LIMITED SOURCES JUSTIFICATION (FAR 8.405-6)

GS-35F-5370H
1. REQUESTING ACTIVITY: Millennium Challenge Corporation (MCC), Washington, DC.
2. NATURE AND/OR DESCRIPTION OF ACTION BEING PROCESSED: The requested action will be for a non-competitive extension against Distributed Solutions, Inc. (DSI) task order (MCC-12-TO-0061) for an interim period of one year.
DESCRIPTION OF THE SERVICES REQUIRED TO MEET THE AGENCY 'S NEEDS:
To provide a hosted solution to automate the tracking, management, and reporting for audit reports for a period of one year. The MCC Audit Tracking and Reporting System (MATRS) tracks and manages the audit and review engagements and the corresponding recommendation resolution process. The solution automates the tracking, management, and reporting of audit and review reports issued by the USAID Office of Inspector General (OIG), Government Accountability Office (GAO), Independent Public Accounting Firms (IPA), and other audit and review organizations.
Services are needed for one year because MCC will migrate and manage the system internally. Currently, DSI provides the hosting and services of the solution.
3. AUTHORITY PERMITTING LIMITATION OF SOURCES: The authority for Limiting
Sources in this case if FAR 8.405-6(a)(1)(B) -Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized."
MCC currently relies on DSI to host and manage the system that monitors and tracks all audits and reviews as well as following up on corrective actions for recommendations contained within audit reports issued by the IG, GAO, IPA’s, and other audit and review organizations. To migrate to another system or end the contract abruptly would cause the agency to miss audit response deadlines and potentially have a negative effect on the agency adhering to laws and regulations.
4. DEMONSTRATION THAT THE CONTRACTOR'S UN IQUE QUALIFICATIONS OR
NATURE OF THE ACQUISITION REQUIRES THE USE OF ONLY ONE
RESPONSIBLE SOURCE AUTHORITY:
DSI’s solution is proprietary and not available through any other provider. In addition, they provide hosting and support of MATRS, and the platform is only available from DSI.
MCC intends to transition the MATRS program internally and more time is needed to fully migrate from DSI’s solution into a system MCC will operate and manage. This process will conclude in FY 2018. Implementation of an audit and reporting system to replace MATRS would thus be a waste of resources and duplicative as such an implementation would only be in place for one year. As such, pursuit of a new system for the one year would not be in the Government's best interest, nor is it something that MCC has the budget to fund. Continuing to fund the existing system for a period of one year until the migration occurs is the most cost-effective and efficient approach.
5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIAL SOURCES AS DEEMED ACCEPTABLE:
No sources or methods have been discovered that would allow MCC to implement a new audit and tracking system to replace MATRS without undergoing a lengthy and costly system implementation process with a new vendor, a process that would be counter-productive given MCC's current efforts to migrate the system and bring it in house.
Solicitation of other sources, which would require MCC to fund an implementation which it lacks the funds to pursue, would only waste both MCC and industry's time and resources.
6. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED
COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE:
The additional hardware and services provided are lower than the contractor's Federal Supply Schedule contract.
7. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS OR
A STATEMENT OF THE REASONS A MARKET RESEARCH WAS NOT CONDUCTED:
Market research has not revealed any capability or alternative to procuring a new audit and tracking system. While Oracle, Appian, and Compusearch have been found to offer similar solutions based on numerous product demonstrations, a l l would require a new system implementation cost and process that MCC currently lacks budgetary resources to provide.
8. A STATEMENT OF THE ACTION IF ANY, THE AGENCY MAY TAKE TO REMOVE
OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING ANY
SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED:
This requirement will be fulfilled by MCC in FY 2018, as such, removal of further barriers to competition will not be a concern.
