SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

The following have been modified:

ADDENDUM 52.212-1

1. OFFER ACCEPTANCE PERIOD AND ALTERNATE OFFERS

1.1 Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

1.2 Multiple and/or Alternate offers. Offerors are encouraged to submit multiple quotes presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation.

Each offer submitted will be evaluated separately. Offerors are encouraged to identify why the acceptance of an alternate quote would be advantageous to the Government.

2. SPECIAL NOTICE TO OFFERORS

The Government intends to evaluate quotes and award a contract after quotes are ranked in order of lowest price to highest price. The lowest-priced quote shall be evaluated first. If the lowest-priced quote is technically acceptable, no other offers will be evaluated.

Therefore, the offeror’s initial quote should contain the offeror’s best terms from a price and technical standpoint. The Government will award without discussions as it is in the Government’s best interest.

2.1 Failure to submit any of the information requested by this solicitation may be cause for unfavorable consideration.

3. CONFIDENTIAL INFORMATION

The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of contract qualifications and quotes submitted to federal agencies. If an offeror’s submissions contain information that he/she believes should be withheld from such requestors under FOIA on the grounds that they contain “trade secrets and commercial or financial information” [5 USC§552(b)(4)], the offeror should mark its submissions in the following manner:

The following notice should be placed on the title page: “Some parts of this document, as identified on individual pages, are considered by the submitter to be privileged or confidential trade secrets or commercial or financial information not subject to mandatory disclosure under the Freedom of

Information Act. Material considered privileged or confidential on such grounds is contained on page(s)

Each individual item considered privileged or confidential under FOIA should be marked with the following notice: “The data or information is considered confidential or privileged, and is not subject to mandatory disclosure under the Freedom of Information Act.”

4. SOLICITATION RESPONSE REQUIREMENTS

4.1 GENERAL

The offeror shall submit documentation illustrating their approach for satisfying the requirements of this solicitation. Quotes must be clear, coherent, and prepared in sufficient detail for effective evaluation of the offeror’s quote against the evaluation criteria. Unnecessarily elaborate brochures or other presentations beyond those sufficient to present a complete effective response to the solicitation are not desired.

The offerors shall describe their quotes, through the use of graphs, charts, diagrams and narrative, in sufficient detail for the Government to understand and evaluate the offer. In its evaluation, the

Government will consider the degree of substantiation of the offer in the quote volumes and in response to any discussions if held.

4.2 QUOTE VOLUME REQUIREMENTS

4.2.1 Paper Copies Format. Text shall be single-spaced, on 8½” x 11” paper (except as specifically noted), with a minimum .75 inch margin all around. Pages shall be numbered consecutively. A page printed on both sides shall be counted as two pages. Submission as double-sided printing/copying on recycled paper is encouraged. Offerors may use 11” x 17” sized fold-out pages for tables, charts, graphs, or pictures that cannot be legibly presented on 8½” x 11” paper. An 11” x 17” is a two-sheet equivalent

(with regards to the page count limitations). Print shall be of a minimum 12-point font size or a maximum

10 characters per inch spacing. Bolding, underlining, and italics may be used to identify topic demarcations or points of emphasis. Graphic presentations, including tables, while not subject to the same font size and spacing requirements, shall have spacing and text that is easily readable.

Each volume in the quote shall include a copy of the cover letter (letter of transmittal), title page and table of contents. The table of contents shall list sections, subsections and page numbers. Each acronym used shall be spelled out in the text the first time it appears in each quote volume.

4.2.2 Electronic Copy Formats.

In case of conflict between the paper copy and the electronic copy of the quotes submitted, the paper copy shall take precedence.

Both the paper copy and electronic submissions must arrive by the stated deadline in order for a quote to be considered complete and to be evaluated.

Failure of any portion of the quote to arrive by the stated deadline will result in rejection of the entire quote.

Text and graphics portions of the electronic copies shall be in a format readable by Microsoft (MS) Word

2010. Data submitted in spreadsheet format shall be readable by MS Excel 2010. Adobe Acrobat pdf format is also acceptable.

