Limited-Sources Justification (LSJ) - FAR 8.405-6 For orders or BPAs exceeding the Simplified Acquisition Threshold (SAT)

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C.

152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.

1. Agency and Contracting Activity. Identification of the agency, contracting activity, and specific identification of the document as a “Limited-Sources Justification.”

The Department of Homeland Security (DHS), Customs and Border Protection (CBP), Office of Acquisition, proposes to award an order to Booz Allen Hamilton under CBP’s Enterprise Business Management Support Services Blanket Purchase Agreement 70B04C19A00000002, established using Federal Supply Schedule Contract GS-35F-386DA, pursuant to FAR 8.405- 6(a), Limiting Sources.

2. Nature and/or description of the action being approved. Describe the action being approved, and include the name and address of the proposed contractor(s).

CBP intends to limit the number of sources solicited pursuant to FAR Part 8.405-6(a) for the procurement of services to upgrade and maintain proprietary software to Proposed Contractor:

Booz Allen Hamilton, 8283 Greensboro Dr., McLean, Virginia 221023830.

3. Description of Supplies/Services. Describe the supplies or services to be acquired. Provide the estimated total value (including options, if any).

The requirement is to provide the National Targeting Center (NTC) Counter Network Division (CND) with cyber threat software upgrades and support services for custom analytical support, and rapid prototype and methodology development, within Team valued at a total cost of .

The NTC CND supports CBP, DHS, and numerous interagency law enforcement and Intelligence Community (IC) members in developing an interoperable counter network process that enables a more comprehensive understanding of current and emerging threats. CND proactively collects, harnesses and applies the power of data science, intelligence, and advanced analytics against the most complex and intricate problem sets. CND analysts, along with CBP’s tactical targeting/analytical units, intelligence support cells, and enforcement units, use custom-developed tools, managed by , to exploit various data sources in their targeting, vetting, network development, and analytical workflows. The software support services enhance analysis for a comprehensive understanding of illicit networks (terrorism, human smuggling, narcotics, and illicit trade/finance) and illuminates opportunities to disrupt and dismantle illicit operations. This contractual investment will enable CBP personnel to make timely decisions informed by quality data, intelligence, and analytics, and provide CBP and DHS personnel greater access to the technology needed to protect our homeland.

Booz Allen Hamiliton is also embedded within CBP’s tactical teams throughout the National Capital Region, are forward deployed to multiple CBP Field Offices, operating on the tactical edge of CBP’s mission. This provides analytical leads/products that enable rapid vetting, targeting, and network development against individuals and cargo that pose a significant threat to the homeland. The level of efficiency and effectiveness at which Booz Allen Hamilton supports CBP operations is directly related to their experience with Team since 2016. Additionally, Booz Allen is the only contractor that can provide the required software upgrades/maintenance support without compromising warranties. Selection of any other source would result in unacceptable degredation in the quality of service and jeopardize national security.

5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).

The contracting officer has determined that issuing the proposed BPA Order to Booz Allen Hamilton for the upgrade and maintenance of software support services represents the best value and will result in the lowest overall cost, considering price and administrative costs, and schedule costs, to meet the Government’s needs. This order will be placed in accordance with FAR 8.405- 3(c). GSA and CBP have already negotiated fair and reasonable pricing rates. Additionally, prior to issuance of the BPA order, the ordering activity will consider the level of effort and the mix of labor proposed to perform the specific task being ordered in order to determine that the total price is reasonable. The contractor’s labor mix and level of effort will also be compared to the Independent Government Cost Estimate.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Based on the justification in Section 5, CBP indends to issue an order to Booz Allen Hamilton under BPA 70B04C19A00000002.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same item/service (e.g., the government intends to revise overly restrictive technical specifications, acquire data rights, or pursue some other means to increase future competition).
