Justification and Approval for Other than Full and Open Competition

J&A Tracking No.

1. Identification of the agency and contracting activity: DHA CA – WESTERN MARKETS

CONTRACTING DIVISION SAN DIEGO

2. Nature and/or Description of Action being approved: Request approval for a new contract to purchase two (2) surgical tables (manufacturer part # ST015210002) along with accessories and its installation by OEM STERIS technicians.

3. Description of Supplies/Services: U.S. Naval Hospital Main Operating Room is requesting two (2) STERIS 5095 surgical tables to replace existing surgical tables which is over its life.

Surgical table is used during various types of surgeries with accessories made for each specialties’ requirement. This equipment is the standard of care for the operating room and is familiar equipment to the anesthesia, RNs, providers, and technicians using the equipment.

4. Statutory and Regulatory Authority Permitting Other Than Full and Open Competition (see FAR 6.302), or the Specification of the Statutory and Regulatory Provision Providing Exception to 8(a) Program Competitive Requirements (see FAR 19.805-1): 10 U.S.C.

2304(c)(1) 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

5. Rationale Justifying Use of the Statutory Authority Cited: This specific STERIS surgical table is essential for the USNHO MOR to provide high quality patient care service. All users are trained for this brand unit and this request is for direct replacements to procure the latest model STERIS surgical table. Our surgical technicians and RNs also have extensive experience and are trained with STERIS products. Purchase of a different equipment will require re-training of our Surgical Techs and staffs. Since USNHO MOR still have two (2) STERIS surgical tables within their life, using two or more OEM types of surgical tables will undoubtedly cause errors/confusion and may negatively impact patient care. Maintaining standardization to a single STERIS surgical table will ensure that care is provided efficiently and effectively. All efforts must therefore be employed to maintain uniformity of the surgical table.

Furthermore, USNHO already have contract # HT941023P0036 with OEM STERIS which covers preventive maintenance and emergency services for STERIS products to include nine (9) Operating tabletops throughout USNHO. Any newly purchased STERIS surgical tables can be simply replaced with the over-life tables on the contract.

6. Efforts to Obtain Competition: Market Research was conducted. Stryker offers a surgical table; however, it is almost double to price as Steris, USNH Okinawa currently does not have a maintenance contract with Stryker.

7. Determination that Anticipated Cost to the Government will be Fair and Reasonable:

When compared with equivalent Stryker surgical table (OPERON D 860 item # OT 8602065)

ECAT price, the quoted total pricing to include installation is 45.87 % lower than the Stryker table ECAT price.

8. Market Research: Market research was conducted through mandatory sources, Cardinal Health, E-CAT and GSA Advantage. Accessories are partially available through ECAT and GSA, however, main surgical table is not available through the mandatory sources. Request to add main table to ECAT catalog has been placed since Jan 2023, but the request could not be completed as of 21 Jul 2023.

9. Other Facts: Two (2) Steris surgical tables are 2 years past its end of life (January 2021) and have been succeeded by two models of Steris operating tables to 4085 and 5095. The current model (5095) is the standard of care and required for routine and emergent surgical procedures.

Also purchasing of non-STERIS surgical table will require new contract issuance for maintenance after warranty period since USNHO doesn’t have surgical table maintenance contract besides STERIS. Steris offers superior performance and there is a local Steris sales representative who can be available for training and maintenance. Tripler Army medical center recently received Stryker beds and reported issues with hand control pieces and dents in base of table.

Actions to overcome barriers: Naval Hospital Okinawa and the DHA Western Markets Contracting Division will continue to survey and engage the market of any potential vendors that can provide a STERIS surgical table and will consider competing future requirement if there are other vendors capable of meeting the requirements. In addition, review and due diligence will be conducted by the Government for any vendor submitting capability statements for STERIS surgical table.