4.2.2(a) CD/DVD The offeror may submit quote information in electronic format via a CD or DVD enclosed with the paper copy quote submission. The CD or DVD shall be “read-only” format.

4.2.2(b) Email Electronic submission via email is authorized. Send email to both the Contracting Officer and Contract

Specialist identified in this solicitation.

Note: Offerors submitting via email must ensure that attachments do not exceed 5 MB; offerors with attachments larger than 5 MB must split their response into multiple emails to meet the 5 MB attachment limitation. In addition, .zip files will be filtered and removed by the MCRDPI firewall. Offerors must rename the .zip file or send in an alternate format.

4.2.2(c) File Transfer Offerors may submit via the Safe Access File Exchange (SAFE): https://safe.amrdec.army.mil/safe/

When uploading a file to the SAFE system, ensure that the solicitation number is included in the description of the file.

4.2.4 Submission Due Dates. SEE SF1449 FOR DUE DATE (BLOCK 8)

4.2.5 Restriction of Disclosure/Proprietary Information. If the offeror wishes to restrict the disclosure or use of its quote, mark the title page with the following legend:

“This quote includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed -- in whole or in part -- for any purpose other than to evaluate this quote. If, however, a contract is awarded to this offeror as a result of -- or in connection with -- the submission of this data, the

Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government’s right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and Mark each sheet of data it wishes to restrict with the following legend: Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this quote”

4.2.6 Cross Referencing. Each volume, other than the Price volume, shall be written to the greatest extent possible on a stand-alone basis so that its content may be evaluated with a minimum of cross-referencing to other volumes of the quote. Cross-referencing within a quote volume is permitted where its use would conserve space without impairing clarity. Hyperlinking of cross-references is permissible.

Information required for quote evaluation, which is not found in its designated volume or cross-referenced, is assumed omitted from the quote.

4.2.7 Electronic Submission of Quote.

(a) By submission of a quote on electronic media, the offeror must ensure that the submission is readable, in the format specified in the solicitation, and has been verified as free of computer viruses. Prior to any evaluation, the Government will check all files for viruses and ensure that all information is readable. In the event that any files are defective (unreadable), the Government may only evaluate the readable paper files. Further, if defective (unreadable) media renders a significant deficiency in the offeror's quote, the

Government may consider the quote incomplete and not consider such quotes for further evaluation.

(b) The offeror must ensure that:

(1) The electronic and paper copies of its quote submitted in response to the solicitation are identical;

(2) It has verified that the electronic quotes are free of computer viruses using standard commercial anti-virus software.

(c) A quote that fails to conform to the requirements of paragraphs (a) and (b) above may be subject to interception or delay at Governmental electronic communications portals. This interception or delay may result in the quote being lost, deleted, destroyed, or forwarded in such a manner that the quote arrives at the target destination past the time and date of the deadline for submission established in the solicitation.

In the event that a quote is lost, deleted, or destroyed due to the offeror's failure to conform to the requirements of paragraphs (a) and (b) above, such quote will be considered to have never been delivered to the Government. In the event that a quote is delayed due to the offeror's failure to conform to the requirements of paragraphs (a) and (b) above, the quote will be treated as late in accordance with the provision of this solicitation entitled Late Submissions, Modifications, and Withdrawals of Quotes, FAR

52.212-1(f).

4.3 COMMUNICATION WITH THE CONTRACTING OFFICE

4.3.1 Site Visit: In accordance with FAR 52.237-1, a site visit is scheduled for 2:00 PM Eastern, Monday

31 JUL 2017. Site Visit location: Regional Contracting Office, Marine Corp Recruit Depot- Parris

Island, SC, 29905. Prospective attendees must contact Terri Collins, terri.collins@usmc.mil on or before

Friday, 28 JUL 2017 with a list of attendees, cc all email communication to chad.dando@usmc.mil.

