LIMITED-SOURCES JUSTIFICATION

SUBJECT: LIMITED-SOURCES JUSTIFICATION

1. This document sets forth the facts and rationale justifying the use of limited sources, in accordance with FAR 8.405-6.

The United States Agency for International Development (USAID), Office of Inspector General (OIG) intends to award a contract to a vendor who will provide Microsoft M365 and Azure Subscription service licensing.

2. The nature and/or description of the action being approved:

USAID/OIG Information Management is seeking to acquire Microsoft M365 G5 Licenses. The period of performance will include a one-year base period and two, one year priced option periods. License quantity needed is 400 for the online G5 licensing. Additionally, the organization needs 60 licenses for MS Visio and Microsoft Project respectively. 20 SQL Server Enterprise Core and System Center DC Core licenses are also required for this software agreement. Lastly, Azure Cloud Subscription service is needed for this order (USAID/OIG will provide a monetary commitment for the cloud service subscription).

3. Description of the supplies or services required to meet the agency’s needs, including the estimated value:

MS M365 licenses will include the following productivity solutions:

4. Authority and supporting rationale (see 8.405-6(a)(1)(i) and (b)(1)) and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

Microsoft Enterprise Solution 5 is the only the productivity license that is used by USAID OIG.

Market Research indicated Microsoft productivity solutions provide the best package regarding communications and business solutions. The business decision to use Microsoft products is based on the ease of performance and the working populations’ general familiarity with the systems. USAID OIG has been a Microsoft shop for over 20 years. A transition would bring about a severe distribution to the agency’s mission. Transition difficulties include lack of general file storage and significant changes to the overall user experience. Continuity across systems is important for training and formatting purposes.

5. Determination by the ordering activity contracting officer that the order represents the best value consistent with 8.404(d).

The Contracting Officer has determined that posting the solicitation on NASA SEWP will provide the best value to USAID OIG. NASA SEWP is known for providing high quality results for IT related purchases, such as licenses. Microsoft Enterprise Solution 5 License is regularly purchased on the acquisition tool. NASA SEWP Contracts are FAR Part 12 Commercial Contracts with price analysis being performed in accordance with FAR 15.305(a)(1), which provides a discount off the offeror’s commercial list price.

NASA SEWP establishes reasonableness of proposed prices in accordance with FAR 15.403- 1(c)(1)(i)(B). This is done by having adequate price competition of two or more responsible offerors, competing independently submit priced offers. To verify price reasonableness, offerors are instructed to submit their published price catalog or published schedule of list prices in a form regularly maintained by the manufacturer or offerors, such as a catalog, price list, schedule or other verifiable and established record.

These discounts remain for the life of the contract. Therefore, when new technology is added or list prices change due to market fluctuations, the SEWP price remains fair and reasonable. All SEWP Delivery Orders are subject to Fair Opportunity. This internal competition provides an incentive for Contract Holders to provide the best possible price in order to be selected for award.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

Microsoft productivity and security solutions market research began by going directly to Microsoft who provided an updated list of 35 Microsoft licensed partners operating under NAICS code 334111. These partners are known as Microsoft Services Provider License Agreements (SPLAs). These vendors are the service providers for those who want to license eligible Microsoft products to host software services and applications to end customers. SPLAs provide the license rights to host specific Microsoft products monthly for up to a three-year term.

It was determined based on how the award was sourced prior to the last contract award that NASA SEWP would be the best vehicle to utilize in awarding this requirement. NASA SEWP has a pre-established group of 129 vendors under NAICS 541519 that closely matches many vendors on Microsoft’s SPLA list. Soliciting this grouping will allow for adequate price competition and provide flexibility by obtaining formal quotes with the intention of placing an order. Quotes will be verified to confirm all products are on contract and properly priced.

7. Any other facts supporting the justification.

USAID OIG is presently using Microsoft licenses every day for production services. These systems include a whole suite of Microsoft products that are used daily by staff. They are a vital function of the user experience. There is no current substitute for Microsoft based solutions and tools. Many other Federal Agencies and Business Partners use Microsoft. Use of substitute products would make sharing documentation more complex and difficult. Only certified Microsoft vendors have the right to license Enterprise level 5. This is highest level of Microsoft Licensing that can be purchased.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
