Funding Document Number: N3225320MP14146 Contract Number: To Be Determined (TBD) Order Number: TBD Estimated Value: XXXXXSSSSSS North American Identification Code: 541519, $30 million sales size standard

3. Statutory Authority: 10 U.S.C. 2304(c)(b) and Regulatory Authority of Federal Acquisition Regulation (FAR) is FAR 13.106-1(b)(1): Soliciting from a single source for purchases not exceeding the simplified acquisition threshold. Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name or industrial mobilization).

4. Description of Action

The Pearl Harbor Naval Shipyard requires brand name, commercial, proprietary Accusoft Prizm Active X Viewer Server software, upgrade, and support. The software support is required to receive the latest version, security and stability updates. The total estimated lifecycle amount of this procurement XXXXXXXX. The 1-year period of performance is June 29, 2020 – June 28, 2021. Fiscal year 2020 Navy operation and maintenance funds have been provided on military interdepartmental purchase request N3225320MP14146. The PHNS Secured Network (SECNET) Citrix Servers requires the Accusoft software, upgrade, and support is required to sustain the Navy infrastructure and fleet.

The Shipyard has invested in XXXXXXXXXXXXXXXXX Accusoft Prizm Viewer software since 2015. The PHNS nuclear and non-nuclear engineers/technicians use the Accusoft software to view classified nuclear submarine system technical manuals. Some of these manuals are only available in their electronic format. These manuals and supporting Accusoft software tools are integral to safely operating nuclear submarines, including writing and executing submarine repair procedures, troubleshooting sensitive nuclear/non-nuclear submarine systems, and maintaining the fleet. The Department of Energy (DoE) and their support contractors for the Department of Navy (DON) produce electronic nuclear submarine technical manuals that require the sole use of Prizm Viewer to view them, per Naval Sea Systems Command (NAVSEA) Naval Reactors (08R) license. The SECNET information technology software and infrastructure is operated, maintained and kept technologically up-to-date in accordance with the DOE Naval Nuclear Propulsion Program (NNPP) Net Web and DON requirements to support the Shipyard’s mission. This software must be used to access information on the DOE Naval Nuclear Propulsion Information or NNPI Net Web.

The NNPI Web permits access to classified data not available on any other web network.

Without this software to access the web data on the NNPP Net, the Shipyard users will not be able to complete their mission of overhauling nuclear submarines.

The Accusoft Prizm Active X Viewer Server software, upgrade, and support are required for the PHNS to sustain the infrastructure used on Navy workstations and servers. The PHNS SECNET's Authority to Operate would be jeopardized without this procurement. A stop work condition of both nuclear and non-nuclear submarine repair work could result. The PHNS SECNET supports the PHNS & Intermediate Maintenance Facility, as well as Puget Sound Naval Shipyard. The software is required for mission critical work of engineers and radiological emergency responders at Oahu, Guam, and Japan (Yokosuka). The PHNS SECNET shut down risk translates into severely degraded emergency control center (ECC) operational readiness in all three locations (Oahu, Guam, and Japan). The associated ECCs could lose accreditation and their NAVSEA 08R radiological emergency response license. Should accreditations and licenses be revoked, authority to conduct naval nuclear ship repair/maintenance would halt, severely impairing the operational readiness of nuclear ships in the Pacific fleet. The PHNS SECNET is integral to daily nuclear ship repair/maintenance activities and a shutdown of the PHNS SECNET will halt all nuclear ship repair/maintenance at the above locations. The stop work condition would affect both nuclear and non-nuclear submarine repair work. The estimated daily cost of the stop work condition iXXXXXXXXX. Without this procurement, the Navy would be unable to return ships to active service, which will affect mission readiness.

5. Proposed Sole Source Contractor: Accusoft Corporation is the proprietary owner and the sole provider for the requirement detailed in Section 4. There are no authorized resellers. Accusoft Corporation owns all proprietary rights to the software code. The Accusoft Prizm Active X Viewer Server software, upgrade, and support are the only products that can meet the minimum needs of the Government, identified in Section 4.

6. Market Research:

Market Research has confirmed only the software owner or original equipment manufacturer (OEM) can provide the required software. The Accusoft Prizm Active X Viewer Server software, upgrade, and support are only available in an open-market order to Accusoft Corporation, the small business, OEM. The software is not available through any reseller or through any Government-wide Acquisition Contract, including Enterprise Software Initiative Blanket Purchase Agreement, General Services Administration, and National Aeronautics Space Administration Solutions for Enterprise Wide Procurement. The solicitation will be emailed to the OEM. All available discounts will be requested to this technically acceptable price reasonable requirement. The sole source requirement, Government intent to issue a sole source order to the OEM, and the redacted sole source justification document will be posted to the Contracting Opportunities (beta.sam.gov) website.

Based on current market research, dated May 2020, it has been determined that only the aforementioned brand-name product and/or product support provided by Accusoft Corporation, can fully support the Government’s need. This requirement is for proprietary products and/or product support and no competitor functional replacement products exist in the market at this time to meet the Government's need. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions, i.e. there are similar products and/or product support in the marketplace that provides the same functionality, the OEM releases ownership rights of product, or it is economically feasible to procure a new system.

7. Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this sole source justification for the proposed contract action pursuant to the authority cited above as the particular brand-name product is essential to the Government's requirements, and market research indicates other companies' products or services do not meet, or cannot be modified to meet, the agency's needs.

Based on the justification provided by the Navy, a determination has been made to issue a sole source solicitation to Accusoft Corporation, the OEM, for the above-described requirement.
