREATER THAN THE SIMPLIFIED ACQUISITION
THRESHOLD AND ACQUISITIONS PURSUANT TO FAR 13.5 – SIMPLIFIED PROCEDURES
FOR CERTAIN COMMERCIAL ITEMS
1. Contracting Activity.
The Regional Contracting Office – National Capital Regional (RCO-NCR), Marine Corps Installations National Capital Region - Marine Corps Base, Quantico, VA (MCINCR-MCBQ).
2. Description of Action Being Approved.
This J&A authorizes and approves the award of a sole-source, firm-fixed price contract to the New York City Fire Department (FDNY), Fire Academy, 1 Randalls Island, Randalls Island, NY 10035 to conduct search and fire rescue training.
3. Description of Supplies/Services.
The Chemical Biological Incident Response Force (CBIRF) requires training in order to maintain proficiency with effective Chemical, Biological, Radiological, Nuclear and Explosives (CBRNE) response Tactics Techniques and Procedures (TTP’s) within the city of New York City and in collaboration with the Fire Department of NY (FDNY). FDNY’s advanced search and rescue training is the most advanced in the country, as they respond to the most frequently occurring and unique major emergencies (Fires, Structural Collapses, ehicle Accident, HAZMAT Incidents etc.) compared to any other city in the United States. FDNY personnel provide valuable lessons learned to CBIRF personnel through inter-agency transfer of TTPs to be utilized in the event of joint response to a CBRNE incident in the New York City area.
As history has represented by the 9/11 attacks, New York City is unique in that it is a high terrorist target area, with critical, national assets such as the New York Stock Exchange and the United Nations. New
York City is the largest financial district in the United States and the Americas and the second
Worldwide. The city is also one of the largest populated cities in the United States. Such characteristics differentiate New York City from any other city in the United States, especially as a targeted area for terrorist attacks.
Search and rescue training efforts were established in 1998 due to the high threat target area of New
York City and is continuously required in order to maintain the continuity of CBIRF/FDNY CBRNE response tactics. CBIRF has continuously provided operational support to NYC in support of Papal visits and UN General Assembly Meetings. This relationship continues due to the ever changing threat to this nation and the requirement for CBIRF and FDNY to be most ready when the nation is least ready. This mutual relationship can only be maintained by annual training between the 2 entities. CBIRF is a Tier1 asset to the president of the United States and is a military unit with multiple force rotations on a 2-3 year basis. The only way to maintain the requisite skillsets to meet CBIRF’s mission is to continually train with the best possible forces available. The training requirement will be separated into two iterations, as follows.
Period of Performance for 1st Iteration: June 19 2016 - June 25 2016
Period of Performance for 2nd Iteration: Sept 10 2016 - Sept 17 2016
This training will include ride-along sessions with rescue and hazardous materials units, a large scale multiple agency training exercise and a threat assessment site walk through of the September 11th, 2001 attack on the World Trade Center.
The total value of this requirement is estimated at $270,219.62
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. Section 2304
(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One
Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
5. Rationale Justifying Use of Cited Statutory Authority.
The goal of this acquisition is to acquire training support services and ride-along opportunities with the members of the FDNY. Training in the areas of Civil Support Exercise and City of New York
Familiarization Training are required under this contract action. Civil Support Exercise comprises planning and execution of Civil Support scenario based Initial Response Force level exercises for up to
160 personnel. Exercise consist of at least three days of technical specialty training, and one 24 hour continuous operation (or several lesser operations adding to 24 hours) in the City of New York. The City of New York Familiarization Training comprises training exposure to City of New York footprint, logistics and Standard Operating Procedures of local emergency response entities.
The required competencies resulting from training and ride-alongs will promote efficient, collaborative, and cooperative CBRNE response efforts between CBIRF and the FDNY in the event of an attack on the city of New York City or in the event entities from both agencies were called to a mutual response.
Furthermore, New York City’s Incident Management infrastructure is unique in composition and application, requiring training and practical application to ensure competency within CBIRF, in the event that CBIRF is called to assist the city of New York in a large scale terrorist attack. By conducting this training directly with FDNY, CBIRF maintains their ability to respond effectively in the event of a
CBRNE incident within the New York City area. As a result, an essential aspect of this training is the opportunity to develop first-hand experience from the first responder level all the way up to the city emergency management office in how New York City would coordinate and execute a response to a major terrorist attack. Since New York is a prime terrorist target with unique terrain and considerations, this training cannot be replicated elsewhere and provide the practical experience working with the actual local government of the area of interest. The value of the training obtained under this effort will allow
CBIRF to better assist the City of New York in an instance of an emergency or attack. It will also improve CBIRF’s knowledge, experience and emergency response skills that can be used to support other cities across the United States or globally. CBIRF could also respond to a Department of Defense mission in a combat environment during which training received at FDNY could be applied.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible
A sources sought announcement was synopsized on FEDBIZOPPS to conduct market research and determine the availability and technical capability of potential sources. This announcement was synopsized under M00264-16-RFI-0408 on 15 December 2015. To date, no responses were received.
7. Procurement History.
This requirement was previously satisfied by the City of New York under a sole source award. The contract numbers include:

8. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.
The fair and reasonableness of the price will be based on a price analysis of historical pricing of FDNY’s previous completed contracts. It is anticipated this analysis will be conducted using historical pricing and experienced technical representatives, with direct knowledge of all disciplines being sought, and an experienced Contracting Officer, with direct knowledge and access to previous competed contracts for comparable training events.
9. Actions to Remove Barriers to Future Competition.
The requiring activity will engage in regular market research initiatives to identify other city and state government entities as well as private sector sources to acquire civil support and city familiarization training to maintain proficiency with effective CBRNE response TTP’s.
