LIMITED-SOURCES JUSTIFICATION (LSJ) FOR MULTIPLE-AWARD SCHEDULE

PROGRAM

Upon the basis of the following justification, prepared in accordance with Federal Acquisition Regulation (FAR) 8.405-6(c), this justification is hereby provided for approval of the use of sources limited to fewer than those required in FAR 8.405-2, pursuant to the authority of 41 U.S. Code (USC) 251 as implemented by FAR 8.405-6(a)(1)(i)(A).

Identification of the agency and the contracting activity.

U.S. Department of Justice, Federal Bureau of Prisons (Bureau), Central Office, Administration Division, Acquisitions Branch, Technology Procurement Section.

Nature and/or description of the action being approved.

This requirement will be a single firm-fixed price order for administrative and technical product support service that requires a statement of work. This requirement is being procured under NTT Data Federal Services (NTT) General Services Administration (GSA) Federal Supply Schedule GS-35F-518GA.

Description of Supplies/Services required to meet the Agency’s Needs:

The Bureau requires technical and administrative contractor assistance to establish a Program Management Office (PMO)

. The PMO will be located within the BOP’s Reentry Services Division and thus primarily supportive of the branches therein, principally the Education Branch, the Women and Special Population Branch and the Psychology Services Branch. Work will also require coordination with the BOP’s Office of Information Technology, primarily the IT Planning and Development (ITPD) Branch and the Computer Services Administration and User Support Branch. The period of performance will be for twelve (12) months commencing August 1, 2023 through July 31, 2024.

The estimated value of this procurement is not expected to exceed $1,172,567.44.

The authority and supporting rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service:

This Limited-Sources Justification rationale is supported through the implementation of FAR 8.405-6(a)(1)(i)(A) – An urgent or compelling need exists and following the MAS ordering procedures would result in unacceptable delays.

This requirement is crucial in supporting the Bureau’s process of integrating tablets to the inmate population, which provides approved commercial and Bureau specific content, initiated as a result of the federal legislation Fi st Step Act (FSA) of 2018, Public Law (P.L. 115- 391).

The Bureau has an active Blanket Purchase Agreement (BPA) call 15BNAS21F00000050 procured through the Drug Enforcement Administration (DEA) BPA 15DDHQ19A00000002 contract vehicle, which is in the first option year performance period and expires on July 31, 2023. The Bureau was notified that it will not be able to utilize the BPA for the second and final option year, thus a new contract vehicle must be established for continued contractor performance. The current contractor, NTT, has provided performance for a period of two years under this requirement for the Bureau. NTT has staff onboarded (Program Manager and Program Specialists) who’ve completed their background investigations, have agency issued contractor Personal Identity Verification cards, and Government Furnished Equipment, all necessary to complete the tasks of the requirement.

Determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d):
