Limited Source Justification (Acq Track #34443)
1. Contracting activity:
This Limited Source Justification supports a procurement action to be conducted under the authority of the Multiple Award Schedule Program (FAR 8.401). The procurement action is generated by Office of Personnel Management (OPM), Office of Procurement Operations (OPO).
2. Nature and/or description of the action being approved:
A BPA to allow the purchase of proprietary software licensing, support and hosting services from the manufacturer of that software, using the manufacturer’s own GSA Schedule contract.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value):
To support its mission, Facilities, Security, and Emergency Management (FSEM) purchased and implemented the FM:Interact Computer Aided Facility Management (CAFM) software tool in FY 2012. The CAFM software tool ensures that all space within the Theodore Roosevelt Federal Building (TRB) be assigned and used in a manner that reduces wasted space and provide maximum efficiency. The FM Interact system plays a vital role in the on-going assignment and management of space within the TRB and other government facilities by providing an accurate database of information on Program Office space and seating assignments; ensuring all staff is positioned to achieve maximum productivity and adherence to space allocation standards.
FSEM requires the ability to purchase the renewal of licensing, maintenance, hosting, and related services for the existing software, as well as any additional expansion modules available which may further assist it in completing its mission, professional setup and assistance services to implement any new modules, and training for new employees or new modules as needed.
A five-year FAR Part 8 BPA will be established with a maximum (ceiling) value of $500,000.00. Beyond the known requirement for Basic renewal services for software support, maintenance, license renewals, FEDRAMP hosting and Help Desk services, FSEM will have the ability to use this BPA to acquire upgrades, new modules or additional related services from the software creator.
4. Authority and supporting rationale permitting acquisition using limited sources:
[ ] FAR 8.405-6(a)(1)(i)(A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays.
[X] FAR 8.405-6(a)(1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
[ ] FAR 8.405-6(a)(1)(i)(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order, provided that the original
AT 34443 – LSJ – CAFM Page 2 of 3 order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
4.1. Demonstration that the contractor’s unique qualifications or the nature of the acquisition requires the use of the authority cited:
COMMERCIAL SOFTWARE is proprietary by nature and all licensing and maintenance/support services related to that software is also proprietary.
The maintenance, hosting, licensing and support for these software tools is proprietary in nature, as it was developed by FM:Systems. The requirement does not call for any services which cannot be acquired through FM:Systems’ GSA Schedule contract. There are no plans to replace the software in the foreseeable future, and as such, maintenance renewal and other associated services are required to ensure no disruption of current functionality.
5. Determination by the contracting officer that the order represents the best value consistent with FAR 8.404(d):
Based on the nature of the requirement, the solicitation will be issued to a single source, FM:Systems, GSA Schedule #GS-35F-0028T. Competition will not be sought. In order to determine that the anticipated order will represent the best value, the contracting officer and requesting activity will review previous orders and compare the requirement to the published pricing on GSA Schedule. Additionally, the vendor will be requested to provide any discounts available beyond the published GSA price. Per FAR 8.404 pricing provided for on the Federal Supply Schedule is already determined to be fair and reasonable.
6. Description of the market research conducted and the results or statement of the reason market research was not conducted:
Market research specific to this requirement was conducted by OPO. Market research indicates that the FM:Interact software products, and related services are only available from the owner of the proprietary software license, FM:Systems.
7. Other facts supporting the justification.
None
8. Statement of actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
If in the future the existing FM:Systems software no longer meets the government’s needs, or ceases to be supported by the manufacturer, OPM shall consider a competitive procurement to determine a different brand of software to meet its needs.