4.3.2 Questions and Answers: Solicitation information and amendments will be posted to the Federal

Business Opportunities website at www.fbo.gov. Offerors may e-mail written questions requesting clarification of the RFQ to the Government via the Contract Specialists, Terri Collins at:

Terri.Collins@usmc.mil and Randy Wentworth at randy.wentworth@usmc.mil, and copy the Contracting

Officer, Chad Dando at: chad.dando@usmc.mil. The Government will answer questions received up to ten (10) days prior to the solicitation closure and will provide responses to interested parties via an amendment to the solicitation. Questions received after this date may not be answered.

4.4 COVER LETTER/REPS AND CERTS (VOLUME I)

The quote shall be accompanied by a cover letter (letter of transmittal) prepared on the company’s letterhead stationery. The cover letter (letter of transmittal) shall identify all enclosures being transmitted and shall be used only to transmit the quote and shall include no other information. This cover letter shall also contain:

1) The solicitation number

2) Name (including CAGE, DUNS, and TIN), address, and telephone and facsimile number and electronic address of the offeror

3) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item.

4) Names, titles, and telephone and facsimile numbers, and electronic addresses of persons authorized to negotiate on the offeror’s behalf with the Government in connection with this solicitation

5) Name, title, and signature of person authorized to sign the quote. Quotes signed by an agent shall be accompanied by evidence of that agent’s authority, unless that evidence has been previously furnished to the issuing office.

The offeror must submit acknowledgement of any amendments issued prior to the closing date of the solicitation. In addition, Offerors shall complete provisions and submit with proposal as identified in Section K of the SF 1449 solicitation.

4.5 TECHNICAL FACTOR REQUIREMENTS (VOLUME II)

Offerors shall submit a detailed technical quote in compliance with conditions of this solicitation. At a minimum, the technical quote shall provide the following:

1. List of recommended equipment aligned with the product requirements listed in Sections B and

C.

2. Rigging and installation plan in accordance with the guidelines provided in Section C to include proposed timelines for installation.

3. Equipment Start-up/demonstration plan.

4. Training and Maintenance Plan.

5. Warranty plan.

6. Listing of factory authorized, local (located in the SouthEast) service agencies, indicating the address, telephone number, and name of person to contact.

Removal and disposition/trade in of existing equipment shall also be included in the unit prices of the new, equipment.

The technical approach shall contain sufficient information to make a thorough evaluation and a sound determination as to whether the proposed quote is adequate to meet the Government requirements. The

Technical Approach shall be specific, detailed, and sufficiently complete to clearly and fully demonstrate the offeror’s total comprehensive knowledge and understanding of the requirements and technical problems inherent to the work required. Generalized statements within the quote, such as, “standard procedures will be employed”, or “well known techniques will be used,” will be considered technically inadequate. Paraphrasing any part of the solicitation will also be considered inadequate.

Offeror’s should note that data submitted prior to the quote submission will not be considered in the

Government’s evaluation. Therefore, such data should not be relied upon nor incorporated in the technical quote by reference. All offerors are encouraged to submit substantial detail in response to this factor.

4.6 PAST PERFORMANCE REQUIREMENTS (VOLUME III)

The contractor must submit three (3) references, which shall be relevant contracts completed within the past three (3) years similar in technical scope, complexity to this requirement. Prefer at least one (1) of which shall be a military customer, who can provide a recommendation regarding the offeror’s experience and expertise in industrial laundry equipment installation.

The offeror has both the duty and discretion to determine which of its prior contracts are most relevant to the currently described requirements. However, the offeror should consider that the Government shall give special attention to past performance relating to the United States Federal Government. Commercial contracts will be considered.

If the offeror is unable to provide three (3) relevant contracts for past performance evaluation, a lesser number may be submitted. If an offeror does not submit any or less than (3) references, the offeror shall affirmatively state it only has a certain number of references or state it has none at all. If the offeror affirmatively states it has no references, such offerors shall be assigned a past performance rating of

"Neutral-Unknown Confidence”.

4.7 PRICE FACTOR REQUIREMENTS (VOLUME IV)

The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

Section B “Pricing Schedule” shall be completed by the offeror in accordance with the following all prices contained in the pricing schedule shall be inclusive of shipping and trade in of existing equipment. A separate CLIN is provided for installation and rigging. The offeror shall provide a breakdown of the unit pricing for CLINS 0001 and 0002.
