LSJ-2022-007
Rev.:10/2020
The period of performance (POP) for the BPA was originally awarded for a total of 5 years from July 1, 2019 to June 30, 2024. This justification provides a reduced POP to 4 years with a revised end date of June 30, 2023. The requirements are expected to recompete a year early removing Option Period 4. There is insufficient estimated value to provide the requirement to the end of the revised BPA period of performance of June 30, 3023.
Authority Cited and Rationale:
FAR 8.405-6(a)(1)(A). An urgent and compelling need exists, and following normal procedures would result in unacceptable delays.
FAR 8.405-6(a)(1)(B). Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
FAR 8.405-6(a)(1)(C). In the interest of economy and efficiency, the new work is a logical follow-on to an original GSA FSS order provided that the original order was placed in accordance with the applicable GSA FSS ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
FAR 8.405-6(b), Items Peculiar to One Manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
Rationale:
BPA 80NSSC19A0005 was awarded as a result of NASA HQ Office of the Chief Information Officer (OCIO) requirement for Acquisition Management Support and Integrated Consulting Services. The services currently being provided by Gartner, Inc under this BPA include unique subscription memberships of Information Technology (IT) and non-government subject matter experts (SME) that have in-depth knowledge of new and emerging Information Technologies (IT) and experience in researching processes. The CIO community is required to stay abreast of new and emerging technologies and requires expert research and consulting services to help determine what technologies or processes could or should be implemented as well as understanding what best practices should be applied regarding those technologies. BPA 80NSSC19A0005 has been leveraged by the NASA CIO community to stay up-to-date with knowledge of current global trends, technology, strategic advice and research in IT products and services.
The increase in spending authority is necessary because NASA CIO have determined there is insufficient ceiling on BPA 80NSSC19A0005 to provide subscription membership and consulting support for NASA during Option Year 3 and a break in performance is unacceptable due to the importance in maintaining access to industry leading, highly specialized IT expertise, analysts, and strategic reports on current research and trends in the IT environment to make key strategic decisions is critical to the NASA CIO community during the Mission Support Future Architecture Program (MAP)/OCIO Transformation. As of June 1, 2022, $12,397,207.06 of the $12,730,991.88 ceiling has been obligated against BPA 80NSSC19A0005. To provide sufficient ceiling to carry to the end of the third option period, the NSSC estimates it will require a ceiling of $17,256,912.23, a $4.526 million increase over the current BPA ceiling. This recommendation is made pursuant to FAR 8.405-6(a)(1)(B).
NASA experienced a much greater increase in the required consulting and membership since the initial award of the BPA. In December of 2019, the Mission Support Council (MSC) Chair approved a mutually agreed to scope the OCIO MAP Team recommended and unconditionally approved the OCIO MAP project to move to the next Key Decision Point (KDP). BPA 80NSSC19A0005 was utilized to assist throughout the stages of the MAP transition such as providing input on the MAP Future Implementation Plan, as well as other components of OICO that experienced changes in scope due to MAP.
For example, one component of OCIO, the Enterprise Business Management Office (EBMO) is undergoing vast changes in alignment with IT changes at NASA relevant to MAP. The scope, visibility, responsibilities of EBMO significantly increased and had to improve financial transparency to support its migration from reporting financial data to proactively supporting data driven decision making across the Agency. The NSSC utilized BPA 80NSSC19A0005 to provide consulting support from Gartner to assist EBMO in identifying key gaps and prioritizing key areas for change in align with MAP Goals. This is only one example of the additional support NASA has required as part of the OCIO map transition.
A break in performance is not acceptable, as it would potentially lead to schedule delays in the MAP transition.
Determination by the contracting officer that the order represents the best value consistent with FAR 8.404(d):
The Contracting Officer’s signature on this document indicates that the Contracting Officer has determined that the anticipated cost to the government will be fair and reasonable. Prices are currently established in the BPA terms and conditions and are reviewed at the time each Option will be exercised to ensure prices within the BPA are still the most advantageous to the Government.
Market Research:
Given the highly unique subscription membership offerings, highly specialized IT expertise, analyst, strategic reporting capability, and familiarity with the current state of the NASA MAP Transformation, market research has shown there to be no available vendor capable of providing an effective proposal for providing proper support in such a short time frame.
Other Facts:
N/A
A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
The NASA Information Technology Procurement Office (ITPO) is currently establishing its acquisition strategy to procure the follow-on IT Consulting requirement to support future applicable NASA requirements. The anticipated award date is currently estimated to be in line with the period of performance end date of Option 3 for BPA 80NSSC19A0005 to ensure there is no lapse in service for future requirements. Therefore, recompeting the remaining duration of the current BPA would result in substantial duplication of effort regarding acquisition planning, evaluating contractor proposals, and post-award administration.
