☒ FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
a. The Government currently owns the Ysio Max Digital Radiographic System, located at IACH. A work order was placed with Clinical Engineering for a system malfunction with the equipment listed in paragraph 1 of the Performance Work Statement (PWS). Siemens is the original equipment manufacturer (OEM) of the Ysio Max Digital Radiographic System. The contractor shall supply one new OEM AX wi-D detector for the Ysio Max System. According to OEM, using refurbished detector will void the existing service contract for the Ysio System.
b. Purchasing similar maintenance that is non-compatible, would risk the possibility of equipment damage and possible disruption of patient care.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 ☐ do not apply due to the $ threshold, ☒ apply and will be followed, or ☐ do not apply due to an exception at 5.202.
7. Market Research: The Contract Specialist conducted a dynamic small business search with the NAICS code 811219 and the capabilities narrative “radiographic maintenance”, that revealed no small businesses that fit within these guidelines. A sources sought was posted to beta.SAM.gov from 19 March 2020 – 24 March 2020, with no responses.
8. Other Facts: Siemens equipment is serviced, repaired, and maintained only by OEM certified personnel. It is recommended for this to be a sole source award to Siemens.

Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the services or supplies herein described have otherwise been authorized for acquisition.
